The Plant Health (Forestry) (Miscellaneous Amendments) (Wales) (EU Exit) Regulations 2019
The Welsh Ministers make these Regulations in exercise of the powers conferred by section 8(1) of, and Schedule 2 to, the European Union (Withdrawal) Act 2018 M1.
In accordance with paragraph 1(8) of Schedule 7 to that Act, a draft of this instrument has been laid before and approved by the National Assembly for Wales.

Title, commencement and application1.
(1)
The title of these Regulations is the Plant Health (Forestry) (Miscellaneous Amendments) (Wales) (EU Exit) Regulations 2019.
(2)
These Regulations come into force on exit day.
(3)
These Regulations apply in relation to Wales.

(1)
The Plant Health (Fees) (Forestry) (Wales) Regulations 2019 M2 are amended as follows.

In regulation 2(1)—
(a)
F3“controlled consignment” means a consignment which—
(a)
is introduced into Wales from a third country; and
(b)
consists of, or includes, isolated bark or wood of a type that is described in Part A of Annex 11, or Annex 12, to Commission Implementing Regulation (EU) 2019/2072 establishing uniform conditions for the implementation of Regulation (EU) 2016/2031 of the European Parliament and the Council, as regards protective measures against pests of plants.”;
(b)
omit the definition of “the Directive”;
(c)
““documentary check” (“gwiriad dogfennol”) means an examination for the purposes of article 12(B1)(c) or 12A(2)(a) of the Order;”;

These Regulations are made in exercise of the powers in section 8(1) of, and Schedule 2 to, the European Union (Withdrawal) (Act) 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies arising from the withdrawal of the United Kingdom from the European Union.
These Regulations make amendments to the Forest Reproductive (Great Britain) Regulations 2002, the Plant Health (Forestry) Order 2005 and the Plant Health (Fees) (Forestry) (Wales) Regulations 2019.
The Welsh Ministers' Code of Practice on the carrying out of regulatory impact assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.
