The Department for Social Development, in exercise of the powers conferred by Article 1(2) of the Welfare Reform and Pensions (Northern Ireland) Order 1999(1), and now vested in it(2), and of all other powers enabling it in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Welfare Reform and Pensions (1999 Order) (Commencement No. 4) Order (Northern Ireland) 2000.

(2) In this Order any reference to a numbered Article or Schedule is to the Article of, or Schedule to, the Welfare Reform and Pensions (Northern Ireland) Order 1999.

Appointed days

2.  The day appointed for the coming into operation of—

(a)Article 12(1), (2), (3) and (11) (effect of bankruptcy on pension rights: approved arrangements), and paragraph 1 of Schedule 2 (income payments orders and bankruptcy) and Article 17 in so far as it relates to that paragraph, is 29th May 2000;

(b)Article 12(12) (treatment of pension credits) is 1st December 2000, and

(c)Article 64(3) and (4) (‘relevant age' for higher rate mobility component of disability living allowance) is 9th April 2001.

Amendment of the Welfare Reform and Pensions (1999 Order) (Commencement No. 3) Order (Northern Ireland) 2000

3.  In Part III of the Schedule to the Welfare Reform and Pensions (1999 Order) (Commencement No. 3) Order (Northern Ireland) 2000(3) for “Article 9, except the definition of “designated scheme” in subsection (1)” there shall be substituted “Article 9, except the definition of “designated scheme” in paragraph (1)”.

Explanatory Note

(This note is not part of the Order.)

Article 2 of this Order provides for the coming into operation of the following provisions of the Welfare Reform and Pensions (Northern Ireland) Order 1999 (“the Order”) as follows—

Article 12(1), (2), (3) and (11) (which provides for rights under tax-approved pension schemes to be excluded from a bankrupt’s estate), and paragraph 1 of Schedule 2 (income payments orders against pension payments) and Article 17 in so far as it relates to that paragraph, on 29th May 2000,

Article 12(12) (under which a person is treated as having a right under an approved pension arrangement where he is entitled to a pension credit) on 1st December 2000, and

Article 64(3) and (4) (which reduces, for certain categories of case, the lower age limit for entitlement to the higher rate mobility component of disability living allowance from age 5 to age 3) on 9th April 2001.

Article 3 of this Order contains a minor amendment to Part III of the Schedule to the Welfare Reform and Pensions (1999 Order) (Commencement No. 3) Order (Northern Ireland) 2000.
