Regulations is the Electricity (Offshore Generating Stations) (Applications for Consent) (Wales) Regulations 2019 and they come into force on 1 April 2019.</Text></P1para></P1></P1group><P1group RestrictStartDate="2025-12-15" RestrictExtent="E+W" TerritorialApplication="W"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/2" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-5b9f6ac6df85424a2a12a3c9ebdd5b2a"/>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/2/1" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/2/1" id="regulation-2-1"><Pnumber>1</Pnumber><P2para><Text>In these Regulations—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-1990-act">the 1990 Act</Term>” (“<Term id="term-deddf-1990"><Emphasis>Deddf 1990</Emphasis></Term>”) means the Town and Country Planning Act 1990 <CommentaryRef Ref="c23593211"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-application">application</Term>” (“<Term id="term-cais"><Emphasis>cais</Emphasis></Term>”) means an application to the Welsh Ministers for consent under section 36 <CommentaryRef Ref="c23593221"/> to construct, extend or operate a generating station <CommentaryRef Ref="c23593231"/>, together with any application under section 36A <CommentaryRef Ref="c23593241"/> for a declaration relating to rights of navigation which is made with the application under section 36;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-8425b5baf39e0708c67908583b784ca0-1769121413472" CommentaryRef="key-8425b5baf39e0708c67908583b784ca0">“</Addition><Term><Addition ChangeId="key-8425b5baf39e0708c67908583b784ca0-1769121413472" CommentaryRef="key-8425b5baf39e0708c67908583b784ca0">infrastructure consent development</Addition></Term><Addition ChangeId="key-8425b5baf39e0708c67908583b784ca0-1769121413472" CommentaryRef="key-8425b5baf39e0708c67908583b784ca0">” (“</Addition><Term><Emphasis><Addition ChangeId="key-8425b5baf39e0708c67908583b784ca0-1769121413472" CommentaryRef="key-8425b5baf39e0708c67908583b784ca0">datblygiad cydsyniad seilwaith</Addition></Emphasis></Term><Addition ChangeId="key-8425b5baf39e0708c67908583b784ca0-1769121413472" CommentaryRef="key-8425b5baf39e0708c67908583b784ca0">”) means any development in respect of which an applicant is applying for consent in accordance with the provisions of the Infrastructure (Wales) Act 2024;</Addition></Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-local-planning-authority">local planning authority</Term>” (“<Term id="term-awdurdod-cynllunio-lleol"><Emphasis>awdurdod cynllunio lleol</Emphasis></Term>”) has the same meaning as in Part 1 of the 1990 Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-relevant-planning-authority">relevant planning authority</Term>” (“<Term id="term-awdurdod-cynllunio-perthnasol"><Emphasis>awdurdod cynllunio perthnasol</Emphasis></Term>”) means in relation to land in Wales, a local planning authority;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-section-90-development">section 90 development</Term>” (“<Term id="term-datblygiad-adran-90"><Emphasis>datblygiad adran 90</Emphasis></Term>”) means any development in respect of which an applicant on making an application requests the Welsh Ministers to give a direction under section 90(2) or (2ZA) of the 1990 Act <CommentaryRef Ref="c23593251"/> (deemed planning permission for development with government authorisation).</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/2/2" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/2/2" id="regulation-2-2"><Pnumber>2</Pnumber><P2para><Text>Unless otherwise stated, any reference in these Regulations to a numbered section is a reference to that section of the Electricity Act 1989.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2025-12-15" RestrictExtent="E+W" TerritorialApplication="W"><Title>Content of applications</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/3" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/3" id="regulation-3"><Pnumber><CommentaryRef Ref="key-07e8a53fdd7b9f4b6750a5b30e3347ff"/>3</Pnumber><P1para><Text>An application must be in writing and must describe by reference to a map the place to which the application relates, that is, the place where—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/3/a" id="regulation-3-a"><Pnumber>a</Pnumber><P3para><Text>it is proposed to construct the generating station, where the proposed extension will be or where the station proposed to be operated is situated; <CommentaryRef Ref="key-65f533c1479d07398b1440b76eff319b"/>...</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/3/b" id="regulation-3-b"><Pnumber>b</Pnumber><P3para><Text>any section 90 development will be situated <Addition ChangeId="key-94dda6f36839fed8e626d319ba863be1-1769121032845" CommentaryRef="key-94dda6f36839fed8e626d319ba863be1">; and</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/3/c" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/3/c" id="regulation-3-c"><Pnumber><Addition situated</Addition>.</Text></P3para></P3></P1para></P1></P1group><P1group RestrictStartDate="2019-04-01" RestrictExtent="E+W" TerritorialApplication="W"><Title>Service of notice of application on the relevant planning authority</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/4" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/4" id="regulation-4"><Pnumber><CommentaryRef Ref="key-9de93c49ca77bbc96b25345b154f5e48"/>4</Pnumber><P1para><Text>Where an application is made to the Welsh Ministers and a part of the place to which the application relates is within the area of a relevant planning authority, notice of the application must be served on the relevant planning authority.</Text></P1para></P1></P1group><P1group RestrictStartDate="2019-07-05" RestrictExtent="E+W" TerritorialApplication="W"><Title>Service of notice of application where there is no relevant planning authority</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/5" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/5" id="regulation-5"><Pnumber><CommentaryRef Ref="key-89d42ac276d43fcc3a1738ef5a5915f2"/>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/5/1" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/5/1" id="regulation-5-1"><Pnumber>1</Pnumber><P2para><Text>This regulation applies where no part of the place to which an application relates is within the area of a relevant planning authority.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/5/2" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/5/2" id="regulation-5-2"><Pnumber>2</Pnumber><P2para><Text>Where in the applicant's opinion any local planning authority in England and Wales or  <Substitution ChangeId="key-79c5db050e39ffa0769a2eaae80f61dd-1620121294766" CommentaryRef="key-79c5db050e39ffa0769a2eaae80f61dd">any district council</Substitution>  in Northern Ireland is likely to have an interest in the application, the applicant must serve notice of the application upon that body and, within seven days of such service, inform the Welsh Ministers in writing of its identity and provide them with a copy of the notice.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/5/3" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/5/3" id="regulation-5-3"><Pnumber>3</Pnumber><P2para><Text>Where, in the applicant's opinion, no such body as is mentioned in paragraph (2) is likely to have an interest in the application, the applicant must inform the Welsh Ministers of that fact.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/5/4" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/5/4" id="regulation-5-4"><Pnumber>4</Pnumber><P2para><Text>Where in the Welsh Ministers' opinion any local planning authority in England and Wales or  <Substitution ChangeId="key-c99b21f977c2f065bc9e1a3589be957e-1620121318916" CommentaryRef="key-c99b21f977c2f065bc9e1a3589be957e">any district council</Substitution>  in Northern Ireland is likely to have an interest in the application, the Welsh Ministers may, unless they have received a notice under paragraph (2) to the effect that a notice of the application has been served on that body, direct that the applicant must serve notice of an application upon that body.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-04-01" RestrictExtent="E+W" TerritorialApplication="W"><Title>Service of notice of application on other persons</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/6" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/6" id="regulation-6"><Pnumber><CommentaryRef Ref="key-9dfc91531dac424fe01ee2afaea7da62"/>6</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/6/1" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/6/1" id="regulation-6-1"><Pnumber>1</Pnumber><P2para><Text>The applicant must serve notice of an application upon—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/6/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/6/1/a" id="regulation-6-1-a"><Pnumber>a</Pnumber><P3para><Text>the Joint Nature Conservation Committee <CommentaryRef Ref="c23593261"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/6/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/6/1/b" id="regulation-6-1-b"><Pnumber>b</Pnumber><P3para><Text>the Natural Resources Body for Wales <CommentaryRef Ref="c23593271"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/6/1/c" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/6/1/c" id="regulation-6-1-c"><Pnumber>c</Pnumber><P3para><Text>the Maritime and Coastguard Agency;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/6/1/d" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/6/1/d" id="regulation-6-1-d"><Pnumber>d</Pnumber><P3para><Text>a harbour authority, in the case of development in or adjacent to a harbour under the control of that authority;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/6/1/e" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/6/1/e" id="regulation-6-1-e"><Pnumber>e</Pnumber><P3para><Text>such other persons as the Welsh Ministers may direct.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/6/2" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/6/2" id="regulation-6-2"><Pnumber>2</Pnumber><P2para><Text>In this regulation,  “<Term id="term-harbour">harbour</Term>” (“<Term id="term-harbwr"><Emphasis>harbwr</Emphasis></Term>”) and  “<Term id="term-harbour-authority">harbour authority</Term>” (“<Term id="term-awdurdod-harbwr"><Emphasis>awdurdod harbwr</Emphasis></Term>”) have the same meaning as in section 57 of the Harbours Act 1964 <CommentaryRef Ref="c23593281"/> (interpretation).</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-07-05" RestrictExtent="E+W" TerritorialApplication="W"><Title>Publication of notice of application</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/7" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/7" id="regulation-7"><Pnumber><CommentaryRef Ref="key-13bc5208b770145e77300aab2e5ff72f"/>7</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/7/1" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/7/1" id="regulation-7-1"><Pnumber>1</Pnumber><P2para><Text>The applicant must publish notice of an application—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/7/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/7/1/a" id="regulation-7-1-a"><Pnumber>a</Pnumber><P3para><Text>in two successive weeks in one or more local newspapers which are likely to come to the attention of those likely to be affected by the proposed development;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/7/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/7/1/b" id="regulation-7-1-b"><Pnumber>b</Pnumber><P3para><Text>in Lloyd's List and in one or more  <Substitution Ref="key-ae6366f7306be85b509baee00cfe6f14"/>8</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/8/1" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/8/1" id="regulation-8-1"><Pnumber>1</Pnumber><P2para><Text>Any notice served or published pursuant to regulations 5, 6 or 7(1) must state the time (which must not be less than 28 days from the date of service of the notice, or less than 28 days from the date or latest date of publication of the notice) within which, and the manner in which, objections to the application may be made to the Welsh Ministers, by persons other than any relevant planning authority.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/8/2" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/8/2" id="regulation-8-2"><Pnumber>2</Pnumber><P2para><Text>A relevant planning authority must serve notification of any objection by it to an application upon the Welsh Ministers within four months of the date of the application, or within any longer period as may be agreed in writing by the authority with both the Welsh Ministers and the applicant.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-04-01" RestrictExtent="E+W" TerritorialApplication="W"><Title>Public inquiries where there are objections by the relevant planning authority</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/9" the relevant planning authority notify the Welsh Ministers that they object to the application and their objection is not withdrawn, the Welsh Ministers—</Text><P3 id="regulation-9-1-a"><Pnumber>a</Pnumber><P3para><Text>must cause a public inquiry to be held;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/9/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/9/1/b" id="regulation-9-1-b"><Pnumber>b</Pnumber><P3para><Text>before determining whether to give their consent, must consider the objection and the report of the person who held the inquiry.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/9/2" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/9/2" id="regulation-9-2"><Pnumber>2</Pnumber><P2para><Text>Paragraph (1) does not apply where the Welsh Ministers propose to accede to the application subject to such modifications or conditions as will give effect to the objection of the relevant planning authority</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/9/3" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/9/3" id="regulation-9-3"><Pnumber>3</Pnumber><P2para><Text>The Welsh Ministers may, for the purposes of paragraph (1), disregard any objection not notified by a relevant planning authority in accordance with regulation 8(2).</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-04-01" RestrictExtent="E+W" TerritorialApplication="W"><Title>Public inquiries where there are objections by other id="regulation-10-2"><Pnumber>2</Pnumber><P2para><Text>The Welsh Ministers must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/10/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/10/2/a" id="regulation-10-2-a"><Pnumber>a</Pnumber><P3para><Text>consider objections or copies of objections sent to them in accordance with these Regulations, together with all other material considerations, with a view to determining whether a public inquiry should be held with respect to the application; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/10/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/10/2/b" id="regulation-10-2-b"><Pnumber>b</Pnumber><P3para><Text>cause a public inquiry to be held if they think it appropriate to do so, either in addition to or instead of any other hearing or opportunity of stating objections to the application.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-04-01" RestrictExtent="E+W" TerritorialApplication="W"><Title>Scope of public inquiries where there are one or more relevant planning authorities</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/11" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/11" id="regulation-11"><Pnumber><CommentaryRef Ref="key-92bc37cfa786d60d269574e77f0a3853"/>11</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/11/1" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/11/1" id="regulation-11-1"><Pnumber>1</Pnumber><P2para><Text>This regulation applies where—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/11/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/11/1/a" id="regulation-11-1-a"><Pnumber>a</Pnumber><P3para><Text>a public inquiry is to be held in accordance with regulation 9(1) or 10; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/11/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/11/1/b" id="regulation-11-1-b"><Pnumber>b</Pnumber><P3para><Text>the application relates to a place a part of which is in the area of one or more relevant planning authorities.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/11/2" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/11/2" id="regulation-11-2"><Pnumber>2</Pnumber><P2para><Text>Except in so far as the Welsh Ministers otherwise direct, an inquiry held under regulation 9(1) must be confined to so much of the application as relates to land within the area of the authority by whom an objection has been made.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/11/3" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/11/3" id="regulation-11-3"><Pnumber>3</Pnumber><P2para><Text>The Welsh Ministers must have regard to objections made otherwise than by the authority in question in determining whether to give a direction under paragraph (2) and in determining (where they give one) what direction to give.</Text></P2para></P2><P2 id="regulation-11-4-a"><Pnumber>a</Pnumber><P3para><Text>so much of the application as relates to land within the area of a particular relevant planning authority;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/11/4/b" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/11/4/b" id="regulation-11-4-b"><Pnumber>b</Pnumber><P3para><Text>so much of the application as relates to anywhere that is not within the area of a relevant planning authority.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/11/5" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/regulation/11/5" id="regulation-11-5"><Pnumber>5</Pnumber><P2para><Text>For the purposes of paragraph (2) a planning authority that has made an objection is to be treated as not having done so if the Welsh Ministers propose to accede to the application subject to such modifications or conditions as meet that objection.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-04-01" RestrictExtent="E+W" TerritorialApplication="W"><Title>Combined notice</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/regulation/12" by these Regulations may be combined with a notice required by or under Schedule 16 to the Energy Act 2004 <CommentaryRef Ref="c23593291"/> (applications and proposals for notices under section 95) in any case involving the same generating station.</Text></P1para></P1></P1group><P1group RestrictStartDate="2019-04-01" RestrictExtent="E+W" TerritorialApplication="W"><Title>Consequential Minister for Housing and Local Government, one of the Welsh Ministers</JobTitle><DateSigned Date="2019-02-18"><DateText/></DateSigned></Signee></Signatory></SignedSection></Body><ExplanatoryNotes DocumentURI="http://www.legislation.gov.uk/wsi/2019/295/note" IdURI="http://www.legislation.gov.uk/id/wsi/2019/295/note" RestrictStartDate="2019-04-01" RestrictExtent="E+W" TerritorialApplication="W"><P><Text><Emphasis>(This note is not part of the Regulations)</Emphasis></Text></P><P><BlockText><Para><Text>These Regulations make provision about the grant of consents under section 36 of the Electricity Act 1989 (“<Term>the 1989 Act</Term>”) to construct, extend or operate an offshore generating station in respect of which the Welsh Ministers are the appropriate authority.</Text></Para></BlockText></P><P><BlockText><Para><Text>For the purposes of these Regulations a reference to an application for consent under section 36 of the 1989 Act includes any application under section 36A of that Act for a declaration relating to public rights of navigation which is made with an application for consent under section 36 of the 1989 Act.</Text></Para></BlockText></P><P><BlockText><Para><Text>The Welsh Ministers are the appropriate authority in relation to applications made after 1 April 2019 under section 36 of the 1989 Act relating to generating stations (or proposed generating stations) in Welsh waters which have or will have a capacity not exceeding 350 megawatts.</Text></Para></BlockText></P><P><BlockText><Para><Text>“<Term>Welsh waters</Term>” means so much of the internal waters and territorial sea of the United Kingdom as are adjacent to Wales, and the Welsh zone.  “<Term>Welsh Zone</Term>” has the meaning given in section 158 of the Government of Wales Act 2006.</Text></Para></BlockText></P><P><BlockText><Para><Text>These Regulations make provision about—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>the making of applications;</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>service and publicity requirements;</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>the circumstances in which public inquiries are to be held; and</Text></Para></ListItem><ListItem NumberOverride="d"><Para><Text>the scope of public inquiries where there are one or more relevant planning authorities.</Text></Para></ListItem></OrderedList></BlockText></P><P><BlockText><Para><Text>These Regulations also make provision for the circumstances in which a notice required by these Regulations may be combined with a notice required by or under Schedule 16 to the Energy Act 2004.</Text></Para></BlockText></P><P><BlockText><Para><Text>They also make a consequential amendment to the Conservation of Habitats and Species Regulations 2017.</Text></Para></BlockText></P><P><BlockText><Para><Text>The Welsh Ministers' Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations.
