Coming into operation
The Department of Agriculture and Rural Development is a Department designated for the purposes of section 2(2) of the European Communities Act 19721 as read with paragraph 1A of Schedule 2 to that Act, in relation to the common agricultural policy of the European Community2, and to measures in the veterinary and phytosanitary fields for the protection of public health3.
These Regulations make provision for a purpose mentioned in that section and it appears to the Department of Agriculture and Rural Development that it is expedient for the reference to Council Directive 91/414/EEC concerning the placing of plant protection products on the market4, to be construed as a reference to that Directive as amended from time to time.
The Department of Agriculture and Rural Development makes the following Regulations in exercise of the powers conferred by that section.
Citation, commencement and interpretation1

These Regulations may be cited as the Plant Protection Products (Amendment No 2) Regulations (Northern Ireland) 2008 and shall come into operation on 12th January 2009.

The Interpretation Act (Northern Ireland) 19545 shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
Amendment of the Plant Protection Products Regulations (Northern Ireland) 20052

The Plant Protection Products Regulations (Northern Ireland) 20056 shall be amended in accordance with paragraphs (2) and (3).

In regulation 2(1) (interpretation), for the definition of “the Directive” substitute—
“the Directive” means Council Directive 91/414/EEC concerning the placing of plant protection products on the market, as amended from time to time;

Schedule 1 (instruments amending Council Directive 91/414/EEC) is revoked.
Revocation3
The Plant Protection Products (Amendment) Regulations (Northern Ireland) 20087 are revoked.
