Welsh Ministers, in exercise of the powers conferred by sections 59, 60(1), 61(1) and 333(7) of the Town and Country Planning Act 1990<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/1990/8">1990 c. 8</ref>. Section 59(4) was inserted by section 55 of, and paragraph 5 of Schedule 7 to, the Planning (Wales) Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/anaw/2015/4">2015 (anaw 4)</ref>. There are other amendments which are not relevant to this instrument.</p></authorialNote> and now vested in them<authorialNote class="footnote" eId="f00002" marker="2"><p>The functions of the Secretary of State under sections 59, 60(1), 61(1) and 333(7) were, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (<ref eId="c00003" href="http://www.legislation.gov.uk/id/uksi/1999/672">S.I. 1999/672</ref>): <i>see</i> the entry in Schedule 1 for the Town and Country Planning Act 1990 as substituted by article 4 of, and Schedule 3 to, the National Assembly for Wales (Transfer of Functions) Order 2000 (<ref eId="c00004" href="http://www.legislation.gov.uk/id/uksi/2000/253">S.I. 2000/253</ref>). By virtue of section 162 of, and paragraphs 30 and 32 of Schedule 11 to, the Government of Wales Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/2006/32">2006 (c. 32)</ref> the functions of the National Assembly for Wales were transferred to the Welsh Ministers.</p></authorialNote>, make the following Order.</p></formula></preamble><body><article eId="article-1"><heading>Title, commencement and application</heading><num>1.</num><paragraph eId="article-1-1"><num>(1)</num><content><p>The title of this Order is the Town and Country Planning (General Permitted Development) (Amendment) (Wales) Order 2020 and it comes into force on 30 March 2020.</p></content></paragraph><paragraph eId="article-1-2"><num>(2)</num><content><p>This Order applies in relation to Wales.</p></content></paragraph></article><article eId="article-2"><heading>Amendment of the Town and Country Planning (General Permitted Development) Order 1995</heading><num>2.</num><paragraph eId="article-2-1"><num>(1)</num><content><p>Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/1995/418">S.I. 1995/418</ref> to which there are amendments which are not relevant to this instrument.</p></authorialNote> is amended as set out in paragraph <ref href="#article-2-2">(2)</ref>.</p></content></paragraph><paragraph eId="article-2-2"><num>(2)</num><content><p><mod>After Part 12 (Development by Local Authorities) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="wsi" ukl:TargetClass="secondary" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><part><num>Part 12A</num><heading>Emergency Development by Local Authorities</heading><chapter><num>Class A</num><article><heading>A. Permitted development</heading><intro><p><b>Development by a local authority on land owned, leased, occupied or maintained by it for the purposes of—</b></p></intro><level class="para1"><num>(a)</num><content><p><b>preventing an emergency;</b></p></content></level><level class="para1"><num>(b)</num><content><p><b>reducing, controlling or mitigating the effects of an emergency; or</b></p></content></level><level class="para1"><num>(c)</num><content><p><b>taking other action in connection with an emergency.</b></p></content></level></article><article><heading>A.1 Conditions</heading><hcontainer name="wrapper1"><intro><p>Development is permitted by Class A subject to the following conditions—</p></intro><level class="para1"><num>(a)</num><content><p>if the developer is not also the local planning authority, the developer must, as soon as reasonably practicable notify the local planning authority of that development; and</p></content></level><level class="para1"><num>(b)</num><intro><p>on or before the expiry of the period of twelve months beginning with the date on which the development began—</p></intro><level class="para2"><num>(i)</num><content><p>any use of that land for a purpose of Class A must cease and any buildings, plant, machinery, structures and erections permitted by Class A must be removed; and</p></content></level><level class="para2"><num>(ii)</num><content><p>the land must be restored to its condition before the development took place, or to such other state as may be agreed in writing between the local planning authority and the developer.</p></content></level></level></hcontainer><hcontainer name="wrapper1"><intro><p><b>A.2 Interpretation of Class A</b></p></intro><paragraph><num>(1)</num><content><p>For the purposes of Class A, “emergency” means an event or situation which threatens serious damage to human welfare in a place in the United Kingdom.</p></content></paragraph><paragraph><num>(2)</num><intro><p>For the purposes of paragraph (1), an event or situation threatens damage to human welfare only if it involves, causes or may cause—</p></intro><level class="para1"><num>(a)</num><content><p>loss of human life;</p></content></level><level class="para1"><num>(b)</num><content><p>human illness or injury;</p></content></level><level class="para1"><num>(c)</num><content><p>homelessness;</p></content></level><level class="para1"><num>(d)</num><content><p>damage to property;</p></content></level><level class="para1"><num>(e)</num><content><p>disruption of a supply of money, food, water, energy or fuel;</p></content></level><level class="para1"><num>(f)</num><content><p>disruption of a system of communication;</p></content></level><level class="para1"><num>(g)</num><content><p>disruption of facilities for transport; or</p></content></level><level class="para1"><num>(h)</num><content><p>disruption of services relating to health.</p></content></level></paragraph></hcontainer></article></chapter></part></quotedStructure></mod></p></content></paragraph></article><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><block name="signature"><signature refersTo="#">Julie James</signature></block><block name="role"><role refersTo="#">Minister for Housing and Local Government, one of the Welsh Ministers</role></block><block name="date"><date date="2020-03-27">27 March 2020</date></block></content></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><heading>EXPLANATORY NOTE</heading><subheading>(This note is not part of the Order)</subheading><blockContainer ukl:Name="P"><p>This Order amends the Town and Country Planning (General Permitted Development) Order 1995 (“the GPDO”).</p></blockContainer><blockContainer ukl:Name="P"><p>Article 3 of, and Schedule 2 to, the GPDO confer permitted development rights in respect of certain development. Where such rights are conferred, an application for planning permission is not required.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 2 of this Order amends Schedule 2 to the GPDO by inserting a new Part 12A (Emergency Development by Local Authorities) to permit local authorities in Wales to carry out certain development in an emergency in accordance with that Part. For these purposes, an emergency is an event or situation which threatens serious damage to human welfare in a place in the United Kingdom.</p></blockContainer><blockContainer ukl:Name="P"><p>The development permitted is development for the purposes of—</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>preventing an emergency,</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>reducing, controlling or mitigating the effects of an emergency, or</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(c)</num><p>taking other action in connection with an emergency.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><p>The permitted development is subject to conditions which are also set out in the new Part 12A.</p></blockContainer><blockContainer ukl:Name="P"><p>The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with this Order.
