The Foot-and-Mouth Disease (Wales) (Amendment) Order 2025

The Welsh Ministers make the following Order in exercise of the powers conferred by sections 1, 8(1), 17(1), 23 and 25 of the Animal Health Act 19811.

Title and coming into force1.

The title of this Order is the Foot-and-Mouth Disease (Wales) (Amendment) Order 2025.

This Order comes into force on 3 April 2025.

Amendment to the Foot-and-Mouth Disease (Wales) Order 20062.

The Foot-and-Mouth Disease (Wales) Order 20062 is amended as follows.

In article 16(1) (declaration of a temporary control zone) for “must” substitute “may”.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order is made in exercise of the powers conferred by the Animal Health Act 1981 (c. 22). This Order applies in relation to Wales only.

Article 16(1) of the Foot-and-Mouth Disease (Wales) Order 2006 (“the 2006 Order”) currently requires the Welsh Ministers to declare a temporary control zone on suspicion of disease around a suspect premises. Article 2 of this Order amends article 16(1) of the 2006 Order to provide the Welsh Ministers with a discretion as to whether to declare a temporary control zone.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.
