10.—(1) A person contravening any provision of these Regulations shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale or to imprisonment for a term not exceeding three months or to both.
(2) Paragraph (1) above does not apply to anything done or omitted by the Minister.
(3) Section 20 of the Food Safety Act 1990(1) shall apply to the commission by any person of an offence under these Regulations, and section 21(1), (5) and (6) of that Act shall apply in any proceedings for an offence under these Regulations, as if the references to “any of the preceding provisions of this Part” were references to “these Regulations”.
