6B(3), 6C(4) and 6D(4) of Schedule 17 to the Equality Act 2010<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/2010/15">2010 c. 15</ref>.</p></authorialNote> make the following Regulations.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Title, commencement and interpretation</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>The title of these Regulations is the Equality Act 2010 (Disabled School Pupils) (Wales) Regulations 2021.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations come into force on 5 January 2022.</p></content></paragraph><paragraph eId="regulation-1-3"><num>(3)</num><content><p>In these Regulations, “<term refersTo="#term-the-2010-act" eId="term-the-2010-act">the 2010 Act</term>” means the Equality Act 2010.</p></content></paragraph><paragraph eId="regulation-1-4"><num>(4)</num><content><p>Words and expressions used in these Regulations and in the 2010 Act have the same meaning as in that Act, except so far as a contrary intention appears.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Advice and information</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>When making arrangements under paragraph 6B(1) of Schedule 17 to the 2010 Act to provide advice and information to disabled school pupils in its area, and the case friends<authorialNote class="footnote" eId="f00002" marker="2"><p>Paragraph 6A of Schedule 17 to the 2010 Act provides for the appointment of case friends.</p></authorialNote> of such pupils, a local authority must ensure that the advice and information is also provided to the parents of disabled school pupils in its area.</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><intro><p>The arrangements must require the advice and information to include—</p></intro><level class="para1" eId="regulation-2-2-a"><num>(a)</num><content><p>the rights of disabled school pupils under the 2010 Act relating to disability discrimination in schools,</p></content></level><level class="para1" eId="regulation-2-2-b"><num>(b)</num><content><p>the local authority’s duties under the 2010 Act relating to disability discrimination in schools,</p></content></level><level class="para1" eId="regulation-2-2-c"><num>(c)</num><content><p>how to access the local authority’s arrangements for resolving disagreements,</p></content></level><level class="para1" eId="regulation-2-2-d"><num>(d)</num><content><p>how to access independent advocacy services, and</p></content></level><level class="para1" eId="regulation-2-2-e"><num>(e)</num><content><p>how to bring a disability discrimination claim to the Education Tribunal for Wales.</p></content></level></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><intro><p>The arrangements must ensure the advice and information is—</p></intro><level class="para1" eId="regulation-2-3-a"><num>(a)</num><content><p>clear, factual and accurate, and</p></content></level><level class="para1" eId="regulation-2-3-b"><num>(b)</num><content><p>kept up to date.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Dispute resolution</heading><num>3.</num><intro><p>Before appointing a person for the purposes of paragraph 6C(2) of Schedule 17 to the 2010 Act, a local authority must be satisfied that the person they propose to appoint is—</p></intro><level class="para1" eId="regulation-3-a"><num>(a)</num><content><p>sufficiently knowledgeable about the subject matter of Chapter 1 of Part 6 of the 2010 Act, and</p></content></level><level class="para1" eId="regulation-3-b"><num>(b)</num><content><p>independent of the local authority and the persons involved in any dispute.</p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Independent advocacy services</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><intro><p>Before making arrangements with a provider for the purposes of paragraph 6D of Schedule 17 to the 2010 Act, a local authority must be satisfied that the provider—</p></intro><level class="para1" eId="regulation-4-1-a"><num>(a)</num><content><p>is sufficiently knowledgeable about the subject matter of Chapter 1 of Part 6 of the 2010 Act,</p></content></level><level class="para1" eId="regulation-4-1-b"><num>(b)</num><content><p>has the skills needed to communicate effectively with disabled school pupils, including those with communication difficulties,</p></content></level><level class="para1" eId="regulation-4-1-c"><num>(c)</num><content><p>is not on the children’s barred list, or, in the case of a provider working with young people, the adults’ barred list, and</p></content></level><level class="para1" eId="regulation-4-1-d"><num>(d)</num><content><p>will keep confidential records of the services provided under the arrangement.</p></content></level></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><intro><p>For the purposes of this regulation—</p></intro><level class="para1" eId="regulation-4-2-a"><num>(a)</num><content><p>“<term refersTo="#term-provider" eId="term-provider">provider</term>” means a person providing independent advocacy services;</p></content></level><level class="para1" eId="regulation-4-2-b"><num>(b)</num><content><p>“children’s barred list” and “adults’ barred list” mean the lists maintained by the Disclosure and Barring Service under section 2 of the Safeguarding Vulnerable Groups Act 2006<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/2006/47">2006 c. 47</ref>.</p></authorialNote>.</p></content></level></paragraph></hcontainer><hcontainer facilitate the resolution of disputes about disability discrimination in schools.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 4 makes provision about the appointment of persons to provide independent advocacy services for disabled school pupils.</p></blockContainer><blockContainer ukl:Name="P"><p>The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations.
