The Welsh Ministers are satisfied that mistakes have occurred in the preparation of the County Borough of Caerphilly (Communities) Order 2026(1) and the County of Swansea (Communities) Order 2026(2), which were made under sections 37(1), and 40(1) and (2)(a) of the Democracy and Boundary Commission Cymru etc. Act 2013(3) (“the 2013 Act”).
The Welsh Ministers consider it necessary to rectify those mistakes and make the following Order in exercise of the power conferred on them by section 43(10) of the 2013 Act.
1.—(1) The title of this Order is the County Borough of Caerphilly (Communities) and the County of Swansea (Communities) (Miscellaneous Amendments) Order 2026.
(2) This Order comes into force on 31 July 2026.
2.—(1) The County Borough of Caerphilly (Communities) Order 2026 is amended as follows.
(2) Omit articles 46 and 47 (establishment of community council and community electoral arrangements for the community of Cefn Fforest and Pengam).
(3) In article 54 (new community councils), for “articles 15, 26 and 46” substitute “articles 15 and 26”.
(4) In article 55 (new community councils — residuary successors), omit paragraph (c).
3.—(1) The County of Swansea (Communities) Order 2026 is amended as follows.
(2) For article 20 (Mawr — abolition of community) substitute—
20. The community of Mawr as changed by this Order is abolished.
20A. The community council of Mawr is dissolved.”

This Order amends the County Borough of Caerphilly (Communities) Order 2026 (“the Caerphilly Communities Order”) which implements the recommended changes to the community electoral arrangements for the County Borough of Caerphilly contained in the report of the Democracy and Boundary Commission Cymru (“the Commission”) dated May 2024. This Order also amends the County of Swansea (Communities) Order 2026 (“the Swansea Communities Order”) which implements the recommended changes to the community electoral arrangements for the County of Swansea contained in the report of the Commission dated November 2024.
The Caerphilly Communities Order and the Swansea Communities Order contain mistakes which are rectified by this Order. The Caerphilly Communities Order incorrectly created a new community council for the new community of Cefn Fforest and Pengam, which was not the Commission’s intention in its report dated May 2024. Article 2 of this Order rectifies that mistake by omitting articles 46 and 47 of the Caerphilly Communities Order and making other consequential amendments.
The Swansea Communities Order does not dissolve Mawr Community Council and contains incorrect English language spellings of the electoral ward names of Llangennith, Llanmadoc and Upper Loughor. Article 3 of this Order rectifies those mistakes.
The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.
2013 anaw 4. Section 11 of the Senedd Cymru (Members and Elections) Act 2024 (asc 4) renamed the short title of the 2013 Act as the Democracy and Boundary Commission Cymru etc. Act 2013.
