Citation

1.  This Order may be cited as the Welfare Reform (Northern Ireland) Order 2015 (Commencement No. 3) Order 2016.

Provisions coming into force on 2nd May 2016

2.—(1) The following provisions of the Welfare Reform (Northern Ireland) Order 2015 come into force on 2nd May 2016.

(2) In Part 2 (universal credit)—

(a)in Chapter 1 (entitlement and awards), Articles 7 and 9 to 17 for the purpose of making regulations;

(b)in Chapter 2 (claimant responsibilities)—

(i)Articles 18 to 27 and 29 for the purpose of making regulations;

(ii)Article 30;

(iii)Articles 31 and 32 for the purpose of making regulations;

(iv)Article 33;

(c)in Chapter 3 (supplementary and general)—

(i)Articles 36 to 38, 39(3), 41 and 42;

(ii)Articles 43 and 45 to 47 for the purpose of making regulations;

(iii)Articles 48 and 49;

(iv)in Schedule 1, paragraphs 1 to 5 and 7;

(v)in Schedule 2—

(aa)paragraphs 3 to 5;

(bb)paragraphs 13 to 15 in so far as necessary for the purpose of amendments made by Schedule 9 to the Welfare Reform (Northern Ireland) Order 2015;

(cc)paragraph 19 for the purpose of making regulations;

(dd)paragraphs 21 to 25 in so far as necessary for the purpose of amendments made by Schedule 9 to the Welfare Reform (Northern Ireland) Order 2015;

(ee)paragraph 34;

(ff)paragraph 35 in so far as necessary for the purpose of amendments made by Schedule 9 to the Welfare Reform (Northern Ireland) Order 2015;

(gg)paragraph 36 for the purpose of making regulations;

(hh)paragraphs 37, 39 and 43 in so far as necessary for the purpose of amendments made by Schedule 9 to the Welfare Reform (Northern Ireland) Order 2015;

(ii)paragraphs 45, 46, 47(1) to (3), 48(1) to (3), 50, 51 and 52(1) and (2);

(vi)in Schedule 3, paragraphs 19 and 21(c) to (g) for the purpose of making regulations;

(vii)in Schedule 5, paragraphs 1 to 3 and 6;

(viii)Schedule 6.

(3) In Part 3 (working-age benefits)—

(a)in Chapter 1 (jobseeker’s allowance)—

(i)Article 50(1) and (3) for the purpose of making regulations;

(ii)Article 54;

(iii)Article 55(1), (2) and (4) for the purpose of making regulations;

(iv)in Schedule 7, paragraph 12 for the purpose of making regulations;

(b)in Chapter 2 (employment and support allowance), Articles 60 and 63 for the purpose of making regulations.

(4) In Part 4 (other benefit changes), Article 72(3) and (4).

(5) In Part 5 (personal independence payment)—

(a)Article 82(3) for the purpose of making regulations;

(b)Articles 83(3) and (4), 84(3), (4) and (7), 85 and 86;

(c)Article 88 for the purpose of making regulations;

(d)Articles 89 to 91;

(e)Article 92 for the purpose of making regulations;

(f)Articles 96 to 99;

(g)Article 100 for the purpose of making regulations;

(h)in Schedule 9—

(i)paragraphs 2, 4, 6, 7(1) and (3) and 8;

(ii)paragraph 29 for the purpose of making regulations;

(iii)paragraph 35;

(iv)paragraph 37 for the purpose of making regulations;

(v)paragraph 38;

(vi)paragraph 39 for the purpose of making regulations;

(vii)paragraphs 40 and 43 to 45;

(i)Schedule 10.

(6) In Part 6 (social security: general)—

(a)Articles 103 to 106 and 108;

(b)Article 109 for remaining regulation-making purposes;

(c)Article 110 for the purpose of making regulations;

(d)Articles 117 and 118 for the purpose of making regulations.

Provisions coming into force on 20th June 2016

3.—(1) Except in so far as already in force, the following provisions of the Welfare Reform (Northern Ireland) Order 2015 come into force on 20th June 2016.

(2) Part 5, except for—

(a)Article 95;

(b)in Schedule 9, paragraph 3.

(3) In Part 6, Articles 109 and 110, except in so far as those Articles relate to universal credit.
