<Text>The Welsh Ministers make these Regulations in exercise of the powers conferred by section 50(3) and paragraph 16(1) of Schedule 5 to, the Agriculture Act 2020<FootnoteRef Ref="f00001"/>.</Text></P>

<Text>As required by Article 9 of Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2002/0178" id="c00001" Class="EuropeanUnionRegulation" Year="2002" Number="0178">(EC) No 178/2002</Citation> of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety<FootnoteRef Ref="f00002"/> there has been open and transparent public consultation during the preparation of these Regulations.</Text></P>

<P><Text Hanging="indented">These Regulations amend the retained EU law that establishes marketing standards for eggs. They apply in relation to Wales.</Text></P>
<P><Text Hanging="indented">They amend retained <Citation URI="http://www.legislation.gov.uk/european/regulation/2008/0589" id="c00005" Class="EuropeanUnionRegulation" Year="2008" Number="0589">Commission Regulation (EC) No 589/2008</Citation> (EUR 2008/589) on marketing standards for eggs, by permitting marketing standards checks on Class A eggs to take place at locations such as packing centres and wholesalers’ premises, but before sale to the final consumer or to mass caterers, rather than requiring the checks to be carried out before customs clearance.</Text></P>
<P><Text Hanging="indented">The Welsh Minister’s Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely cost and benefits of complying with these Regulations.</Text></P>
