3. Regulation 24 of the Social Security (Claims and Payments) Regulations 1987(1) (incapacity benefit, maternity allowance and severe disablement allowance) shall be amended as follows—
(a)in paragraph (1), for the words “and (3)” there shall be substituted “, (3) and (3A)”;
(b)in paragraph (2), for the words “paragraph (3)” there shall be substituted “paragraphs (3) and (3A)”;
(c)after paragraph (3), there shall be inserted—
“(3A) Where the amount of incapacity benefit payable after reduction for pension payments under section 30DD of the Social Security Contributions and Benefits Act 1992(2) (including any reduction for other purposes) is less than £5.00 a week, the Secretary of State may direct that it shall be paid (whether in advance or in arrears) at such intervals as may be specified not exceeding 12 months.”.
