Rydych yn edrych ar yr eitem hon o ddeddfwriaeth fel yr oedd ar bwynt penodol mewn amser. Mae fersiwn ddiweddarach o hyn neu ddarpariaeth, gan gynnwys newidiadau ac effeithiau dilynol, yn disodli'r fersiwn hon.
Sylwer bod y term darpariaeth yn cael ei ddefnyddio i ddisgrifio elfen ddiffiniadwy mewn darn o ddeddfwriaeth sy'n cael effaith ddeddfwriaethol – fel Rhan, Pennod neu adran.
Deddf Gwasanaethau Cymdeithasol a Llesiant (Cymru) 2014, Adran 161 yn gyfredol gyda’r holl newidiadau y gwyddys eu bod mewn grym ar neu cyn 10 Mehefin 2024. Mae newidiadau a all gael eu dwyn i rym yn y dyfodol. Mae newidiadau a wnaed yn ymddangos yn y cynnwys a chyfeirir atynt trwy anodiadau.
Nid yw newidiadau ac effeithiau sydd eto i'w gwneud gan y tîm golygyddol ond yn berthnasol wrth edrych ar y fersiwn ddiweddaraf neu fersiwn ragolygol o ddeddfwriaeth. Felly, nid oes modd eu gweld wrth edrych ar ddeddfwriaeth fel y mae ar bwynt penodol mewn amser. Er mwyn gweld yr wybodaeth 'Newidiadau i Ddeddfwriaeth' ar gyfer y ddarpariaeth hon ewch yn ôl i'r fersiwn ddiweddaraf gan ddefnyddio'r opsiynau yn y blwch 'Pa Fersiwn' uchod.
(1)Mae gan berson sy’n dod o fewn is-adran (2) hawl, ar bob adeg resymol—
(a)i gael mynd i mewn i fangreoedd yr awdurdod lleol o dan sylw;
(b)i arolygu, a gwneud copïau, o unrhyw gofnodion neu ddogfennau eraill a gedwir gan yr awdurdod, ac unrhyw ddogfennau eraill sy’n cynnwys gwybodaeth sy’n ymwneud â’r awdurdod, a’r rheini’n gofnodion neu’n ddogfennau y mae’r person o’r farn eu bod yn berthnasol i gyflawniad ei swyddogaethau o dan, neu yn rhinwedd, y Rhan hon.
(2)Mae’r personau canlynol yn dod o fewn yr is-adran hon—
(a)person a bennir mewn cyfarwyddyd o dan adran 153 neu, pan fo’r cyfarwyddyd yn pennu dosbarth o bersonau, person y mae’r awdurdod yn ymrwymo i gontract neu unrhyw drefniant arall ag ef sy’n ofynnol o dan y cyfarwyddyd;
(b)person a bennir mewn cyfarwyddyd o dan adran 154;
(c)Gweinidogion Cymru yn unol â chyfarwyddyd o dan adran 155;
(d)person a enwebir drwy gyfarwyddyd o dan adran 155.
(3)Wrth arfer yr hawl o dan is-adran (1)(b) i arolygu cofnodion neu ddogfennau eraill—
(a)mae gan berson (“P”) hawlogaeth i gael mynediad at, ac i arolygu a gwirio gweithrediad, unrhyw gyfrifiadur ac unrhyw gyfarpar neu ddeunydd cysylltiedig sydd, neu sydd wedi bod, yn cael ei ddefnyddio mewn cysylltiad â’r cofnodion neu’r dogfennau eraill o dan sylw, a
(b)caiff P ei gwneud yn ofynnol i’r personau canlynol ddarparu unrhyw gymorth y mae arno angen rhesymol ei gael (gan gynnwys, ymhlith pethau eraill, rhoi gwybodaeth ar gael i’w harolygu neu i’w chopïo ar ffurf ddarllenadwy)—
(i)y person y defnyddir neu y defnyddiwyd y cyfrifiadur felly ganddo neu ar ei ran;
(ii)unrhyw berson y mae’r cyfrifiadur, y cyfarpar neu’r deunydd o dan ei ofal neu sy’n ymwneud fel arall â’u gweithredu.
(4)Mae unrhyw gyfeiriad yn yr adran hon at berson sy’n dod o fewn is-adran (2) yn cynnwys cyfeiriad at unrhyw berson sy’n cynorthwyo’r person hwnnw.
(5)Yn yr adran hon mae “dogfen” a “cofnodion” ill dau yn cynnwys gwybodaeth a gofnodir ar unrhyw ffurf.
