The High Hedges (2011 Act) (Commencement) Order (Northern Ireland) 2012

The Department of the Environment makes this Order in exercise of the powers conferred by section 20 of the High Hedges Act (Northern Ireland) 2011(1).

Citation and interpretation

1.—(1) This Order may be cited as the High Hedges (2011 Act) (Commencement) Order (Northern Ireland) 2012.

(2) In this Order—

“the Act” means the High Hedges Act (Northern Ireland) 2011; and

“the Department” means the Department of the Environment.

Appointed days

2.—(1) 31st January 2012 is the day appointed for the coming into operation of the provisions of the Act specified in column 1 of the Schedule, for the purposes set out in column 3 of the Schedule.

(2) 31st March 2012 is the day appointed for the coming into operation of all provisions of the Act not otherwise brought into operation by this Order.

Section 4(1)FeesFor the purpose of enabling the Department to make regulations to prescribe the maximum fee which may be determined by a council under section 3(1)(b) of the Act
Section 4(4)FeesFor the purpose of enabling the Department to make regulations, in relation to a case where section 4(3) of the Act applies, for the payment to the council by any person who is an occupier or owner of the neighbouring land of a fee
Section 7(7)AppealsFor the purpose of enabling the Department of Justice to make rules under paragraph 7 of Schedule 9B to the Rates (NI) Order 1977 (NI 28) (procedural rules for Valuation Tribunal) in relation to appeals

EXPLANATORY NOTE

(This note is not part of the Order)

This Order provides for the coming into operation of the provisions of the High Hedges Act (Northern Ireland) 2011 (“the Act”).

31st January 2012 is the day appointed for the coming into operation of the provisions specified in column 1 of the Schedule (for the purposes specified in column 3 of the Schedule).

31st March 2012 is the day appointed for the coming into operation of all provisions of the Act not otherwise brought into operation by this Order.
