(1) The regulator shall publish—

[F3 (2A) Guidance under subsection (1)(b) must, in particular, specify how the regulator applies and intends to apply the tests in section 198A (use of certain powers in cases of failure or potential failure to comply with standards under section 193).]

Before giving guidance under section 215 the regulator must consult—

[F4 (za) the Secretary of State,]

(a) one or more bodies appearing to it to represent the interests of registered providers,

[F5 (aa) any body for the time being nominated under section 278A,]
