2019.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/2" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/2" id="article-2"><Pnumber>2</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/2/1" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/2/1" id="article-2-1"><Pnumber>1</Pnumber><P2para><Text>In this Order—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-1990-act">the 1990 Act</Term>” (“<Term id="term-deddf-1990"><Emphasis>Deddf 1990</Emphasis></Term>”) means the Town and Country Planning Act 1990 <CommentaryRef Ref="c23435121"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-appellant">appellant</Term>” (“<Term id="term-apelydd"><Emphasis>apelydd</Emphasis></Term>”) means a developer who makes an appeal under this Order;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-approval">approval</Term>” (“<Term id="term-cymeradwyaeth"><Emphasis>cymeradwyaeth</Emphasis></Term>”) means the approval required under paragraph 7(1) of Schedule 3 for a drainage system for construction work;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-authorised-person">authorised person</Term>” (“<Term id="term-person-awdurdodedig"><Emphasis>person awdurdodedig</Emphasis></Term>”) means a person authorised by an approving body;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-breach">breach</Term>” (“<Term id="term-toriad"><Emphasis>toriad</Emphasis></Term>”)<Emphasis>, </Emphasis>in relation to the requirement for approval, means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>construction work <CommentaryRef Ref="c23435131"/> is commenced without approval,</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>a condition of approval is breached, or</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>construction work does not conform to the approved proposals;</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-construction-area">construction area</Term>” (“<Term id="term-ardal-adeiladu"><Emphasis>ardal adeiladu</Emphasis></Term>”) means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>the area of land identified on a plan accompanying an application for planning permission, or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>if an application for planning permission has not been made, the area of land on which construction work has commenced or is proposed to be commenced;</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-developer">developer</Term>” (“<Term id="term-datblygwr"><Emphasis>datblygwr</Emphasis></Term>”) means a person who commences or proposes to commence construction work;</Text></Para></ListItem><ListItem><Para><Text>“electronic communication” (“<Emphasis>cyfathrebiad electronig”</Emphasis>) has the meaning given in section 15(1) of the Electronic Communications Act 2000 <CommentaryRef Ref="c23435141"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-enforcement-notice">enforcement notice</Term>” (“<Term id="term-hysbysiad-gorfodi"><Emphasis>hysbysiad gorfodi</Emphasis></Term>”) has the meaning given in article 8;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-local-planning-authority">local planning authority</Term>” (“<Term id="term-awdurdod-cynllunio-lleol"><Emphasis>awdurdod cynllunio lleol</Emphasis></Term>”) has the meaning given in section 1(1B) <CommentaryRef Ref="c23435151"/> of the 1990 Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-notice-of-appeal">notice of appeal</Term>” (“<Term id="term-hysbysiad-apêl"><Emphasis>hysbysiad apêl</Emphasis></Term>”) means a notice under article 14;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-powers-of-entry">powers of entry</Term>” (“<Term id="term-pwerau-mynediad"><Emphasis>pwerau mynediad</Emphasis></Term>”) means the powers conferred by article 4;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-schedule-3">Schedule 3</Term>” (“<Term           <Strong>PART 2</Strong>
        </Number><Title>Exercise of enforcement functions</Title><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Agreement to exercise enforcement function</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/3" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/3" id="article-3"><Pnumber>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/3/1" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/3/1" id="article-3-1"><Pnumber>1</Pnumber><P2para><Text>An approving body <CommentaryRef Ref="c23435171"/> may agree with the local planning authority (“<Term id="term-the-authority">the Authority</Term>”) that the Authority may exercise an enforcement function under this Order as if it were the approving body.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/3/2" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/3/2" id="article-3-2"><Pnumber>2</Pnumber><P2para><Text>The agreement—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/3/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/3/2/a" id="article-3-2-a"><Pnumber>a</Pnumber><P3para><Text>may relate to any breach of the requirement for approval, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/3/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/3/2/b" id="article-3-2-b"><Pnumber>b</Pnumber><P3para><Text>may contain arrangements to reimburse the costs incurred by the Authority in exercising the enforcement function.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/3/3" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/3/3" id="article-3-3"><Pnumber>3</Pnumber><P2para><Text>In this article,  “<Term id="term-enforcement-function">enforcement function</Term>” means any function exercisable by the approving body in relation to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/3/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/3/3/a" id="article-3-3-a"><Pnumber>a</Pnumber><P3para><Text>powers of entry;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/3/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/3/3/b" id="article-3-3-b"><Pnumber>b</Pnumber><P3para><Text>a temporary stop notice, enforcement notice or stop notice.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Powers of entry</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4" id="article-4"><Pnumber>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/1" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/1" id="article-4-1"><Pnumber>1</Pnumber><P2para><Text>An authorised person may at any reasonable time enter a construction area (except any premises in the construction area used wholly or mainly as a private dwelling house) to determine if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/1/a" id="article-4-1-a"><Pnumber>a</Pnumber><P3para><Text>there has been a breach of the requirement for approval, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/1/b" id="article-4-1-b"><Pnumber>b</Pnumber><P3para><Text>a temporary stop notice, stop notice or enforcement notice has been complied with.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/2" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/2" id="article-4-2"><Pnumber>2</Pnumber><P2para><Text>Paragraph (1) is subject to paragraph (4).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/3" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/3" id="article-4-3"><Pnumber>3</Pnumber><P2para><Text>The authorised person must on request produce evidence of authorisation.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/4" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/4" id="article-4-4"><Pnumber>4</Pnumber><P2para><Text>In an emergency, powers of entry may be exercised at any time.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/5" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/5" id="article-4-5"><Pnumber>5</Pnumber><P2para><Text>An authorised person may not exercise powers of entry to determine if there has been a breach of the requirement for approval if a drainage system for the construction work has been adopted.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/6" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/6" id="article-4-6"><Pnumber>6</Pnumber><P2para><Text>A justice of the peace may, by signed warrant, permit an authorised person to enter any premises in a construction area, if necessary by reasonable force, if the justice on sworn information in writing is satisfied—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/6/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/6/a" id="article-4-6-a"><Pnumber>a</Pnumber><P3para><Text>that there are reasonable grounds to enter the premises for the purposes of paragraph (1) of this article, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/6/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/6/b" id="article-4-6-b"><Pnumber>b</Pnumber><P3para><Text>that any of the conditions in paragraph (7) are met.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/7" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/7" id="article-4-7"><Pnumber>7</Pnumber><P2para><Text>The conditions are—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/7/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/7/a" id="article-4-7-a"><Pnumber>a</Pnumber><P3para><Text>entry to the premises has been, or is likely to be, refused, and notice of the intention to apply for a warrant has been given to the occupier;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/7/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/7/b" id="article-4-7-b"><Pnumber>b</Pnumber><P3para><Text>asking for admission to the premises, or giving such a notice, would defeat the object of the entry;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/4/7/c" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/4/7/c" id="article-4-7-c"><Pnumber>c</Pnumber><P3para><Text>entry is required urgently;</Text></P3para></P3><P3 IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/5/1/a" id="article-5-1-a"><Pnumber>a</Pnumber><P3para><Text>an authorised person enters a construction area or any premises in a construction area in exercise of powers of entry but finds no evidence of a breach of the requirement for approval, and</Text></P3para></P3><P3 result of the exercise of those powers the developer or other person incurs loss.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/5/2" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/5/2" id="article-5-2"><Pnumber>2</Pnumber><P2para><Text>If an authorised person enters a construction area or any premises in a construction area in exercise of powers of entry and a breach of the requirement for approval is found, compensation is payable—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6" id="article-6"><Pnumber>6</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/1" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6/1" id="article-6-1"><Pnumber>1</Pnumber><P2para><Text>An approving body may give a notice (“a temporary stop notice”) to a developer if the approving body has reason to believe that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6/1/a" id="article-6-1-a"><Pnumber>a</Pnumber><P3para><Text>the developer has breached the requirement for approval, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6/1/b" id="article-6-1-b"><Pnumber>b</Pnumber><P3para><Text>it is expedient that the construction work stop immediately.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/2" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6/2" id="article-6-2"><Pnumber>2</Pnumber><P2para><Text>A temporary stop notice must be in writing and must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6/2/a" id="article-6-2-a"><Pnumber>a</Pnumber><P3para><Text>specify the activity that is believed to be a breach,</Text></P3para></P3><P3 id="article-6-2-c"><Pnumber>c</Pnumber><P3para><Text>prohibit the developer from continuing with the activity, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/2/d" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6/2/d" id="article-6-2-d"><Pnumber>d</Pnumber><P3para><Text>specify the consequences of non-compliance with the notice.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/3" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6/3" id="article-6-3"><Pnumber>3</Pnumber><P2para><Text>An approving body may at any time withdraw a temporary stop notice by giving written notice to a developer setting out reasons for the decision to withdraw it.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/4" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6/4" id="article-6-4"><Pnumber>4</Pnumber><P2para><Text>A temporary stop notice has effect from the time it is given and, unless it is earlier withdrawn, ceases to have effect at the end of—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/4/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/6/4/a" id="article-6-4-a"><Pnumber>a</Pnumber><P3para><Text>the period of 4 weeks beginning with the day it is given, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/6/4/b" enforcement notice may be given at any time before a drainage system for the construction work is adopted but not later than 4 years after the breach occurs.</Text></P2para></P2><P2 IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/8/3/c" id="article-8-3-c"><Pnumber>c</Pnumber><P3para><Text>the steps which the developer must take to remedy the id="article-9-1"><Pnumber>1</Pnumber><P2para><Text>For construction work commenced without approval, the enforcement notice must require the developer—</Text><P3 id="article-9-2"><Pnumber>2</Pnumber><P2para><Text>For a breach of a condition of approval, the enforcement notice must require the developer—</Text><P3 carry out work to ensure the drainage system complies with the conditions of approval, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/9/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/9/2/b" id="article-9-2-b"><Pnumber>b</Pnumber><P3para><Text>to restore the construction area to the condition it was in before the construction work began.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/9/3" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/9/3" id="article-9-3"><Pnumber>3</Pnumber><P2para><Text>For construction work that does not conform to the approved proposals, the enforcement notice must require the developer—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/9/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/9/3/a" id="article-9-3-a"><Pnumber>a</Pnumber><P3para><Text>to carry out work to ensure the drainage system complies with the approved proposals, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/9/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/9/3/b" id="article-9-3-b"><Pnumber>b</Pnumber><P3para><Text>to restore the construction area to the condition it was in before the construction work began.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/9/4" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/9/4" id="article-9-4"><Pnumber>4</Pnumber><P2para><Text>If a developer fails to comply with an enforcement notice, the approving body—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/9/4/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/9/4/a" id="article-9-4-a"><Pnumber>a</Pnumber><P3para><Text>may take the steps specified in the enforcement notice or authorise another person to take the steps, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/9/4/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/9/4/b" id="article-9-4-b"><Pnumber>b</Pnumber><P3para><Text>may require the developer to pay expenses incurred under sub-paragraph (a), such expenses to be recoverable as a debt.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/9/5" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/9/5" id="article-9-5"><Pnumber>5</Pnumber><P2para><Text>The approving body or a person authorised under paragraph (4)(a) may at any reasonable time enter a construction area to take the steps specified in the enforcement notice.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Stop notices</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/10" id="article-10-1-a"><Pnumber>a</Pnumber><P3para><Text>the developer has appealed against an enforcement notice, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/10/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/10/1/b" id="article-10-1-b"><Pnumber>b</Pnumber><P3para><Text>the approving body thinks it is expedient that construction work on the land to which the enforcement notice relates should stop immediately.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/10/2" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/10/2" id="article-10-2"><Pnumber>2</Pnumber><P2para><Text>A stop notice may prohibit a developer from continuing with the construction work specified in the notice until—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/10/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/10/3/d" id="article-10-3-d"><Pnumber>d</Pnumber><P3para><Text>the enforcement notice to which it relates.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/10/4" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/10/4" id="article-10-4"><Pnumber>4</Pnumber><P2para><Text>A copy of the enforcement notice must be annexed to the stop notice.</Text></P2para></P2><P2 approving body may at any time withdraw a stop notice by giving written notice to a developer setting out reasons for the decision to withdraw it.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Register of notices</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/11" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/11" id="article-11"><Pnumber>11</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/11/1" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/11/1" id="article-11-1"><Pnumber>1</Pnumber><P2para><Text>An approving body must keep a register containing information relating to all temporary stop notices, enforcement notices and stop notices it gives.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/11/2" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/11/2" id="article-11-2"><Pnumber>2</Pnumber><P2para><Text>The register must contain the information prescribed for the purpose of section 188(1) <CommentaryRef Ref="c23435181"/> of the 1990 Act and by article 30 of the Town and Country Planning (Development Management Procedure) (Wales) Order 2012 <CommentaryRef Ref="c23435191"/> but developer who is given an enforcement notice may by notice appeal to the Welsh Ministers against the decision to give it.</Text></P2para></P2><P2 enforcement notice is suspended until an appeal is determined or withdrawn.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Time limit for making an appeal</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/13" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/13" id="article-13"><Pnumber>13</Pnumber><P1para><Text>An appeal must be made within the period of 4 weeks beginning with the day on which a developer is given an enforcement notice.</Text></P1para></P1></P1group><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Making an appeal</Title><P1 id="article-14-1-a"><Pnumber>a</Pnumber><P3para><Text>be in writing, on a form obtained from the Welsh Ministers,</Text></P3para></P3><P3 copy of any related stop notice or temporary stop notice.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/14/3" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/14/3" id="article-14-3"><Pnumber>3</Pnumber><P2para><Text>A developer who sends a notice of appeal to the Welsh Ministers must, at the same time, send a copy of the notice of appeal and accompanying documents to the approving body.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/14/4" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/14/4" id="article-14-4"><Pnumber>4</Pnumber><P2para><Text>In this article,  “<Term id="term-accompanying-documents">accompanying documents</Term>” means the documents mentioned in paragraph (2).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/14/5" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/14/5" id="article-14-5"><Pnumber>5</Pnumber><P2para><Text>Any notice or other document required in this article to be sent or provided, may be sent by post or electronic communication.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Use of electronic communications</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15" id="article-15"><Pnumber>15</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/1" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/1" id="article-15-1"><Pnumber>1</Pnumber><P2para><Text>Paragraphs (2) to (6) of this article apply where an electronic communication is used by an appellant for the purpose of fulfilling any requirement in article 14.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/2" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/2" id="article-15-2"><Pnumber>2</Pnumber><P2para><Text>The requirement is taken to be fulfilled where the notice or other document transmitted by means of the electronic communication is—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/2/a" id="article-15-2-a"><Pnumber>a</Pnumber><P3para><Text>capable of being accessed by the recipient,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/2/b" id="article-15-2-b"><Pnumber>b</Pnumber><P3para><Text>legible in all material respects, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/2/c" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/2/c" id="article-15-2-c"><Pnumber>c</Pnumber><P3para><Text>sufficiently permanent to be used for subsequent reference.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/3" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/3" id="article-15-3"><Pnumber>3</Pnumber><P2para><Text>In paragraph (2)  “<Term id="term-legible-in-all-material-respects">legible in all material respects</Term>” means that the information contained in the notice or other document is available to the recipient to no lesser extent than it would be if sent or given by means of a document in printed form.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/4" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/4" id="article-15-4"><Pnumber>4</Pnumber><P2para><Text>Where the electronic communication is received by the recipient outside the recipient's business hours, it will be taken to have been received on the next working day.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/5" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/5" id="article-15-5"><Pnumber>5</Pnumber><P2para><Text>A requirement in article 14 that any notice or other document should be in writing is fulfilled where that document meets the criteria in paragraph (2) and  “written” and cognate expressions are to be construed accordingly.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/6" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/6" id="article-15-6"><Pnumber>6</Pnumber><P2para><Text>Where an appellant sends any notice or other document to the Welsh Ministers using electronic communications, they will be taken to have agreed—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/6/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/6/a" id="article-15-6-a"><Pnumber>a</Pnumber><P3para><Text>to the use of such communications for all purposes relating to the appeal which are capable of being carried out electronically;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/6/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/6/b" id="article-15-6-b"><Pnumber>b</Pnumber><P3para><Text>that the appellant's address for the purpose of such communications is the address incorporated into or otherwise logically associated with, the notice or other document;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/15/6/c" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/15/6/c" id="article-15-6-c"><Pnumber>c</Pnumber><P3para><Text>that the appellant's deemed agreement under this paragraph will subsist until the appellant gives notice in accordance with article 16, of a wish to revoke the agreement.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Withdrawal of consent to the use of electronic communications</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/16" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/16" id="article-16"><Pnumber>16</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/16/1" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/16/1" id="article-16-1"><Pnumber>1</Pnumber><P2para><Text>Where an appellant is no longer willing to accept the use of electronic communications for any purpose of this Order which is capable of being effected electronically, the appellant must give notice in writing—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/16/1/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/16/1/a" id="article-16-1-a"><Pnumber>a</Pnumber><P3para><Text>withdrawing any address notified to the Welsh Ministers or to an approving body for that purpose, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/16/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/16/1/b" id="article-16-1-b"><Pnumber>b</Pnumber><P3para><Text>revoking any agreement entered into with the Welsh Ministers or with an approving body for that purpose.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/16/2" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/16/2" id="article-16-2"><Pnumber>2</Pnumber><P2para><Text>Withdrawal or revocation under paragraph (1) is final and takes effect on the later of—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/article/16/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/16/2/a" id="article-16-2-a"><Pnumber>a</Pnumber><P3para><Text>the date specified by the appellant in the notice but that date must not be less than 1 week after the date on which the notice is given, or</Text></P3para></P3><P3 IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/article/17/1" id="article-17-1"><Pnumber>1</Pnumber><P2para><Text>Paragraphs (2) to (4) of this article apply where the Welsh Ministers are in id="article-17-2"><Pnumber>2</Pnumber><P2para><Text>Section 319B (determination of procedure for certain proceedings: Wales) of the 1990 Act and the Town and Country Planning (Referred Applications and Appeals Procedure) (Wales) Regulations 2017 <CommentaryRef Ref="c23435201"/> (“<Term id="term-the-2017-regulations">the 2017 Regulations</Term>”) apply to an appeal under this Order with the applies in relation to the acts and defaults of a member in connection with the member's functions of management as it applies to an officer of a body corporate.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2019-01-07" RestrictExtent="E+W" TerritorialApplication="W"><Title>Offences by partnerships and unincorporated id="article-24-1"><Pnumber>1</Pnumber><P2para><Text>Proceedings for an offence under this Order alleged to have been committed by a partnership or an unincorporated association must be brought against Minister for Environment under the authority of Cabinet Secretary for Energy, Planning and Rural Affairs, one of the Welsh Ministers</JobTitle><DateSigned Date="2018-11-13"><DateText/></DateSigned></Signee></Signatory></SignedSection></Body><ExplanatoryNotes DocumentURI="http://www.legislation.gov.uk/wsi/2018/1182/note" IdURI="http://www.legislation.gov.uk/id/wsi/2018/1182/note" RestrictExtent="E+W" TerritorialApplication="W"><P><Text><Emphasis>(This note is not part of the Order)</Emphasis></Text></P><P><BlockText><Para><Text>This Order provides for the enforcement of breach of the approval required (“the requirement for approval”) under paragraph 7(1) of Schedule 3 to the Flood and Water Management Act 2010 (c. 29) (“<Term>the Act</Term>”) in relation to drainage systems for construction work.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 3 provides that an approving body may agree with the local planning authority that that authority may exercise enforcement functions under this Order on behalf of the approving body.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 4 provides for powers of entry onto property of a person authorised by an approving body for the purpose of ascertaining whether there has been a breach of requirement for approval or whether a temporary stop notice, enforcement notice or stop notice has been complied with, including circumstances in which an application may be made to a court for a warrant.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 5 provides for the circumstances in which a developer or other person may recover compensation in relation to loss incurred as a result of the exercise of powers of entry pursuant to article 4.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 6 confers power on an approving body to give a temporary stop notice to a developer, where the body has reason to believe that a developer has breached the requirement for approval. The duration of such a notice is limited in accordance with that article.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 7 provides for the circumstances in which a developer may recover compensation in relation to loss incurred as a result of being given a temporary stop notice.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 8 confers power on an approving body, where a developer has breached the requirement for approval, to give a notice to the developer (an  “enforcement notice”), specifying the steps to be taken by the developer to remedy the breach.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 9 specifies the steps to be taken by a developer, that must be included in an enforcement notice in specified circumstances, and provides for the steps the approving body may take in the event of non-compliance with the notice.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 10 confers power on an approving body to give a developer a stop notice, in circumstances where the developer has appealed against an enforcement notice and the approving body thinks it expedient that the construction work to which the enforcement notice relates, should stop immediately. Article 10 also provides for the circumstances in which such a notice ceases to have effect.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 11 requires the approving body to maintain a register of all stop notices, temporary stop notices and enforcement notices that it gives, and prescribes the information to be entered in the register.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 12 provides for a developer to appeal to the Welsh Ministers against an enforcement notice on grounds specified in the article.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 13 prescribes the period within which an appeal must be made.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 14 prescribes the content of a notice of appeal, and the actions that must be taken to make an appeal.</Text></Para></BlockText></P><P><BlockText><Para><Text>Articles 15 and 16 provide respectively, for the use of electronic communications and withdrawal of consent to the use of electronic communications in relation to appeals.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 17 makes provision for section 319B of the Town and Country Planning Act 1990 (c. 8) (“<Term>the 1990 Act</Term>”) and the Town and Country Planning (Referred Applications and Appeals Procedure) (Wales) Regulations 2017 (S.I. 2017/544 (W. 121)) to apply, with appropriate modifications, to an appeal against an enforcement notice under this Order, as if it was an appeal against a planning enforcement notice.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 18 provides that the Welsh Ministers are to determine an appeal under this Order.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 19 provides for the powers of the Welsh Ministers in determining an appeal against an enforcement notice.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 20 provides for procedure in relation to evidence in a hearing or inquiry, by applying, subject to appropriate modifications, subsections (2) and (3) of section 250 of the Local Government Act 1972 (c. 70) (local inquiries: evidence and costs), and in relation to costs, by applying section 322C of the 1990 Act (costs: Wales).</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 21 provides for an offence of failure to comply with a temporary stop notice, enforcement notice or stop notice.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 22 provides for an offence of wilful obstruction of a person authorised by an approving body who is exercising powers of entry under Article 4.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 23 makes provision for liability of officers and members where an offence under this Order is committed by a body corporate.</Text></Para></BlockText></P><P><BlockText><Para><Text>Article 24 makes provision for liability of partnerships and partners, where an offence under this Order is committed by a partnership, and for the liability of unincorporated associations and their officers, where such an offence is committed by an unincorporated association.</Text></Para></BlockText></P><P><BlockText><Para><Text>A regulatory impact assessment in relation to Wales has been prepared on the likely costs and benefits of complying with this Order.
