Regulations is the Infrastructure Consent (Fees) (Wales) Regulations 2025 and they come into force on 15 December 2025.</Text></P1para></P1></P1group><P1group TerritorialApplication="W" RestrictExtent="E+W" RestrictStartDate="2026-03-16"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-522557cf1f193f02c960e61cc7eeb018"/>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>In these Regulations—</Text><UnorderedList Class="Definition" Decoration="none"><ListItem><Para><Text>“<Term id="term-the-2024-act">the 2024 Act</Term>” (“<Term><Emphasis>Deddf 2024</Emphasis></Term>”) means the Infrastructure (Wales) Act 2024);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-applicant">applicant</Term>” (“<Term><Emphasis>ceisydd</Emphasis></Term>”) means <Addition ChangeId="key-2d9964791be792a87a31d11221f110f8-1777482622248" CommentaryRef="key-2d9964791be792a87a31d11221f110f8">, except in Part 6,</Addition> a person who proposes to make, or has made an application for infrastructure consent;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-application">application</Term>” (“<Term><Emphasis>cais</Emphasis></Term>”) means <Addition ChangeId="key-67314606af0dbfc4d8eb79bc2cfadfd8-1777482622248" CommentaryRef="key-67314606af0dbfc4d8eb79bc2cfadfd8">, except in Part 6,</Addition> an application for infrastructure consent made under section 32 of the 2024 Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-financial-year">financial year</Term>” (“<Term><Emphasis>blwyddyn ariannol</Emphasis></Term>”) means any period of 12 months beginning with 1 April;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-infrastructure-consent">infrastructure consent</Term>” (“<Term><Emphasis>cydsyniad seilwaith</Emphasis></Term>”) means a consent given under section 19 of the 2024 Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-local-impact-report">local impact report</Term>” (“<Term><Emphasis>adroddiad ar yr effaith leol</Emphasis></Term>”) means any local impact report required under section 36(1) of the 2024 Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-marine-impact-report">marine impact report</Term>” (“<Emphasis>adroddiad effaith ar y </Emphasis>môr”) means any marine impact report required under section 37(1) and (2) of the 2024 Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-planning-authority">planning authority</Term>” (“<Term><Emphasis>awdurdod cynllunio</Emphasis></Term>”) means the local planning authority within the meaning given by Part 1 of the Town and Country Planning Act 1990<FootnoteRef Ref="f00002"/> for an area in Wales in which the proposed development is located;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-pre-application-services">pre-application services</Term>” (“<Term><Emphasis>gwasanaethau cyn gwneud cais</Emphasis></Term>”) means services provided to a person under section 27 of the 2024 Act for the purpose of assisting the person in applying for an infrastructure consent order.</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/2/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/2/2" id="regulation-2-2"><Pnumber>2</Pnumber><P2para><Text>See section 136 of the 2024 Act in relation to provision in these Regulations which requires or authorises a person to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/2/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/2/2/a" id="regulation-2-2-a"><Pnumber>a</Pnumber><P3para><Text>notify another person of something, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/2/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/2/2/b" id="regulation-2-2-b"><Pnumber>b</Pnumber><P3para><Text>give a document to another person (whether the provision uses the word “serve”, “give” or other term).</Text></P3para></P3></P2para></P2></P1para></P1></P1group></Part><Part DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/part/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/part/2" NumberOfProvisions="3" id="part-2" TerritorialApplication="W" RestrictExtent="E+W" RestrictStartDate="2025-12-15"><Number>PART 2</Number><Title>Fees for providing pre-application services</Title><P1group TerritorialApplication="W" RestrictExtent="E+W" RestrictStartDate="2025-12-15"><Title>Fee for pre-application services provided by the Welsh Ministers</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3" id="regulation-3"><Pnumber><CommentaryRef Ref="key-7c48512d8e504d7755ec10ee2ef8f466"/>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/1" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/1" id="regulation-3-1"><Pnumber>1</Pnumber><P2para><Text>Where the Welsh Ministers provide pre-application services, a fee must be paid to the Welsh Ministers.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/2" id="regulation-3-2"><Pnumber>2</Pnumber><P2para><Text>Subject to paragraphs (8) and (9), the fee payable under this regulation is the amount published on a website maintained by or on behalf of the Welsh Ministers.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/3" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/3" id="regulation-3-3"><Pnumber>3</Pnumber><P2para><Text>The Welsh Ministers must ensure that the following information is published on the website—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/3/a" id="regulation-3-3-a"><Pnumber>a</Pnumber><P3para><Text>the pre-application services for which fees are charged,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/3/b" id="regulation-3-3-b"><Pnumber>b</Pnumber><P3para><Text>the fees payable,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/3/c" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/3/c" id="regulation-3-3-c"><Pnumber>c</Pnumber><P3para><Text>the method used to calculate fees, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/3/d" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/3/d" id="regulation-3-3-d"><Pnumber>d</Pnumber><P3para><Text>the enactment under which the relevant pre-application services are provided.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/4" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/4" id="regulation-3-4"><Pnumber>4</Pnumber><P2para><Text>The Welsh Ministers must ensure that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/4/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/4/a" id="regulation-3-4-a"><Pnumber>a</Pnumber><P3para><Text>the fee payable is published on the website no less than one month before the fee comes into force, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/4/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/4/b" id="regulation-3-4-b"><Pnumber>b</Pnumber><P3para><Text>the fee payable does not exceed the costs reasonably incurred by them in providing the relevant pre-application services, taking one financial year with another.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/5" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/5" id="regulation-3-5"><Pnumber>5</Pnumber><P2para><Text>Following a request for pre-application services, the Welsh Ministers must provide a notice to the applicant setting out the fee to be paid for providing those services.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/6" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/6" id="regulation-3-6"><Pnumber>6</Pnumber><P2para><Text>The applicant must pay the fee to the Welsh Ministers within such period as may be specified in the notice, provided such period is not less than 21 days beginning the day after the date of that notice.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/7" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/7" id="regulation-3-7"><Pnumber>7</Pnumber><P2para><Text>If the applicant fails to pay a fee payable to the Welsh Ministers within the period specified, the Welsh Ministers may—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/7/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/7/a" id="regulation-3-7-a"><Pnumber>a</Pnumber><P3para><Text>recover any unpaid fees for any work completed as a civil debt, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/7/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/7/b" id="regulation-3-7-b"><Pnumber>b</Pnumber><P3para><Text>notwithstanding any requirement to provide the relevant pre-application services, withhold the relevant pre-application services until the fees are paid.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/8" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/8" id="regulation-3-8"><Pnumber>8</Pnumber><P2para><Text>Where the cost of providing pre-application services is likely to exceed the fee payable under paragraph (2) of this regulation the Welsh Ministers must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/8/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/8/a" id="regulation-3-8-a"><Pnumber>a</Pnumber><P3para><Text>inform the applicant the cost is likely to exceed the fee,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/8/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/8/b" id="regulation-3-8-b"><Pnumber>b</Pnumber><P3para><Text>indicate the amount by which the fee is likely to be exceeded, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/8/c" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/8/c" id="regulation-3-8-c"><Pnumber>c</Pnumber><P3para><Text>ask the applicant to respond within 14 days to confirm they accept that an additional fee is payable.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/9" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/9" id="regulation-3-9"><Pnumber>9</Pnumber><P2para><Text>Where an additional fee is payable under paragraph (8) the fee will be administered by invoice payable by the applicant within 21 days beginning on the day after the date of the invoice.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/3/10" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/3/10" id="regulation-3-10"><Pnumber>10</Pnumber><P2para><Text>Any fee paid under this regulation must be refunded if the request for pre-application services is rejected as invalid.</Text></P2para></P2></P1para></P1></P1group><P1group TerritorialApplication="W" RestrictExtent="E+W" RestrictStartDate="2025-12-15"><Title>Fee for pre-application services provided by planning authorities</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/4" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/4" id="regulation-4"><Pnumber><CommentaryRef Ref="key-6438a28b3b1d69c21e36e8820bb5b0f2"/>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>Subject to paragraphs (7) and (8), where a planning authority provides pre-application services, a fee must be paid to that authority.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>The fee payable under this regulation is the amount published on a website when the application is made.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/9/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/9/2" id="regulation-9-2"><Pnumber>2</Pnumber><P2para><Text>The fee payable under this regulation is the amount published on a website maintained by or on behalf of the Welsh Ministers.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/9/3" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/9/3" id="regulation-9-3"><Pnumber>3</Pnumber><P2para><Text>The Welsh Ministers must ensure that the following information is published on the website—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/9/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/9/3/a" id="regulation-9-3-a"><Pnumber>a</Pnumber><P3para><Text>details of the functions for which the fee is charged,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/9/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/9/3/b" id="regulation-9-3-b"><Pnumber>b</Pnumber><P3para><Text>the fees payable,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/9/3/c" id="regulation-9-5-e"><Pnumber>e</Pnumber><P3para><Text>determination of the application.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group TerritorialApplication="W" RestrictExtent="E+W" RestrictStartDate="2025-12-15"><Title>Fee for a local impact report</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/10" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/10" id="regulation-10"><Pnumber><CommentaryRef Ref="key-e160b2cdea2efd9cbf58e0aa63fe8ca3"/>10</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/10/1" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/10/1" id="regulation-10-1"><Pnumber>1</Pnumber><P2para><Text>Where a planning authority submits a local impact report to the Welsh Ministers under section 36(1) of the 2024 Act the Welsh Ministers must pay the portion of the fee referred to in regulation 9 which relates to the local impact report to the relevant planning authority (“the local impact report fee”).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/10/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/10/2" id="regulation-10-2"><Pnumber>2</Pnumber><P2para><Text>Unless the Welsh Ministers otherwise agree with the relevant planning authority, the Welsh Ministers must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/10/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/10/2/a" id="regulation-10-2-a"><Pnumber>a</Pnumber><P3para><Text>pay the full local impact report fee to the relevant planning authority if the local impact report is received within the deadline for receipt of representations specified in the notice of accepted application given under section 34(2)(a) or (b) of the 2024 Act, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/10/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/10/2/b" id="regulation-10-2-b"><Pnumber>b</Pnumber><P3para><Text>pay 50% of the local impact report fee to the relevant planning authority where the local impact report is submitted within the period of two weeks after the deadline for receipt of representations specified in the notice of accepted application given under section 34(2)(a) or (b) of the 2024 Act.</Text></P3para></P3></P2para></P2><P2 RestrictExtent="E+W" RestrictStartDate="2025-12-15"><Title>Fee for a marine impact report</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/11" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/11" id="regulation-11"><Pnumber><CommentaryRef Ref="key-f0403dd5e709fd79c066898ba3c66fa5"/>11</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/11/1" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/11/1" id="regulation-11-1"><Pnumber>1</Pnumber><P2para><Text>Where Natural Resources Wales submits a marine impact report to the Welsh Ministers under section 37(1) or (2) of the 2024 Act, the Welsh Ministers must pay the portion of the fee referred to in regulation 9 which relates to the marine impact report to Natural Resources Wales (“the marine impact report fee”).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/11/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/11/2" id="regulation-11-2"><Pnumber>2</Pnumber><P2para><Text>Unless the Welsh Ministers otherwise agree with Natural Resources Wales the Welsh Ministers must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/11/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/11/3/b" id="regulation-11-3-b"><Pnumber>b</Pnumber><P3para><Text>refund the applicant in full if the application is not accepted or is withdrawn before the submission of a marine impact report by Natural Resources Wales.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group TerritorialApplication="W" RestrictExtent="E+W" RestrictStartDate="2025-12-15"><Title>Refund of unspent fees</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/12" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/12" id="regulation-12"><Pnumber><CommentaryRef Ref="key-9e39407ca0e834be141756d8186e8165"/>12</Pnumber><P1para><Text>The Welsh Ministers must refund to the applicant any part of the fee paid under regulation 9 which has not been spent after the determination of the application.</Text></P1para></P1></P1group></Part><Part DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/part/5" DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/1" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/1" id="regulation-13-1"><Pnumber>1</Pnumber><P2para><Text>A relevant statutory consultee and a relevant planning authority may charge a fee for providing services to applicants in accordance with this regulation.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/2" id="regulation-13-2"><Pnumber>2</Pnumber><P2para><Text>A relevant statutory consultee and a relevant planning authority referred to in paragraph (1) must publish the following information on their website—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/2/a" id="regulation-13-2-a"><Pnumber>a</Pnumber><P3para><Text>the services in respect of which fees are charged,</Text></P3para></P3><P3 id="regulation-13-3"><Pnumber>3</Pnumber><P2para><Text>The relevant statutory consultee and relevant planning authority must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/3/a" id="regulation-13-3-a"><Pnumber>a</Pnumber><P3para><Text>publish the fee payable on their website no less than one month before the fee comes into force;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/3/b" id="regulation-13-3-b"><Pnumber>b</Pnumber><P3para><Text>ensure the fee payable does not exceed the costs reasonably incurred by them in providing the relevant services taking one financial year with another.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/4" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/4" id="regulation-13-4"><Pnumber>4</Pnumber><P2para><Text>The relevant statutory consultee and relevant planning authority must provide a notice setting out the fee to be paid by the applicant when an application is made for a service published on their website.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/5" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/5" id="regulation-13-5"><Pnumber>5</Pnumber><P2para><Text>The applicant must pay the fees to the relevant statutory consultee or relevant planning authority (as appropriate) within such period as may be specified in the notice referred to in paragraph (4) provided such period is not less than 21 days beginning with the day after the date of that notice.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/6" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/6" id="regulation-13-6"><Pnumber>6</Pnumber><P2para><Text>If the applicant fails to pay the fees to the relevant statutory consultee or relevant planning authority (as appropriate) within the period specified, the relevant statutory consultee or relevant planning authority may—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/6/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/6/a" id="regulation-13-6-a"><Pnumber>a</Pnumber><P3para><Text>recover the fees for any completed work from the applicant as a civil debt, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/6/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/6/b" id="regulation-13-6-b"><Pnumber>b</Pnumber><P3para><Text>notwithstanding any requirement to provide the relevant services, withhold the relevant services until the fees are paid.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/13/7" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/13/7" id="regulation-13-7"><Pnumber>7</Pnumber><P2para><Text>In this regulation—</Text><UnorderedList Class="Definition" Decoration="none"><ListItem><Para><Text>“<Term id="term-relevant-planning-authority">relevant planning authority</Term>” (“<Term><Emphasis>awdurdod cynllunio perthnasol</Emphasis></Term>”) means the planning authority for the area in which the proposed development is located;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-relevant-statutory-consultee">relevant statutory consultee</Term>” (“<Emphasis>ymgynghorai statudol perthnasol”</Emphasis>) means a consultee referred to in column 3 of the Table in the Schedule to the Infrastructure Consent (Pre-Application and Application Procedure and Transitional Provisions) (Wales) Regulations 2025<FootnoteRef Ref="f00003"/> where the significant infrastructure project to which the application or proposed application relates falls within a category set out in column 2 of the Table;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-services">services</Term>” (“<Term><Emphasis>gwasanaethau</Emphasis></Term>”) means the performance of an infrastructure consent function or the provision of an infrastructure consent service within the meaning of section 124 of the 2024 Act.</Text></Para></ListItem></UnorderedList></P2para></P2></P1para></P1></P1group><P1group TerritorialApplication="W" RestrictExtent="E+W" RestrictStartDate="2025-12-15"><Title>Fees payable to relevant authorities for applications for removing consent requirements and deeming consents</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14" id="regulation-14"><Pnumber><CommentaryRef Ref="key-cd29998ebbad6b02ded48d3bc622c2a6"/>14</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/1" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/1" id="regulation-14-1"><Pnumber>1</Pnumber><P2para><Text>A relevant authority may charge the applicant a fee in accordance with this regulation for—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/1/a" id="regulation-14-1-a"><Pnumber>a</Pnumber><P3para><Text>a consent provided under section 84(2) of the 2024 Act (removing consent requirements and deeming consents), or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/1/b" id="regulation-14-1-b"><Pnumber>b</Pnumber><P3para><Text>an infrastructure consent service provided in relation to that consent.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/2" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/2" id="regulation-14-2"><Pnumber>2</Pnumber><P2para><Text>A relevant authority must publish the following information on their website—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/2/a" id="regulation-14-2-a"><Pnumber>a</Pnumber><P3para><Text>the services in respect of which fees are charged,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/2/b" id="regulation-14-2-b"><Pnumber>b</Pnumber><P3para><Text>the fee charged for those services, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/2/c" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/2/c" id="regulation-14-2-c"><Pnumber>c</Pnumber><P3para><Text>the method used to calculate fees.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/3" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/3" id="regulation-14-3"><Pnumber>3</Pnumber><P2para><Text>Where a fee is payable by the applicant to the relevant authority, the relevant authority will provide the applicant with details of the amount payable.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/4" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/4" id="regulation-14-4"><Pnumber>4</Pnumber><P2para><Text>A relevant authority must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/4/a" id="regulation-14-5"><Pnumber>5</Pnumber><P2para><Text>The relevant authority must provide a notice setting out the fee to be paid by the applicant when an application is made for a service published on their website.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2025/883/regulation/14/6" IdURI="http://www.legislation.gov.uk/id/wsi/2025/883/regulation/14/6" id="regulation-14-6"><Pnumber>6</Pnumber><P2para><Text>The applicant must pay the fees to the relevant authority within such period as may be specified in the notice provided by the relevant authority <Text Hanging="indented">The Infrastructure (Wales) Act 2024 (“<Term>the 2024 Act</Term>”) establishes a unified application and consenting process to enable making and consideration of applications for infrastructure consent. The process applies to the significant infrastructure projects that are specified in Part 1 of the 2024 Act. Broadly, they are energy, transport, waste and water projects.</Text>

<Text Hanging="indented">Part 2 of the 2024 Act contains the requirement for infrastructure consent. Part 3 of the 2024 Act makes provision about applying for infrastructure consent.</Text>
</P>
<P>
<Text Hanging="indented">Part 4 of the 2024 Act contains provision about appointing an authority to examine applications for infrastructure consent (“<Term>the examining authority</Term>”) and about particular aspects of the examination process. Part 5 of the 2024 Act contains provisions about deciding applications for infrastructure consent.</Text>
</P>

<Text Hanging="indented">The 2024 Act enables the Welsh Ministers to make provision for or in connection with the charging of fees by specified public authorities for the performance of an infrastructure consent function and the provision of an infrastructure consent service (as defined in section 124 of the Act).</Text>
</P>
<P>
<Text Hanging="indented">These Regulations make provision in relation to the following—</Text>

<Text>fees for obtaining information about interests in land (regulation 6),</Text>

<ListItem>
<Para>
<Text>fees for exercising powers of entry to survey land (regulation 7),</Text>
</Para>
</ListItem>
<ListItem>
<Para>
<Text>fees for giving notice of proposed application (regulation 8),</Text>
</Para>

<Text>fees for making an application (regulation 9),</Text>
</Para>

<Text>fees for a local impact report (regulation 10),</Text>

<Text Hanging="indented">The Infrastructure Consent (Pre-Application and Application Procedure and Transitional Provisions) (Wales) Regulations 2025 (<Citation URI="http://www.legislation.gov.uk/id/wsi/2025/690" id="c00001" Class="WelshStatutoryInstrument" Year="2025" Number="690" AlternativeNumber="W. 114">S.I. 2025/690) (W. 114)</Citation> make provisions for the process for pre-application notification, the manner in which applications for infrastructure consent in respect of such development are to be dealt with by the Welsh Ministers and the process to be followed following examination of an application for infrastructure consent.</Text>

<Text Hanging="indented">The Infrastructure Consent (Examination and Decision) (Procedure) (Wales) Regulations 2025 (<Citation URI="http://www.legislation.gov.uk/id/wsi/2025/692" id="c00002" Class="WelshStatutoryInstrument" Year="2025" Number="692" AlternativeNumber="W. 116">S.I. 2025/692) (W. 116)</Citation> deal with the examination procedure which follows an application and make further provision in relation to an examining authority, preparation for and the examination of applications and post-examination processes.</Text>

<Text Hanging="indented">The Infrastructure Consent (Compulsory Acquisition) (Wales) Regulations 2025 (<Citation URI="http://www.legislation.gov.uk/id/wsi/2025/691" id="c00003" Class="WelshStatutoryInstrument" Year="2025" Number="691" AlternativeNumber="W. 115">S.I. 2025/691) (W. 115)</Citation> make supplementary provision where an application for infrastructure consent includes a request to authorise compulsory acquisition of land or an interest in or right over land.</Text>

<Text Hanging="indented">The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations.
