The Welsh Ministers, in exercise of the powers conferred by sections 26M(3), (4) and (5) and 93(6A)(1) of the Planning (Listed Buildings and Conservation Areas) Act 1990(2), make the following Regulations.
In accordance with section 93(3A)(3) of that Act, a draft of this instrument has been laid before and approved by resolution of Senedd Cymru.
Section 26M was inserted by section 28(1) of the Historic Environment (Wales) Act 2016 (anaw 4) (“the 2016 Act”). Section 93(6A) was inserted by paragraph 26 of Schedule 6 to the Planning and Compulsory Purchase Act 2004 (c. 5).
Section 93(3A) was inserted by section 40(5) of the 2016 Act. The reference in section 93(3A) to the National Assembly for Wales now has effect as a reference to Senedd Cymru, by virtue of section 150A(2) of the Government of Wales Act 2006 (c. 32).
