The Department of Justice in exercise of the powers conferred by section 1(1) of the Damages Act 1996(1), having consulted the Government Actuary and the Department of Finance(2) in accordance with section 1(4) of that Act, makes the following Order.

Citation and commencement

1.  This Order may be cited as the Damages (Personal Injury) Order (Northern Ireland) 2021 and shall come into operation on 31st May 2021.

Rate of return

2.  The rate of return referred to in section 1(1) of the Damages Act 1996 shall be minus 1.75 per cent.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order prescribes minus 1.75 per cent as the rate of return which, under section 1 of the Damages Act 1996, courts are required to take into account when calculating damages for future pecuniary loss in an action for personal injury.

1996 c. 48. Section 1(6) was inserted by Article 15(5) of, and paragraph 55 of Schedule 18 to the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order 2010 (S.I. 2010 No. 976). In their application to Northern Ireland, subsections (1) and (4) of section 1 are modified by subsection (6).
