Title and coming into force1.

The title of these Regulations is the Local Health Boards (Directed Functions) (Wales) (Amendment) Regulations 2026.

These Regulations come into force on 1 April 2026.

“ “direct payments” (“taliadau uniongyrchol”) has the same meaning as in section 10B(8) of the Act;”.

On and after 1 April 2026, a Local Health Board must exercise the functions of the Welsh Ministers specified in—
(a)
sections 10B(1) and 10D of the Act (direct payments for health care and arrangements with other bodies relating to direct payments)3, and(b)
the National Health Service (Direct Payments) (Wales) Regulations 2026.

But the exercise of the functions specified in paragraph (1) is subject to—
(a)
regulation 5, and
(b)
any prohibitions or restrictions in an LHB Order.”
These Regulations amend the Local Health Boards (Directed Functions) (Wales) Regulations 2009 (S.I. 2009/1511 (W. 147)) (“the 2009 Regulations”).
Regulation 2 amends the 2009 Regulations with the effect that Local Health Boards are directed to exercise the specified functions of the Welsh Ministers in relation to the making of direct payments.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations.
