38.—(1) This article applies for a period of 36 months beginning on the date on which this Order comes into force.
(2) Paragraph (3) applies to a person who is not the holder of a licence under section 6(1)(f) of the Electricity Act 1989(1).
(3) Exemption is granted from section 4(1)(e) of the Electricity Act 1989(2) to a person to whom this paragraph applies.
(4) Paragraph (5) applies to a person who is not the holder of a licence under section 7AB(1)(3) of the Gas Act 1986.
(5) Exemption is granted from section 5(1)(d)(4) of the Gas Act 1986 to a person to whom this paragraph applies.
Section 6(1)(f) is inserted by article 6(2)(b) of this Order.
Section 4(1)(e) is inserted by article 4(2)(b) of this Order.
Section 7AB(1) is inserted by article 21 of this Order.
Section 5(1)(d) is inserted by article 19(2)(b) of this Order.
