The Welsh Ministers, in exercise of the powers conferred on them by sections 45B and 45P(2) of the Public Health (Control of Disease) Act 1984(1), make the following Regulations.

Title and coming into forceE+W

1.—(1) The title of these Regulations is the Health Protection (Coronavirus, International Travel) (Wales) (Amendment) (No. 6) Regulations 2021.

(2) These Regulations come into force at 4.00 a.m. on 23 April 2021.

PART 2E+WAmendments

Amendments to the Health Protection (Coronavirus, International Travel) (Wales) Regulations 2020E+W

2.  The Health Protection (Coronavirus, International Travel) (Wales) Regulations 2020(2) are amended as follows.

Amendment to regulation 6BE+W

3.  In regulation 6B(1A) (requirement to arrange tests before arriving in Wales), before “applies” insert “or regulation 12E(2)(f)”.

4.  In regulation 6K(1) (workforce testing), after “Schedule 2” insert “or regulation 12E(2)(g)”.

Amendments to regulation 12EE+W

5.—(1) Regulation 12E (additional measures applicable to persons travelling from a country or territory listed in Schedule 3A) is amended as follows.

(2) After paragraph (2)(e) insert—

(f)a person described in paragraph 14 of Schedule 5;

(g)a person who—

(i)is required to undertake work as a health or care professional in the United Kingdom,

(ii)is eligible to practice a profession regulated by any of the bodies mentioned in section 25(3) of the National Health Service Reform and Health Care Professions Act 2002(3) or section 67 of the Regulation and Inspection of Social Care (Wales) Act 2016(4), and

(iii)has travelled to the United Kingdom for the purpose of employment as a health or care professional.

(3) In paragraph (3F)(b), in the modification to regulation 10(4), after sub-paragraph (h) insert—

(i)where P is a person falling within paragraph (2)(f), for the purpose of undertaking that work.

6.  In Schedule 3A (countries and territories subject to additional measures), at the appropriate place insert—

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, International Travel) (Wales) Regulations 2020 (S.I. 2020/574 (W. 132)) (the “International Travel Regulations”).

The International Travel Regulations impose requirements on persons entering Wales after having been abroad. They include a requirement for persons arriving in Wales to isolate for a period determined in accordance with those Regulations.

Regulation 3 amends regulation 6B of the International Travel Regulations to exempt a person arriving in Wales from a country or territory subject to additional measures, who has travelled to the United Kingdom for the purpose of transporting certain materials to be used for the provision of a health service by a provider of health services, from the requirement to arrange tests before their arrival.

Regulation 4 amends regulation 6K of the International Travel Regulations to apply the provisions on workforce testing to certain health or care workers arriving in Wales from a country or territory subject to additional measures to undertake employment.

Regulation 5 amends regulation 12E of the International Travel Regulations so as to allow entry into Wales for those two categories of person.

Regulation 6 amends Schedule 3A to the International Travel Regulations, which contains the list of countries and territories subject to additional measures in Wales. Regulation 6 adds India to the list.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has not been prepared as to the likely costs and benefits of complying with these Regulations.
