NODYN ESBONIADOL

(Nid yw’r nodyn hwn yn rhan o’r Rheoliadau)

Mae’r Rheoliadau hyn yn gysylltiedig â Rhan 2 o Reoliadau Rheolaethau Swyddogol ac Amodau Ffytoiechydol (Diwygio) 2021 (O.S. 2021/136), ac mae rhai elfennau o’r Rheoliadau hynny yn gymwys o ran Cymru. Roedd y Rheoliadau hynny yn gwneud darpariaeth i ychwanegu at Reoliad (EU) 2017/625 Senedd Ewrop a’r Cyngor ar reolaethau swyddogol a gweithgareddau swyddogol eraill (“y Rheoliad Rheolaethau Swyddogol”). Yn benodol, roeddent yn ychwanegu at, ac yn addasu, y rhanddirymiadau trosiannol a’r addasiadau trosiannol a nodwyd yn Erthygl 168 o’r Rheoliad Rheolaethau Swyddogol, ac Atodiad 6 iddo, drwy ddarparu i reolaethau swyddogol a gynhelir ar nwyddau penodol a restrir yn yr Atodlen i’r Rheoliadau hynny gael eu cynnal yn y gyrchfan.

Mae’r Rheoliadau hyn yn gwneud diwygiadau cysylltiedig i ddarpariaethau sy’n ymwneud â throseddau yn Rheoliadau Rheolaethau Swyddogol (Iechyd Planhigion ac Organeddau a Addaswyd yn Enetig) (Cymru) 2020 (O.S. 2020/206 (Cy. 48)) i gynnwys arolygiadau yn y gyrchfan yn y fframwaith gorfodi presennol.

Ystyriwyd Cod Ymarfer Gweinidogion Cymru ar gynnal Asesiadau Effaith Rheoleiddiol mewn perthynas â’r Rheoliadau hyn. O ganlyniad, ystyriwyd nad oedd yn angenrheidiol cynnal asesiad effaith rheoleiddiol o’r costau a’r manteision sy’n debygol o ddeillio o gydymffurfio â’r Rheoliadau hyn.
