The Sustainable Drainage (Enforcement) (Wales) (Amendment) Order 2020

The Welsh Ministers, in exercise of the powers conferred by section 32 of, and paragraph 14 of Schedule 3 to, the Flood and Water Management Act 20101, make the following Order.

In accordance with paragraph 14(5)(b) of Schedule 3 to that Act, a draft of this instrument has been laid before and approved by, a resolution of the National Assembly for Wales.

Title and commencement1.

The title of this Order is the Sustainable Drainage (Enforcement) (Wales) (Amendment) Order 2020.

This Order comes into force on the day after the day on which it is made.

Amendment of the Sustainable Drainage (Enforcement) (Wales) Order 20182.

In article 21 of the Sustainable Drainage (Enforcement) (Wales) Order 20182, omit “not exceeding £20,000”.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order amends the Sustainable Drainage (Enforcement) (Wales) Order 2018 (S.I. 2018/1182 (W. 241)) in order to provide for an unlimited fine for the offences set out within article 21 of that Order.

The Welsh Ministers’ Code of Practice on the carrying out of regulatory impact assessments was considered in relation to this Order. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with this Order.
