(1)Subject to the provisions of this Act, the Ministry of Agriculture may, in accordance with a scheme made by that Ministry with the approval of the Ministry of Finance, make out of moneys provided by Parliament to any person carrying on or proposing to carry on a business in the fishing industry in Northern Ireland a grant towards so much of the expenditure incurred by that person—
(a)in providing a fishing vessel; or
(b)in providing an engine for a fishing vessel; or
(c)in improving a sea fishing vessel;
for use for the purposes of that business as may be approved by the Ministry of Agriculture in pursuance of the scheme.
(2)[F1 Subject to subsection (2A),] no grant shall be made in pursuance of a scheme under this Act in respect of expenditure incurred in providing any vessel, engine, part, equipment or apparatus which appears to the Ministry of Agriculture to be second-hand.
[F2 (2A) A grant may be made in pursuance of a scheme under this Act in respect of that part of the expenditure (approved as mentioned in subsection (1)), incurred in providing a second-hand vessel, which is attributable to any liability to repay—
a grant under this Act or any other statutory provision; or
a grant under the law of any other part of the United Kingdom;
in respect of the vessel or any engine, part, equipment or apparatus therein.]
(3)A schemeF3 made under this Act—
(a)may provide for—
(i)repayment of grant in specified circumstances;
(ii)the imposition of penalties in respect of contraventions of provisions of the scheme;

(c)shall be subject to affirmative resolution.
