The Care Standards Act 2000 (Commencement No.1) (Wales) Order 2000

The National Assembly for Wales makes the following Order in exercise of the power conferred upon it by section 122 of the Care Standards Act 2000(1)

Citation, interpretation and application

1.—(1) This Order may be cited as the Care Standards Act 2000 (Commencement No.1) (Wales) Order 2000.

(2) In this Order—

(3) This Order applies to Wales.

Appointed days

2.—(1) 13th November 2000 is the day appointed for the coming into force of each provision of the Act specified in Schedule 1 to this Order.

(2) 1st April 2001 is the day appointed for the coming into force, to the extent there specified, of each provision of the Act specified in Schedule 2 to this Order.

SCHEDULE 2PROVISIONS OF THE ACT COMING INTO FORCE ON 1ST APRIL 2001

Explanatory Note

(This note does not form part of the Order)

This Order appoints a day for certain provisions of the Care Standards Act 2000 (“the Act”) to come into force. The Order applies to Wales.

The Order provides that the following provisions of Part V of the Act shall come into force on 13th November 2000:

(a)section 72, which establishes an office of the Children’s Commissioner for Wales;

(b)Schedule 2, which makes provision about certain operational functions of the office such as its status, appointment and remuneration, general powers, accounting and reporting.

The Order provides that the following provisions of Part IV of the Act shall come into force on 1st April 2001 in so far as they relate to the Care Council for Wales (“the Council”):

(a)section 54(1), (3)-(7), which establishes a body corporate to be known as the Care Council for Wales; provides its general duty; and provides that it shall, in the exercise of its functions, act in accordance with any directions, or under any general guidance, issued by the National Assembly for Wales;

(b)section 55 which makes provision about the interpretation of Part IV of the Act;

(c)section 113 (2)-(4) which provides that the Assembly has default powers in relation to the Council;

(d)section 114 which makes provision about Orders in Council made under section 70 of the Act that transfer staff from the Central Council for Education and Training in Social Work to the Council;

(e)Schedule 1 which makes provision about certain operational functions of the Council such as its status, general powers, membership and appointment, procedure, staff, accounting and reporting.

The following provisions of the Act have been brought into force in relation to Wales, as well as England, by S.I. 2000/2544 (C.72).

In addition to the provisions listed below various other provisions of the Act have been brought into force in relation to England by S.I. 2000/ 2795 (C. 79 ).

2000 c. 14. The power is exercisable by the appropriate Minister. The appropriate Minister is defined in section 121(1) as meaning the National Assembly in relation to Wales; in relation to England, Scotland or Northern Ireland it means the Secretary of State.
