2019</docDate></block></container></preface><preamble><formula name="enactingText"><p>The Welsh Ministers, in exercise of the powers conferred by sections 32 and 48(2) of, and paragraphs 4(a) and 14 of Schedule 3 to, the Flood and Water Management Act 2010 <noteRef href="#c23435111" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>, make the following Order.</p><p>In accordance with paragraph 14(5)(b) of Schedule 3 to that Act a draft of this instrument has been laid before and approved by, a resolution of the National Assembly for Wales.</p></formula></preamble><body eId="body"><part eId="part-1"><num><b>PART 1</b></num><heading>Introduction</heading><article eId="article-1"><heading>Title and commencement</heading><num>1.</num><paragraph eId="article-1-1"><num>(1)</num><content><p>The title of this Order is the Sustainable Drainage (Enforcement) (Wales) Order 2018.</p></content></paragraph><paragraph eId="article-1-2"><num>(2)</num><content><p>This Order comes into force on 7 January 2019.</p></content></paragraph></article><article eId="article-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="article-2-1"><num>(1)</num><intro><p>In this Order—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-the-1990-act" eId="term-the-1990-act">the 1990 Act</term>” (“<term refersTo="#term-deddf-1990" eId="term-deddf-1990"><i>Deddf 1990</i></term>”) means the Town and Country Planning Act 1990 <noteRef href="#c23435121" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-appellant" eId="term-appellant">appellant</term>” (“<term refersTo="#term-apelydd" eId="term-apelydd"><i>apelydd</i></term>”) means a developer who makes an appeal under this Order;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-approval" eId="term-approval">approval</term>” (“<term refersTo="#term-cymeradwyaeth" eId="term-cymeradwyaeth"><i>cymeradwyaeth</i></term>”) means the approval required under paragraph 7(1) of Schedule 3 for a drainage system for construction work;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-authorised-person" eId="term-authorised-person">authorised person</term>” (“<term refersTo="#term-person-awdurdodedig" eId="term-person-awdurdodedig"><i>person awdurdodedig</i></term>”) means a person authorised by an approving body;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-breach" eId="term-breach">breach</term>” (“<term refersTo="#term-toriad" eId="term-toriad"><i>toriad</i></term>”)<i>, </i>in relation to the requirement for approval, means—</p></intro><level class="para1"><num>(a)</num><content><p>construction work <noteRef href="#c23435131" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> is commenced without approval,</p></content></level><level class="para1"><num>(b)</num><content><p>a condition of approval is breached, or</p></content></level><level class="para1"><num>(c)</num><content><p>construction work does not conform to the approved proposals;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-construction-area" eId="term-construction-area">construction area</term>” (“<term refersTo="#term-ardal-adeiladu" eId="term-ardal-adeiladu"><i>ardal adeiladu</i></term>”) means—</p></intro><level class="para1"><num>(a)</num><content><p>the area of land identified on a plan accompanying an application for planning permission, or</p></content></level><level class="para1"><num>(b)</num><content><p>if an application for planning permission has not been made, the area of land on which construction work has commenced or is proposed to be commenced;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-developer" eId="term-developer">developer</term>” (“<term refersTo="#term-datblygwr" eId="term-datblygwr"><i>datblygwr</i></term>”) means a person who commences or proposes to commence construction work;</p></content></hcontainer><hcontainer name="definition"><content><p>“electronic communication” (“<i>cyfathrebiad electronig”</i>) has the meaning given in section 15(1) of the Electronic Communications Act 2000 <noteRef href="#c23435141" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-enforcement-notice" eId="term-enforcement-notice">enforcement notice</term>” (“<term refersTo="#term-hysbysiad-gorfodi" eId="term-hysbysiad-gorfodi"><i>hysbysiad gorfodi</i></term>”) has the meaning given in article 8;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-local-planning-authority" eId="term-local-planning-authority">local planning authority</term>” (“<term refersTo="#term-awdurdod-cynllunio-lleol" eId="term-awdurdod-cynllunio-lleol"><i>awdurdod cynllunio lleol</i></term>”) has the meaning given in section 1(1B) <noteRef href="#c23435151" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> of the 1990 Act;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-notice-of-appeal" eId="term-notice-of-appeal">notice of appeal</term>” (“<term refersTo="#term-hysbysiad-apêl" eId="term-hysbysiad-apêl"><i>hysbysiad apêl</i></term>”) means a notice under article 14;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-powers-of-entry" eId="term-powers-of-entry">powers of entry</term>” (“<term refersTo="#term-pwerau-mynediad" eId="term-pwerau-mynediad"><i>pwerau mynediad</i></term>”) means the powers conferred by article 4;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-schedule-3" eId="term-schedule-3">Schedule 3</term>” (“<term refersTo="#term-atodlen-3" eId="term-atodlen-3"><i>Atodlen 3</i></term>”) means Schedule 3 to the Flood and Water Management Act 2010;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-stop-notice" eId="term-stop-notice">stop notice</term>” (“<term refersTo="#term-hysbysiad-stop" eId="term-hysbysiad-stop"><i>hysbysiad stop</i></term>”) has the meaning given in article 10;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-temporary-stop-notice" eId="term-temporary-stop-notice">temporary stop notice</term>” (“<term refersTo="#term-hysbysiad-stop-dros-dro" eId="term-hysbysiad-stop-dros-dro"><i>hysbysiad stop dros dro</i></term>”) has the meaning given in article 6;</p></content></hcontainer><hcontainer name="definition"><content><p>“time limit for making an appeal”
                      <i>(“terfyn amser ar gyfer gwneud apêl</i>”) has the meaning given in article 13.</p></content></hcontainer></paragraph><paragraph eId="article-2-2"><num>(2)</num><content><p>In this Order a reference to  “<term refersTo="#term-construction-work" eId="term-construction-work">construction work</term>” is to be construed as a reference to construction work having drainage implications <noteRef href="#c23435161" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>.</p></content></paragraph></article></part><part eId="part-2"><num><b>PART 2</b></num><heading>Exercise of enforcement functions</heading><article eId="article-3"><heading>Agreement to exercise enforcement function</heading><num>3.</num><paragraph eId="article-3-1"><num>(1)</num><content><p>An approving body <noteRef href="#c23435171" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> may agree with the local planning authority (“<term refersTo="#term-the-authority" eId="term-the-authority">the Authority</term>”) that the Authority may exercise an enforcement function under this Order as if it were the approving body.</p></content></paragraph><paragraph eId="article-3-2"><num>(2)</num><intro><p>The agreement—</p></intro><level class="para1" eId="article-3-2-a"><num>(a)</num><content><p>may relate to any breach of the requirement for approval, and</p></content></level><level class="para1" eId="article-3-2-b"><num>(b)</num><content><p>may contain arrangements to reimburse the costs incurred by the Authority in exercising the enforcement function.</p></content></level></paragraph><paragraph eId="article-3-3"><num>(3)</num><intro><p>In this article,  “<term refersTo="#term-enforcement-function" eId="term-enforcement-function">enforcement function</term>” means any function exercisable by the approving body in relation to—</p></intro><level class="para1" eId="article-3-3-a"><num>(a)</num><content><p>powers of entry;</p></content></level><level class="para1" eId="article-3-3-b"><num>(b)</num><content><p>a temporary stop notice, enforcement notice or stop notice.</p></content></level></paragraph></article><article eId="article-4"><heading>Powers of entry</heading><num>4.</num><paragraph eId="article-4-1"><num>(1)</num><intro><p>An authorised person may at any reasonable time enter a construction area (except any premises in the construction area used wholly or mainly as a private dwelling house) to determine if—</p></intro><level class="para1" eId="article-4-1-a"><num>(a)</num><content><p>there has been a breach of the requirement for approval, or</p></content></level><level class="para1" eId="article-4-1-b"><num>(b)</num><content><p>a temporary stop notice, stop notice or enforcement notice has been complied with.</p></content></level></paragraph><paragraph eId="article-4-2"><num>(2)</num><content><p>Paragraph (1) is subject to paragraph (4).</p></content></paragraph><paragraph eId="article-4-3"><num>(3)</num><content><p>The authorised person must on request produce evidence of authorisation.</p></content></paragraph><paragraph eId="article-4-4"><num>(4)</num><content><p>In an emergency, powers of entry may be exercised at any time.</p></content></paragraph><paragraph eId="article-4-5"><num>(5)</num><content><p>An authorised person may not exercise powers of entry to determine if there has been a breach of the requirement for approval if a drainage system for the construction work has been adopted.</p></content></paragraph><paragraph eId="article-4-6"><num>(6)</num><intro><p>A justice of the peace may, by signed warrant, permit an authorised person to enter any premises in a construction area, if necessary by reasonable force, if the justice on sworn information in writing is satisfied—</p></intro><level class="para1" eId="article-4-6-a"><num>(a)</num><content><p>that there are reasonable grounds to enter the premises for the purposes of paragraph (1) of this article, and</p></content></level><level class="para1" eId="article-4-6-b"><num>(b)</num><content><p>that any of the conditions in paragraph (7) are met.</p></content></level></paragraph><paragraph eId="article-4-7"><num>(7)</num><intro><p>The conditions are—</p></intro><level class="para1" eId="article-4-7-a"><num>(a)</num><content><p>entry to the premises has been, or is likely to be, refused, and notice of the intention to apply for a warrant has been given to the occupier;</p></content></level><level class="para1" eId="article-4-7-b"><num>(b)</num><content><p>asking for admission to the premises, or giving such a notice, would defeat the object of the entry;</p></content></level><level class="para1" eId="article-4-7-c"><num>(c)</num><content><p>entry is required urgently;</p></content></level><level class="para1" eId="article-4-7-d"><num>(d)</num><content><p>the premises are unoccupied or the occupier is temporarily absent.</p></content></level></paragraph><paragraph eId="article-4-8"><num>(8)</num><content><p>A warrant is valid for 3 months.</p></content></paragraph><paragraph eId="article-4-9"><num>(9)</num><content><p>An authorised person entering premises which are unoccupied or from which the occupier is temporarily absent must leave the premises as effectively secured against unauthorised entry as they were before entry.</p></content></paragraph></article><article eId="article-5"><heading>Compensation for loss resulting from exercise of powers of entry</heading><num>5.</num><paragraph eId="article-5-1"><num>(1)</num><intro><p>A developer or other person is entitled to compensation if—</p></intro><level class="para1" eId="article-5-1-a"><num>(a)</num><content><p>an authorised person enters a construction area or any premises in a construction area in exercise of powers of entry but finds no evidence of a breach of the requirement for approval, and</p></content></level><level class="para1" eId="article-5-1-b"><num>(b)</num><content><p>as a result of the exercise of those powers the developer or other person incurs loss.</p></content></level></paragraph><paragraph eId="article-5-2"><num>(2)</num><intro><p>If an authorised person enters a construction area or any premises in a construction area in exercise of powers of entry and a breach of the requirement for approval is found, compensation is payable—</p></intro><level class="para1" eId="article-5-2-a"><num>(a)</num><content><p>to the developer for any loss resulting only from an unreasonable exercise of those powers;</p></content></level><level class="para1" eId="article-5-2-b"><num>(b)</num><content><p>to any other person as if no evidence of a breach were found.</p></content></level></paragraph><paragraph eId="article-5-3"><num>(3)</num><content><p>Any claim for compensation must be made to the approving body within 12 months after the exercise of those powers.</p></content></paragraph><paragraph eId="article-5-4"><num>(4)</num><content><p>Disputes about compensation are to be determined by the Upper Tribunal.</p></content></paragraph></article></part><part eId="part-3"><num><b>PART 3</b></num><heading>Notices</heading><article eId="article-6"><heading>Temporary stop notices</heading><num>6.</num><paragraph eId="article-6-1"><num>(1)</num><intro><p>An approving body may give a notice (“a temporary stop notice”) to a developer if the approving body has reason to believe that—</p></intro><level class="para1" eId="article-6-1-a"><num>(a)</num><content><p>the developer has breached the requirement for approval, and</p></content></level><level class="para1" eId="article-6-1-b"><num>(b)</num><content><p>it is expedient that the construction work stop immediately.</p></content></level></paragraph><paragraph eId="article-6-2"><num>(2)</num><intro><p>A temporary stop notice must be in writing and must—</p></intro><level class="para1" eId="article-6-2-a"><num>(a)</num><content><p>specify the activity that is believed to be a breach,</p></content></level><level class="para1" eId="article-6-2-b"><num>(b)</num><content><p>give reasons for that view,</p></content></level><level class="para1" eId="article-6-2-c"><num>(c)</num><content><p>prohibit the developer from continuing with the activity, and</p></content></level><level class="para1" eId="article-6-2-d"><num>(d)</num><content><p>specify the consequences of non-compliance with the notice.</p></content></level></paragraph><paragraph eId="article-6-3"><num>(3)</num><content><p>An approving body may at any time withdraw a temporary stop notice by giving written notice to a developer setting out reasons for the decision to withdraw it.</p></content></paragraph><paragraph eId="article-6-4"><num>(4)</num><intro><p>A temporary stop notice has effect from the time it is given and, unless it is earlier withdrawn, ceases to have effect at the end of—</p></intro><level class="para1" eId="article-6-4-a"><num>(a)</num><content><p>the period of 4 weeks beginning with the day it is given, or</p></content></level><level class="para1" eId="article-6-4-b"><num>(b)</num><content><p>any shorter period specified in the notice, beginning with the day it is given.</p></content></level></paragraph><paragraph eId="article-6-5"><num>(5)</num><content><p>A second or subsequent temporary stop notice must not be given in respect of the same activity unless the approving body has first taken some other enforcement action in relation to the breach.</p></content></paragraph></article><article eId="article-7"><heading>Compensation for loss resulting from temporary stop notice</heading><num>7.</num><paragraph eId="article-7-1"><num>(1)</num><intro><p>A developer who suffers loss as a result of being given a temporary stop notice is entitled to compensation if the approving body—</p></intro><level class="para1" eId="article-7-1-a"><num>(a)</num><content><p>withdraws the notice, or</p></content></level><level class="para1" eId="article-7-1-b"><num>(b)</num><content><p>does not take any further enforcement action.</p></content></level></paragraph><paragraph eId="article-7-2"><num>(2)</num><content><p>Any claim for compensation must be made to the approving body within 12 months after the notice is withdrawn or ceases to have effect, whichever is the earlier.</p></content></paragraph><paragraph eId="article-7-3"><num>(3)</num><content><p>Disputes about compensation are to be determined by the Upper Tribunal.</p></content></paragraph></article><article eId="article-8"><heading>Enforcement notices</heading><num>8.</num><paragraph eId="article-8-1"><num>(1)</num><content><p>If a developer breaches the requirement for approval, the approving body may give a notice to the developer requiring the developer to take steps to remedy the breach (“an enforcement notice”).</p></content></paragraph><paragraph eId="article-8-2"><num>(2)</num><content><p>An enforcement notice may be given at any time before a drainage system for the construction work is adopted but not later than 4 years after the breach occurs.</p></content></paragraph><paragraph eId="article-8-3"><num>(3)</num><intro><p>An enforcement notice must be in writing and must specify—</p></intro><level class="para1" eId="article-8-3-a"><num>(a)</num><content><p>the construction area to which the notice relates,</p></content></level><level class="para1" eId="article-8-3-b"><num>(b)</num><content><p>details of the breach,</p></content></level><level class="para1" eId="article-8-3-c"><num>(c)</num><content><p>the steps which the developer must take to remedy the breach,</p></content></level><level class="para1" eId="article-8-3-d"><num>(d)</num><content><p>the date by which the steps must be taken,</p></content></level><level class="para1" eId="article-8-3-e"><num>(e)</num><content><p>rights of appeal, including the time limit for making an appeal, and</p></content></level><level class="para1" eId="article-8-3-f"><num>(f)</num><content><p>the consequences of non-compliance with the notice.</p></content></level></paragraph><paragraph eId="article-8-4"><num>(4)</num><content><p>An enforcement notice must not require the developer to take any steps until at least 4 weeks after the date on which the notice is given.</p></content></paragraph><paragraph eId="article-8-5"><num>(5)</num><intro><p>An approving body may at any time by written notice to a developer—</p></intro><level class="para1" eId="article-8-5-a"><num>(a)</num><content><p>withdraw an enforcement notice, giving reasons, or</p></content></level><level class="para1" eId="article-8-5-b"><num>(b)</num><intro><p>vary an enforcement notice by—</p></intro><level class="para2" eId="article-8-5-b-i"><num>(i)</num><content><p>reducing the amount of work necessary to comply with the notice, or</p></content></level><level class="para2" eId="article-8-5-b-ii"><num>(ii)</num><content><p>extending the time for taking any step specified in the notice.</p></content></level></level></paragraph></article><article eId="article-9"><heading>Steps required by an enforcement notice</heading><num>9.</num><paragraph eId="article-9-1"><num>(1)</num><intro><p>For construction work commenced without approval, the enforcement notice must require the developer—</p></intro><level class="para1" eId="article-9-1-a"><num>(a)</num><content><p>to apply for approval (the application to be made as if construction work had not commenced), or</p></content></level><level class="para1" eId="article-9-1-b"><num>(b)</num><content><p>to restore the construction area to the condition it was in before the construction work began.</p></content></level></paragraph><paragraph eId="article-9-2"><num>(2)</num><intro><p>For a breach of a condition of approval, the enforcement notice must require the developer—</p></intro><level class="para1" eId="article-9-2-a"><num>(a)</num><content><p>to carry out work to ensure the drainage system complies with the conditions of approval, or</p></content></level><level class="para1" eId="article-9-2-b"><num>(b)</num><content><p>to restore the construction area to the condition it was in before the construction work began.</p></content></level></paragraph><paragraph eId="article-9-3"><num>(3)</num><intro><p>For construction work that does not conform to the approved proposals, the enforcement notice must require the developer—</p></intro><level class="para1" eId="article-9-3-a"><num>(a)</num><content><p>to carry out work to ensure the drainage system complies with the approved proposals, or</p></content></level><level class="para1" eId="article-9-3-b"><num>(b)</num><content><p>to restore the construction area to the condition it was in before the construction work began.</p></content></level></paragraph><paragraph eId="article-9-4"><num>(4)</num><intro><p>If a developer fails to comply with an enforcement notice, the approving body—</p></intro><level class="para1" eId="article-9-4-a"><num>(a)</num><content><p>may take the steps specified in the enforcement notice or authorise another person to take the steps, and</p></content></level><level class="para1" eId="article-9-4-b"><num>(b)</num><content><p>may require the developer to pay expenses incurred under sub-paragraph (a), such expenses to be recoverable as a debt.</p></content></level></paragraph><paragraph eId="article-9-5"><num>(5)</num><content><p>The approving body or a person authorised under paragraph (4)(a) may at any reasonable time enter a construction area to take the steps specified in the enforcement notice.</p></content></paragraph></article><article eId="article-10"><heading>Stop notices</heading><num>10.</num><paragraph eId="article-10-1"><num>(1)</num><intro><p>An approving body may give a notice (“a stop notice”) to a developer if—</p></intro><level class="para1" eId="article-10-1-a"><num>(a)</num><content><p>the developer has appealed against an enforcement notice, and</p></content></level><level class="para1" eId="article-10-1-b"><num>(b)</num><content><p>the approving body thinks it is expedient that construction work on the land to which the enforcement notice relates should stop immediately.</p></content></level></paragraph><paragraph eId="article-10-2"><num>(2)</num><intro><p>A stop notice may prohibit a developer from continuing with the construction work specified in the notice until—</p></intro><level class="para1" eId="article-10-2-a"><num>(a)</num><content><p>the appeal against the enforcement notice is determined or withdrawn, or</p></content></level><level class="para1" eId="article-10-2-b"><num>(b)</num><intro><p>the approving body—</p></intro><level class="para2" eId="article-10-2-b-i"><num>(i)</num><content><p>withdraws the stop notice, or</p></content></level><level class="para2" eId="article-10-2-b-ii"><num>(ii)</num><content><p>takes further enforcement action.</p></content></level></level></paragraph><paragraph eId="article-10-3"><num>(3)</num><intro><p>A stop notice must be in writing and must specify—</p></intro><level class="para1" eId="article-10-3-a"><num>(a)</num><content><p>the date on which it takes effect,</p></content></level><level class="para1" eId="article-10-3-b"><num>(b)</num><content><p>the grounds on which it was served,</p></content></level><level class="para1" eId="article-10-3-c"><num>(c)</num><content><p>the consequences of not complying with it, and</p></content></level><level class="para1" eId="article-10-3-d"><num>(d)</num><content><p>the enforcement notice to which it relates.</p></content></level></paragraph><paragraph eId="article-10-4"><num>(4)</num><content><p>A copy of the enforcement notice must be annexed to the stop notice.</p></content></paragraph><paragraph eId="article-10-5"><num>(5)</num><content><p>An approving body may at any time withdraw a stop notice by giving written notice to a developer setting out reasons for the decision to withdraw it.</p></content></paragraph></article><article eId="article-11"><heading>Register of notices</heading><num>11.</num><paragraph eId="article-11-1"><num>(1)</num><content><p>An approving body must keep a register containing information relating to all temporary stop notices, enforcement notices and stop notices it gives.</p></content></paragraph><paragraph eId="article-11-2"><num>(2)</num><content><p>The register must contain the information prescribed for the purpose of section 188(1) <noteRef href="#c23435181" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> of the 1990 Act and by article 30 of the Town and Country Planning (Development Management Procedure) (Wales) Order 2012 <noteRef href="#c23435191" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> but with the modifications described in paragraph (3).</p></content></paragraph><paragraph eId="article-11-3"><num>(3)</num><intro><p>The modifications are—</p></intro><level class="para1" eId="article-11-3-a"><num>(a)</num><content><p>any reference to the authority is to be read as a reference to the approving body;</p></content></level><level class="para1" eId="article-11-3-b"><num>(b)</num><content><p>any reference to service of the notice or copies of the notice is to be read as a reference to the giving of the notice;</p></content></level><level class="para1" eId="article-11-3-c"><num>(c)</num><content><p>any reference to a breach of planning control is to be read as a reference to a breach of the requirement for approval;</p></content></level><level class="para1" eId="article-11-3-d"><num>(d)</num><content><p>any reference to a breach of condition notice is to be read as a reference to a stop notice or temporary stop notice.</p></content></level></paragraph><paragraph eId="article-11-4"><num>(4)</num><content><p>The information must be entered on the register as soon as is practicable but not more than 2 weeks after a notice is given.</p></content></paragraph><paragraph eId="article-11-5"><num>(5)</num><content><p>An entry relating to a notice must be removed from the register if the notice is withdrawn or ceases to have effect.</p></content></paragraph></article></part><part eId="part-4"><num><b>PART 4</b></num><heading>Appeals against enforcement notices</heading><article eId="article-12"><heading>Right of appeal</heading><num>12.</num><paragraph eId="article-12-1"><num>(1)</num><content><p>A developer who is given an enforcement notice may by notice appeal to the Welsh Ministers against the decision to give it.</p></content></paragraph><paragraph eId="article-12-2"><num>(2)</num><intro><p>The grounds of appeal are that—</p></intro><level class="para1" eId="article-12-2-a"><num>(a)</num><content><p>the decision was based on an error of fact;</p></content></level><level class="para1" eId="article-12-2-b"><num>(b)</num><content><p>the decision was wrong in law;</p></content></level><level class="para1" eId="article-12-2-c"><num>(c)</num><content><p>the decision was unreasonable;</p></content></level><level class="para1" eId="article-12-2-d"><num>(d)</num><content><p>there is no breach of the requirement for approval.</p></content></level></paragraph><paragraph eId="article-12-3"><num>(3)</num><content><p>An enforcement notice is suspended until an appeal is determined or withdrawn.</p></content></paragraph></article><article eId="article-13"><heading>Time limit for making an appeal</heading><num>13.</num><content><p>An appeal must be made within the period of 4 weeks beginning with the day on which a developer is given an enforcement notice.</p></content></article><article eId="article-14"><heading>Making an appeal</heading><num>14.</num><paragraph eId="article-14-1"><num>(1)</num><intro><p>Notice of an appeal against an enforcement notice must—</p></intro><level class="para1" eId="article-14-1-a"><num>(a)</num><content><p>be in writing, on a form obtained from the Welsh Ministers,</p></content></level><level class="para1" eId="article-14-1-b"><num>(b)</num><content><p>state the grounds of appeal,</p></content></level><level class="para1" eId="article-14-1-c"><num>(c)</num><content><p>state the facts on which the appellant will rely in support of each of those grounds and any other particulars of the case the appellant intends to put forward in relation to the appeal, and</p></content></level><level class="para1" eId="article-14-1-d"><num>(d)</num><content><p>include the name, address (including any email address) and telephone number of the appellant and any agent acting for the appellant.</p></content></level></paragraph><paragraph eId="article-14-2"><num>(2)</num><intro><p>The notice must be sent to the Welsh Ministers accompanied by—</p></intro><level class="para1" eId="article-14-2-a"><num>(a)</num><content><p>a statement as to whether the appellant wishes to have the appeal dealt with by way of written representations, a hearing or an inquiry,</p></content></level><level class="para1" eId="article-14-2-b"><num>(b)</num><content><p>a copy of the enforcement notice, and</p></content></level><level class="para1" eId="article-14-2-c"><num>(c)</num><content><p>a copy of any related stop notice or temporary stop notice.</p></content></level></paragraph><paragraph eId="article-14-3"><num>(3)</num><content><p>A developer who sends a notice of appeal to the Welsh Ministers must, at the same time, send a copy of the notice of appeal and accompanying documents to the approving body.</p></content></paragraph><paragraph eId="article-14-4"><num>(4)</num><content><p>In this article,  “<term refersTo="#term-accompanying-documents" eId="term-accompanying-documents">accompanying documents</term>” means the documents mentioned in paragraph (2).</p></content></paragraph><paragraph eId="article-14-5"><num>(5)</num><content><p>Any notice or other document required in this article to be sent or provided, may be sent by post or electronic communication.</p></content></paragraph></article><article eId="article-15"><heading>Use of electronic communications</heading><num>15.</num><paragraph eId="article-15-1"><num>(1)</num><content><p>Paragraphs (2) to (6) of this article apply where an electronic communication is used by an appellant for the purpose of fulfilling any requirement in article 14.</p></content></paragraph><paragraph eId="article-15-2"><num>(2)</num><intro><p>The requirement is taken to be fulfilled where the notice or other document transmitted by means of the electronic communication is—</p></intro><level class="para1" eId="article-15-2-a"><num>(a)</num><content><p>capable of being accessed by the recipient,</p></content></level><level class="para1" eId="article-15-2-b"><num>(b)</num><content><p>legible in all material respects, and</p></content></level><level class="para1" eId="article-15-2-c"><num>(c)</num><content><p>sufficiently permanent to be used for subsequent reference.</p></content></level></paragraph><paragraph eId="article-15-3"><num>(3)</num><content><p>In paragraph (2)  “<term refersTo="#term-legible-in-all-material-respects" eId="term-legible-in-all-material-respects">legible in all material respects</term>” means that the information contained in the notice or other document is available to the recipient to no lesser extent than it would be if sent or given by means of a document in printed form.</p></content></paragraph><paragraph eId="article-15-4"><num>(4)</num><content><p>Where the electronic communication is received by the recipient outside the recipient's business hours, it will be taken to have been received on the next working day.</p></content></paragraph><paragraph eId="article-15-5"><num>(5)</num><content><p>A requirement in article 14 that any notice or other document should be in writing is fulfilled where that document meets the criteria in paragraph (2) and  “written” and cognate expressions are to be construed accordingly.</p></content></paragraph><paragraph eId="article-15-6"><num>(6)</num><intro><p>Where an appellant sends any notice or other document to the Welsh Ministers using electronic communications, they will be taken to have agreed—</p></intro><level class="para1" eId="article-15-6-a"><num>(a)</num><content><p>to the use of such communications for all purposes relating to the appeal which are capable of being carried out electronically;</p></content></level><level class="para1" eId="article-15-6-b"><num>(b)</num><content><p>that the appellant's address for the purpose of such communications is the address incorporated into or otherwise logically associated with, the notice or other document;</p></content></level><level class="para1" eId="article-15-6-c"><num>(c)</num><content><p>that the appellant's deemed agreement under this paragraph will subsist until the appellant gives notice in accordance with article 16, of a wish to revoke the agreement.</p></content></level></paragraph></article><article eId="article-16"><heading>Withdrawal of consent to the use of electronic communications</heading><num>16.</num><paragraph eId="article-16-1"><num>(1)</num><intro><p>Where an appellant is no longer willing to accept the use of electronic communications for any purpose of this Order which is capable of being effected electronically, the appellant must give notice in writing—</p></intro><level class="para1" eId="article-16-1-a"><num>(a)</num><content><p>withdrawing any address notified to the Welsh Ministers or to an approving body for that purpose, or</p></content></level><level class="para1" eId="article-16-1-b"><num>(b)</num><content><p>revoking any agreement entered into with the Welsh Ministers or with an approving body for that purpose.</p></content></level></paragraph><paragraph eId="article-16-2"><num>(2)</num><intro><p>Withdrawal or revocation under paragraph (1) is final and takes effect on the later of—</p></intro><level class="para1" eId="article-16-2-a"><num>(a)</num><content><p>the date specified by the appellant in the notice but that date must not be less than 1 week after the date on which the notice is given, or</p></content></level><level class="para1" eId="article-16-2-b"><num>(b)</num><content><p>the expiry of the period of 1 week beginning with the date on which the notice is given.</p></content></level></paragraph></article><article eId="article-17"><heading>Procedure for appeals</heading><num>17.</num><paragraph eId="article-17-1"><num>(1)</num><content><p>Paragraphs (2) to (4) of this article apply where the Welsh Ministers are in receipt of a valid notice of appeal.</p></content></paragraph><paragraph eId="article-17-2"><num>(2)</num><content><p>Section 319B (determination of procedure for certain proceedings: Wales) of the 1990 Act and the Town and Country Planning (Referred Applications and Appeals Procedure) (Wales) Regulations 2017 <noteRef href="#c23435201" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> (“<term refersTo="#term-the-2017-regulations" eId="term-the-2017-regulations">the 2017 Regulations</term>”) apply to an appeal under this Order with the modifications described in paragraph (3), as if it was an appeal brought under section 174 (appeal against enforcement notice) of the 1990 Act.</p></content></paragraph><paragraph eId="article-17-3"><num>(3)</num><intro><p>The modifications are—</p></intro><level class="para1" eId="article-17-3-a"><num>(a)</num><content><p>any reference to an  “<term refersTo="#term-appellant" eId="term-appellant">appellant</term>” has the meaning given in article 2;</p></content></level><level class="para1" eId="article-17-3-b"><num>(b)</num><content><p>any reference to an  “appeal” under section 174 of the 1990 Act is to be read as a reference to an appeal under this Order;</p></content></level><level class="para1" eId="article-17-3-c"><num>(c)</num><content><p>any reference to an  “<term refersTo="#term-appointed-person" eId="term-appointed-person">appointed person</term>” is a reference to a person appointed by the Welsh Ministers under this Order to report to the Welsh Ministers;</p></content></level><level class="para1" eId="article-17-3-d"><num>(d)</num><content><p>any reference to an  “enforcement appeal” is to be read as a reference to an appeal against an enforcement notice under this Order;</p></content></level><level class="para1" eId="article-17-3-e"><num>(e)</num><content><p>any reference to an  “enforcement notice” under section 172(1) of the 1990 Act is to be read as a reference to an enforcement notice under this Order;</p></content></level><level class="para1" eId="article-17-3-f"><num>(f)</num><content><p>a reference to  “full statement of case” is to be read as a reference to the statement in article 14(1)(c);</p></content></level><level class="para1" eId="article-17-3-g"><num>(g)</num><content><p>any reference to  “interested persons” is to be read as a reference to the statutory consultees specified in paragraph 11(3) of Schedule 3;</p></content></level><level class="para1" eId="article-17-3-h"><num>(h)</num><content><p>any reference to a  “local planning authority” is to be read as a reference to the approving body which gave an enforcement notice under this Order.</p></content></level></paragraph><paragraph eId="article-17-4"><num>(4)</num><intro><p>In this article  “<term refersTo="#term-valid-notice-of-appeal" eId="term-valid-notice-of-appeal">valid notice of appeal</term>” means a notice of appeal—</p></intro><level class="para1" eId="article-17-4-a"><num>(a)</num><content><p>which complies with the requirements of article 14(1),</p></content></level><level class="para1" eId="article-17-4-b"><num>(b)</num><intro><p>is sent to the Welsh Ministers—</p></intro><level class="para2" eId="article-17-4-b-i"><num>(i)</num><content><p>in accordance with article 14(2),</p></content></level><level class="para2" eId="article-17-4-b-ii"><num>(ii)</num><content><p>within the period specified in article 13, and</p></content></level></level><level class="para1" eId="article-17-4-c"><num>(c)</num><content><p>in relation to which the appellant certifies that a copy has been sent to the approving body in accordance with article 14(3).</p></content></level></paragraph></article><article eId="article-18"><heading>Determination of an appeal</heading><num>18.</num><paragraph eId="article-18-1"><num>(1)</num><content><p>An appeal under this Order is to be determined by the Welsh Ministers.</p></content></paragraph><paragraph eId="article-18-2"><num>(2)</num><content><p>For the purposes of paragraph (1), the Welsh Ministers may appoint a person (“<term refersTo="#term-the-appointed-person" eId="term-the-appointed-person">the appointed person</term>”) to report to the Welsh Ministers.</p></content></paragraph></article><article eId="article-19"><heading>Powers of the Welsh Ministers when determining an appeal</heading><num>19.</num><intro><p>When determining an appeal against an enforcement notice, the Welsh Ministers may—</p></intro><level class="para1" eId="article-19-a"><num>(a)</num><content><p>determine that the notice is to cease to have effect, or</p></content></level><level class="para1" eId="article-19-b"><num>(b)</num><content><p>confirm or vary the notice.</p></content></level></article><article eId="article-20"><heading>Evidence and costs</heading><num>20.</num><paragraph eId="article-20-1"><num>(1)</num><content><p>Subsections (2) and (3) of section 250 of the Local Government Act 1972 <noteRef href="#c23435211" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> (local inquiries: evidence and costs) apply with the modifications described in paragraph (2) to an inquiry under this Order as they apply to local inquiries under that section.</p></content></paragraph><paragraph eId="article-20-2"><num>(2)</num><intro><p>The modifications are—</p></intro><level class="para1" eId="article-20-2-a"><num>(a)</num><content><p>any reference to the person appointed to hold the inquiry is to be read as a reference to the person appointed by the Welsh Ministers under article 18(2);</p></content></level><level class="para1" eId="article-20-2-b"><num>(b)</num><content><p>any reference to a local authority is to be read as a reference to an approving body.</p></content></level></paragraph><paragraph eId="article-20-3"><num>(3)</num><content><p>Section 322C of the 1990 Act <noteRef href="#c23435221" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/> (costs: Wales) applies in relation to a hearing or inquiry under this Order as it applies in relation to a hearing or local inquiry referred to in that section.</p></content></paragraph><paragraph eId="article-20-4"><num>(4)</num><content><p>Subject to paragraph (3), the costs of a hearing or inquiry held under this Order must be defrayed by the Welsh Ministers.</p></content></paragraph></article></part><part eId="part-5"><num><b>PART 5</b></num><heading>Offences</heading><article eId="article-21"><heading>Offence of failure to comply with a notice</heading><num>21.</num><paragraph eId="article-21-1"><num>(1)</num><intro><p>A person who fails to comply with a temporary stop notice, enforcement notice or stop notice is guilty of an offence, and is liable—</p></intro><level class="para1" eId="article-21-1-a"><num>(a)</num><content><p>on summary conviction, to a fine <noteRef href="#key-a0d7423183723d99ea930a86927538d0" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>..., or</p></content></level><level class="para1" eId="article-21-1-b"><num>(b)</num><content><p>on conviction on indictment, to a fine.</p></content></level></paragraph><paragraph eId="article-21-2"><num>(2)</num><content><p>In determining the amount of the fine, the court must have regard in particular to any financial benefit which has accrued, or has appeared to accrue, to the person convicted in consequence of the offence.</p></content></paragraph></article><article eId="article-22"><heading>Offence of obstruction</heading><num>22.</num><intro><p>A person who wilfully obstructs an authorised person who is exercising powers of entry—</p></intro><level class="para1" eId="article-22-a"><num>(a)</num><content><p>is guilty of an offence, and</p></content></level><level class="para1" eId="article-22-b"><num>(b)</num><content><p>is liable, on summary conviction, to a fine not exceeding level 3 on the standard scale.</p></content></level></article><article eId="article-23"><heading>Offences by bodies corporate</heading><num>23.</num><paragraph eId="article-23-1"><num>(1)</num><intro><p>If an offence under this Order committed by a body corporate is proved—</p></intro><level class="para1" eId="article-23-1-a"><num>(a)</num><content><p>to have been committed with the consent or connivance of an officer, or</p></content></level><level class="para1" eId="article-23-1-b"><num>(b)</num><content><p>to be attributable to any neglect on the part of an officer—</p></content></level><wrapUp><p>the officer, as well as the body corporate, is guilty of the offence and liable to be proceeded against and punished accordingly.</p></wrapUp></paragraph><paragraph eId="article-23-2"><num>(2)</num><intro><p>In paragraph (1),  “<term refersTo="#term-officer" eId="term-officer">officer</term>” in relation to a body corporate, means—</p></intro><level class="para1" eId="article-23-2-a"><num>(a)</num><content><p>a director, manager, secretary or other similar officer of the body, or</p></content></level><level class="para1" eId="article-23-2-b"><num>(b)</num><content><p>a person purporting to act in any such capacity.</p></content></level></paragraph><paragraph eId="article-23-3"><num>(3)</num><content><p>If the affairs of a body corporate are managed by its members, paragraph (1) applies in relation to the acts and defaults of a member in connection with the member's functions of management as it applies to an officer of a body corporate.</p></content></paragraph></article><article eId="article-24"><heading>Offences by partnerships and unincorporated associations</heading><num>24.</num><paragraph eId="article-24-1"><num>(1)</num><content><p>Proceedings for an offence under this Order alleged to have been committed by a partnership or an unincorporated association must be brought against the partnership or association in the name of the partnership or association.</p></content></paragraph><paragraph eId="article-24-2"><num>(2)</num><intro><p>For the purposes of such proceedings—</p></intro><level class="para1" eId="article-24-2-a"><num>(a)</num><content><p>rules of court relating to the service of documents have effect as if the partnership or unincorporated association were a body corporate, and</p></content></level><level class="para1" eId="article-24-2-b"><num>(b)</num><intro><p>the following provisions apply as they apply in relation to a body corporate—</p></intro><level class="para2" eId="article-24-2-b-i"><num>(i)</num><content><p>section 33 of the Criminal Justice Act 1925 <noteRef href="#c23435231" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>;</p></content></level><level class="para2" eId="article-24-2-b-ii"><num>(ii)</num><content><p>Schedule 3 to the Magistrates' Courts Act 1980 <noteRef href="#c23435241" uk:name="commentary" ukl:Name="CommentaryRef" class="commentary"/>.</p></content></level></level></paragraph><paragraph eId="article-24-3"><num>(3)</num><content><p>A fine imposed on a partnership or unincorporated association on its conviction of an offence under this Order is to be paid out of the funds of the partnership or association.</p></content></paragraph><paragraph eId="article-24-4"><num>(4)</num><intro><p>If an offence under this Order committed by a partnership is proved—</p></intro><level class="para1" eId="article-24-4-a"><num>(a)</num><content><p>to have been committed with the consent or connivance of a partner, or</p></content></level><level class="para1" eId="article-24-4-b"><num>(b)</num><content><p>to be attributable to any neglect on the part of a partner—</p></content></level><wrapUp><p>the partner, as well as the partnership, is guilty of the offence and liable to be proceeded against and punished accordingly.</p></wrapUp></paragraph><paragraph eId="article-24-5"><num>(5)</num><content><p>In paragraph (4),  “<term refersTo="#term-partner" eId="term-partner">partner</term>” includes a person purporting to act as a partner.</p></content></paragraph><paragraph eId="article-24-6"><num>(6)</num><intro><p>If an offence under this Order committed by an unincorporated association (other than a partnership) is proved—</p></intro><level class="para1" eId="article-24-6-a"><num>(a)</num><content><p>to have been committed with the consent or connivance of an officer of the association, or</p></content></level><level class="para1" eId="article-24-6-b"><num>(b)</num><content><p>to be attributable to any neglect on the part of such an officer—</p></content></level><wrapUp><p>the officer, as well as the association, is guilty of the offence and liable to be proceeded against and punished accordingly.</p></wrapUp></paragraph><paragraph eId="article-24-7"><num>(7)</num><intro><p>In paragraph (6),  “<term refersTo="#term-officer" eId="term-officer">officer</term>” in relation to an unincorporated association, means—</p></intro><level class="para1" eId="article-24-7-a"><num>(a)</num><content><p>an officer of the association or a member of its governing body, or</p></content></level><level class="para1" eId="article-24-7-b"><num>(b)</num><content><p>a person purporting to act in such a capacity.</p></content></level></paragraph></article></part><hcontainer Minister for Environment under the authority of Cabinet Secretary for Energy, Planning and Rural Affairs, one of the Welsh Ministers</role></block><block name="date"><date date="2018-11-13"/></block></content></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><blockContainer ukl:Name="P"><p><i>(This note is not part of the Order)</i></p></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>This Order provides for the enforcement of breach of the approval required (“the requirement for approval”) under paragraph 7(1) of Schedule 3 to the Flood and Water Management Act 2010 (c. 29) (“<term refersTo="#term-the-act">the Act</term>”) in relation to drainage systems for construction work.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 3 provides that an approving body may agree with the local planning authority that that authority may exercise enforcement functions under this Order on behalf of the approving body.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 4 provides for powers of entry onto property of a person authorised by an approving body for the purpose of ascertaining whether there has been a breach of requirement for approval or whether a temporary stop notice, enforcement notice or stop notice has been complied with, including circumstances in which an application may be made to a court for a warrant.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 5 provides for the circumstances in which a developer or other person may recover compensation in relation to loss incurred as a result of the exercise of powers of entry pursuant to article 4.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 6 confers power on an approving body to give a temporary stop notice to a developer, where the body has reason to believe that a developer has breached the requirement for approval. The duration of such a notice is limited in accordance with that article.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 7 provides for the circumstances in which a developer may recover compensation in relation to loss incurred as a result of being given a temporary stop notice.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 8 confers power on an approving body, where a developer has breached the requirement for approval, to give a notice to the developer (an  “enforcement notice”), specifying the steps to be taken by the developer to remedy the breach.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 9 specifies the steps to be taken by a developer, that must be included in an enforcement notice in specified circumstances, and provides for the steps the approving body may take in the event of non-compliance with the notice.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 10 confers power on an approving body to give a developer a stop notice, in circumstances where the developer has appealed against an enforcement notice and the approving body thinks it expedient that the construction work to which the enforcement notice relates, should stop immediately. Article 10 also provides for the circumstances in which such a notice ceases to have effect.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 11 requires the approving body to maintain a register of all stop notices, temporary stop notices and enforcement notices that it gives, and prescribes the information to be entered in the register.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 12 provides for a developer to appeal to the Welsh Ministers against an enforcement notice on grounds specified in the article.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 13 prescribes the period within which an appeal must be made.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 14 prescribes the content of a notice of appeal, and the actions that must be taken to make an appeal.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Articles 15 and 16 provide respectively, for the use of electronic communications and withdrawal of consent to the use of electronic communications in relation to appeals.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 17 makes provision for section 319B of the Town and Country Planning Act 1990 (c. 8) (“<term refersTo="#term-the-1990-act">the 1990 Act</term>”) and the Town and Country Planning (Referred Applications and Appeals Procedure) (Wales) Regulations 2017 (S.I. 2017/544 (W. 121)) to apply, with appropriate modifications, to an appeal against an enforcement notice under this Order, as if it was an appeal against a planning enforcement notice.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 18 provides that the Welsh Ministers are to determine an appeal under this Order.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 19 provides for the powers of the Welsh Ministers in determining an appeal against an enforcement notice.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 20 provides for procedure in relation to evidence in a hearing or inquiry, by applying, subject to appropriate modifications, subsections (2) and (3) of section 250 of the Local Government Act 1972 (c. 70) (local inquiries: evidence and costs), and in relation to costs, by applying section 322C of the 1990 Act (costs: Wales).</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 21 provides for an offence of failure to comply with a temporary stop notice, enforcement notice or stop notice.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 22 provides for an offence of wilful obstruction of a person authorised by an approving body who is exercising powers of entry under Article 4.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 23 makes provision for liability of officers and members where an offence under this Order is committed by a body corporate.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>Article 24 makes provision for liability of partnerships and partners, where an offence under this Order is committed by a partnership, and for the liability of unincorporated associations and their officers, where such an offence is committed by an unincorporated association.</p></blockContainer></blockContainer><blockContainer ukl:Name="P"><blockContainer ukl:Name="BlockText"><p>A regulatory impact assessment in relation to Wales has been prepared on the likely costs and benefits of complying with this Order.
