The 2016 Regulations consolidated and updated earlier instruments which implemented Council Directive 85/337/EEC (“the 1985 Directive”) on the assessment of the effects of certain public and private projects on the environment  in relation to town and country planning in Wales.</dc:description><ukm:SecondaryMetadata><ukm:DocumentClassification><ukm:DocumentCategory Value="secondary"/><ukm:DocumentMainType Value="WelshStatutoryInstrument"/><ukm:DocumentStatus Value="revised"/><ukm:DocumentMinorType Value="regulation"/></ukm:DocumentClassification><ukm:Year Value="2017"/><ukm:Number Value="567"/><ukm:AlternativeNumber Category="W" Value="136"/><ukm:Made Date="2017-04-20"/><ukm:Laid Date="2017-04-24" Class="WelshAssembly"/><ukm:ComingIntoForce><ukm:DateTime Date="2017-05-16"/></ukm:ComingIntoForce><ukm:ISBN Value="9780348201130"/></ukm:SecondaryMetadata><ukm:Alternatives><ukm:Alternative URI="http://www.legislation.gov.uk/wsi/2017/567/pdfs/wsi_20170567_mi.pdf" Date="2017-07-04" Size="8362061" Language="Mixed"/></ukm:Alternatives><ukm:Statistics><ukm:TotalParagraphs Value="273"/><ukm:BodyParagraphs Value="66"/><ukm:ScheduleParagraphs Value="207"/><ukm:AttachmentParagraphs Value="0"/><ukm:TotalImages Value="0"/></ukm:Statistics></proprietary></meta><body eId="body"><part eId="part-5"><num><b>PART 5</b></num><heading>Publicity and Procedures on Submission of Environmental Statements</heading><hcontainer name="regulation" eId="regulation-21" uk:target="true"><heading>Procedure where an environmental statement is submitted to the Welsh Ministers</heading><num>21.</num><paragraph eId="regulation-21-1"><num>(1)</num><intro><p>This regulation applies where an applicant or appellant submits an environmental statement to the Welsh Ministers, in relation to an EIA application which is—</p></intro><level class="para1" eId="regulation-21-1-a"><num>(a)</num><content><p>before the Welsh Ministers  <ins class="first last" ukl:ChangeId="key-ae0efb5d822519340a7933bb4db43940-1767871269223" ukl:CommentaryRef="key-ae0efb5d822519340a7933bb4db43940"><noteRef uk:name="commentary" href="#key-ae0efb5d822519340a7933bb4db43940" class="commentary"/>, examining authority</ins> or an inspector for determination; or</p></content></level><level class="para1" eId="regulation-21-1-b"><num>(b)</num><content><p>the subject of an appeal to the Welsh Ministers.</p></content></level></paragraph><paragraph eId="regulation-21-2"><num>(2)</num><content><p>The applicant or appellant must submit the environmental statement in electronic and paper format to the Welsh Ministers and to the relevant planning authority, unless otherwise agreed in writing.</p></content></paragraph><paragraph eId="regulation-21-3"><num>(3)</num><intro><p>An applicant or appellant who submits an environmental statement to the Welsh Ministers may provide a copy of it to any other body, and if so must—</p></intro><level class="para1" eId="regulation-21-3-a"><num>(a)</num><content><p>comply with sub-paragraphs (a) and (b) of regulation 18(2) as if the reference in regulation 18(2)(b) to the relevant planning authority were a reference to the Welsh Ministers; and</p></content></level><level class="para1" eId="regulation-21-3-b"><num>(b)</num><content><p>inform the Welsh Ministers of the matters mentioned in regulation 18(2)(c).</p></content></level></paragraph><paragraph eId="regulation-21-4"><num>(4)</num><intro><p>The Welsh Ministers must comply with regulation 18(3) (except sub-paragraph (a) of that regulation) and the applicant or appellant must comply with regulation 18(4) as if—</p></intro><level class="para1" eId="regulation-21-4-a"><num>(a)</num><content><p>references in those provisions to the relevant planning authority were references to the Welsh Ministers; and,</p></content></level><level class="para1" eId="regulation-21-4-b"><num>(b)</num><content><p>in the case of an appeal, references to the applicant were references to the appellant,</p></content></level><wrapUp><p>and the Welsh Ministers or the inspector must comply with regulation 18(6) as if it referred to the Welsh Ministers or the inspector instead of the relevant planning authority.</p></wrapUp></paragraph></hcontainer></part></body></act></akomaNtoso>
