Statutory Rules of Northern Ireland

The Department of the Environment, the Department of Agriculture and the Department of Economic Development. acting jointly as the Department concerned(1), in exercise of the powers conferred by Articles 17( 1) to (3). 43 1) and (2) and 55(2) of the Health and Safety at Work (Northern Ireland) Order 1978(2) and of every other power enabling them in that behalf, after consultation as required by Article 46(1) of that Order with the Health and Safety Agency for Northern Ireland and such other bodies as appeared to those Departments to be appropriate, hereby make the following Regulations:
1. These Regulations may be cited as The Health and Safety (Miscellaneous Provisions) Regulations (Northern Ireland) 1992 and shall come into operation on 16th November 1992.
2. The statutory provisions specified in column 1 of Schedule 1 shall be amended by substituting for the amounts or quantities set out opposite thereto in column 2 the amounts or quantities set out in the corresponding entry in column 3.
3. The statutory provisions specified in column 1 of Schedule 2 shall be repealed or modified to the extent set out in column 2.
4.—(1) Where the measurements relating to any plant, building or other permanent structure in existence or under construction immediately before the coming into operation of these Regulations complied with the requirements of the relevant statutory provisions as then in operation in so far as they related to the measurements of that plant, building or other permanent structure, then such compliance shall be deemed to be compliance with the relevant statutory provisions as amended by these Regulations.
(2) In paragraph (1) “the relevant statutory provisions” means the statutory provisions listed in column 1 of Schedules 1 and 2.

5. The Highly Flammable Liquids and Liquefied Petroleum Gases Regulations (Northern Ireland) 1975(10) (i)Regulation 2 | (a)Regulation 2 shall be renumbered 2( 1) and in the definition of “highly flammable liquid” for the words “in the manner specified in Schedule 1” to the word “temperature” substitute “in accordance with Part IV of Schedule 1 to the Classification, Packaging and Labelling of Dangerous Substances Regulations (Northern Ireland) 1985(S.R. 1985 No. 81) has a flash point”. These Regulations—
(a)metrication certain imperial units of measurement in the statutory provisions listed in column 1 of Schedule 1; and
(b)provide for the statutory provisions relating to the determination of the flash points of highly flammable liquids, etc, specified in column 1 of Schedule 2 to be repealed or modified to the extent set out in column 2.
The metrication referred to in paragraph (u) fulfils obligations arising from Council Directive 80/181/EEC of 20th December 1979 (O.J. L39, page 40 as amended by Council Directive 85/1/EEC (O.J. L2, page 11) and Council Directive 89/617/EEC (O.J. L357, page 28)) on the approximation of laws of Member States relating to units of measurement. Copies of those EEC Directives can be obtained from Her Majesty’s Stationery Office.
