The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of, and paragraph 21(b) of Schedule 7 to, the European Union (Withdrawal) Act 2018(1).

In accordance with paragraph 1(3) of Schedule 7 to that Act, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.

PART 1Introduction

Citation and commencement

1.  These Regulations may be cited as the State Aid (Agriculture and Fisheries) (Amendment) (EU Exit) Regulations 2019 and come into force on exit day.

PART 2Amendments to Commission Regulation (EU) No 702/2014

Amendments to the agricultural block exemption regulation

2.  Commission Regulation (EU) No 702/2014 declaring certain categories of aid in the agricultural and forestry sectors and in rural areas compatible with the internal market in application of Articles 107 and 108 of the Treaty on the Functioning of the European Union is amended in accordance with this Part.

(a)a reference to Article 107(1) or 108(3) of the Treaty is a reference to that Article as it has effect in domestic law by virtue of section 4 of the European Union (Withdrawal) Act 2018 and regulation 3(1) and (2) of the state aid regulations;

(b)a reference to Article 107(2) or (3) of the Treaty is to be read in accordance with regulation 3(3)(b) of the state aid regulations;

Article 2BCompetent authority

1.  Subject to paragraphs 2 to 5, for the purposes of this Regulation the competent authority is the Secretary of State.

2.  In relation to Scotland, in respect of areas within devolved competence, the competent authority is the Scottish Ministers.

In this paragraph, “devolved competence” is to be read in accordance with section 54 of the Scotland Act 1998.

3.  In relation to Wales, in respect of functions conferred or imposed under section 56 of the Government of Wales Act 2006, the competent authority is the Welsh Ministers.

4.  In relation to Northern Ireland, in respect of functions conferred under sections 22 or 23 of the Northern Ireland Act 1998, the competent authority is the Department of Agriculture, Environment and Rural Affairs.

5.  Where prior to exit day the relevant function was delegated to another person or body, the competent authority is that person or body.

6.  This Article is without prejudice to any power for the competent authority to delegate functions..

These Regulations are made in exercise of the powers conferred by the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a), (b), (c) and (g)) arising from the withdrawal of the United Kingdom from the European Union.

These Regulations make amendments to legislation in the field of agricultural and fisheries exemptions to the State aid rules under Articles 107 and 108 of the Treaty on the Functioning of the European Union. They correct direct deficiencies in EU legislation which exempts certain categories of subsidies from the general prohibitions and notification requirements for State aid. Part 2 amends the Agricultural Block Exemption Regulation, Part 3 amends the Agricultural De Minimis Regulation, Part 4 amends the Fisheries Block Exemption Regulation and Part 5 amends the Fisheries De Minimis Regulation. Part 6 corrects deficiencies in provisions relating to the application of the State aid regime to payments made under Regulation (EU) No 1303/2013 of the European Parliament and of the Council, Regulation (EU) No 1305/2013 of the European Parliament and of the Council, Regulation (EU) No 1307/2013 of the European Parliament and of the Council, and Commission Implementing Regulation (EU) No 808/2014 respectively.
