(This note is not part of the Regulations)
These Regulations, which are made under section 2(2) of the European Communities Act 1972 (c. 68), amend the Working Time Regulations (Northern Ireland) 1998. The Working Time Regulations (Northern Ireland) 1998 implement Council Directive 2003/88/EC (O.J. No. L299 18.11.2003, p.9) (which consolidates Directive 93/104/EC (O.J. No. L307, 13.12.93, p18) as amended by Council Directive 2000/34/EC (O.J. No. L195, 01.08.2000, p.41) as from 2nd August 2004).
The Working Time Regulations (Northern Ireland) 1998 impose (amongst other things) limits on the maximum weekly working time of workers and on the length of night work. Regulation 20(2) of those Regulations, which is revoked by regulation 3, provided an exemption from those limits in cases where a worker’s working time was partly unmeasured or determined by the worker himself.
See the European Communities (Designation) Order 1997 (S.I. 1997/1174)
S.R. 1998 No. 386; regulation 20(2) was inserted by regulation 5 of S.R. 2000 No.7; there are other amending statutory rules which are not relevant to these Regulations.
