NODYN ESBONIADOL

Mae’r Gorchymyn hwn, sydd wedi ei wneud gan Weinidogion Cymru, yn dwyn i rym ddarpariaethau penodedig o Ddeddf Iechyd y Cyhoedd (Cymru) 2017 (“y Ddeddf”).

Mae erthygl 2(1) yn dwyn i rym y darpariaethau a ganlyn ym Mhennod 1 o Ran 3 o’r Ddeddf (ysmygu) ar 29 Medi 2020, i’r graddau sy’n angenrheidiol at ddiben galluogi i reoliadau gael eu gwneud o dan y darpariaethau hynny—

  • dran 6 sy’n ymwneud â’r drosedd o fethu ag atal ysmygu mewn mangre ddi-fwg;

  • adran 10 sy’n ymwneud â thir ysgolion;

  • adran 11 sy’n ymwneud â thir ysbytai;

  • adran 17 sy’n ymwneud ag arwyddion: mangreoedd di-fwg;

  • adran 18 sy’n ymwneud ag awdurdodau gorfodi;

  • adran 27 sy’n ymwneud â hysbysiadau cosb benodedig;

  • adran 28 sy’n ymwneud â dehongli Pennod 1 o Ran 3 o’r Ddeddf; ac

  • Atodlen 1 sy’n ymwneud â chosbau penodedig.

Mae erthygl 2(2) yn dwyn i rym adran 15 (cerbydau di-fwg) ac adran 16 (mangreoedd di-fwg: esemptiadau) o’r Ddeddf ar 29 Medi 2020.
