5.—(1) Chapter 2 (offenders assisting investigations and prosecutions) (sections 71 to 75) of Part 2 of the Act shall come into force on 1st April 2006.
(2) At any time prior to the coming into force of paragraph 16(3)(b) of Schedule 9 to the Constitutional Reform Act 2005(1) (amendment of section 33(3) of the Criminal Appeal Act 1968(2) to replace references to the House of Lords with references to the Supreme Court), section 74(9) of the Act (which refers to section 33(3) of the 1968 Act) has effect as if the reference to the Supreme Court were a reference to the House of Lords.
