The Public Health (Minimum Price for Alcohol) (Wales) Act 2018 (Continuation) Regulations 2026

The Welsh Ministers in exercise of the powers conferred by section 22(2) of the Public Health (Minimum Price for Alcohol) (Wales) Act 20181, make the following Regulations.
There has been a consultation as required by Article 9 of Regulation (EC) No 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying procedures in matters of food safety2.
In accordance with the Senedd approval procedure applied by section 26(2)(b) of the Public Health (Minimum Price for Alcohol) (Wales) Act 2018, a draft of this Welsh statutory instrument was laid before, and approved by resolution of, Senedd Cymru3.

Title and coming into force1.

The title of these Regulations is the Public Health (Minimum Price for Alcohol) (Wales) Act 2018 (Continuation) Regulations 2026.

These Regulations come into force on 9 February 2026.

Interpretation2.

In these Regulations—

“the 2018 Act” (“Deddf 2018”) means the Public Health (Minimum Price for Alcohol) (Wales) Act 2018;

“minimum pricing provisions” (“darpariaethau’r isafbris”) has the meaning given by section 22(4) of the 2018 Act.

Continuation of minimum pricing provisions3.

Despite subsection (1) of section 22 of the 2018 Act, the minimum pricing provisions are not repealed by virtue of that subsection at the end of the period specified in it.

EXPLANATORY NOTE
(This note is not part of the Regulations)

The Public Health (Minimum Price for Alcohol) (Wales) Act 2018 (“the 2018 Act”) makes provision about the minimum price for which alcohol is to be supplied by alcohol retailers from qualifying premises in Wales to a person in Wales and establishes a local authority led enforcement regime.

Section 22(1) of the 2018 Act provides that the minimum pricing provisions expire 6 years after section 2 of the 2018 Act came into force unless Regulations are made under section 22(2) of that Act to continue the effect of those provisions. Section 2 of the 2018 Act came into force on 2 March 2020.

These Regulations are made under section 22(2) of the 2018 Act and continue the effect of the minimum pricing provisions.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations in Wales.
