Saving provisions in relation to powers under the Mental Health Act 1983

4.—(1) Despite the coming into force of sections 80 to 83 of the Act in accordance with regulation 3, the amendments made by those sections do not apply in relation to a person where—

(a) the warrant authorising the removal of that person under section 135 of the Mental Health Act 1983(1) was issued before 11th December 2017; or

(b) the removal of that person to a place of safety under section 136 of the Mental Health Act 1983(2) started before 11th December 2017.

1983 c. 20; section 135 was amended by paragraph 26 of Part I of Schedule 6, and Part 1 of Schedule 7, to the Police and Criminal Evidence Act 1984 (c.60), paragraph 1 of Schedule 10 to the National Health Service and Community Care Act 1990 (c.19), paragraph 9(9) of Schedule 4 to the Care Standards Act 2002 (c.14), section 44(2) of, and paragraph 10(a) of Schedule 2 to, the Mental Health Act 2007 (c.12), and S.I. 2015/914 and 2016/413. There are other amendments but none are relevant.
