and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/1/b" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/1/b" id="regulation-13-1-b"><Pnumber>b</Pnumber><P3para><Text>the development in question—</Text><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/1/b/i" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/1/b/i" id="regulation-13-1-b-i"><Pnumber>i</Pnumber><P4para><Text>has not been the subject of a screening opinion or screening direction; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/1/b/ii" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/1/b/ii" id="regulation-13-1-b-ii"><Pnumber>ii</Pnumber><P4para><Text>in the case of a subsequent application, was the subject of a screening opinion or direction before planning permission was granted to the effect that it is not EIA development; and</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/1/c" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/1/c" id="regulation-13-1-c"><Pnumber>c</Pnumber><P3para><Text>the relevant application is not accompanied by a statement referred to by the appellant as an environmental statement for the purposes of these Regulations,</Text></P3para></P3><Text>paragraphs (3) to (9) of regulation 7 apply as if the appeal were a request made by the appellant pursuant to regulation 6(8).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/2" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/2" id="regulation-13-2"><Pnumber>2</Pnumber><P2para><Text>Where an inspector is dealing with an appeal and a question arises as to whether the relevant application is an EIA application and it appears to the inspector that it may be such an application, the inspector must refer that question to the Welsh Ministers and must not determine the appeal before a screening direction is made, except by refusing planning permission or subsequent consent.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/3" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/3" id="regulation-13-3"><Pnumber>3</Pnumber><P2para><Text>Paragraphs (3) to (9) of regulation 7 apply to a question referred under paragraph (2) as if the referral of that question were a request made by the appellant pursuant to regulation 6(8).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/4" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/4" id="regulation-13-4"><Pnumber>4</Pnumber><P2para><Text>Where regulation 7(3) applies by virtue of paragraph (1) or (3), the Welsh Ministers must, where necessary to ensure that the applicant has provided, in the case of—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/4/a" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/4/a" id="regulation-13-4-a"><Pnumber>a</Pnumber><P3para><Text>applications, the information referred to in regulation 6(2); and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/4/b" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/4/b" id="regulation-13-4-b"><Pnumber>b</Pnumber><P3para><Text>subsequent applications, the information referred to in regulation 6(3),</Text></P3para></P3><Text>make a request for additional information before issuing a screening direction and regulation 6(4) applies as if the referral of the application were a request made by the applicant under regulation 6(8).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/5" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/5" id="regulation-13-5"><Pnumber>5</Pnumber><P2para><Text>Where it appears to the Welsh Ministers that the relevant application is an EIA application and is not accompanied by a statement referred to by the appellant as an environmental statement for the purposes of these Regulations, they must notify the appellant that the submission of an environmental statement is required.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/6" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/6" id="regulation-13-6"><Pnumber>6</Pnumber><P2para><Text>Where the Welsh Ministers are aware that any particular person is or is likely to be affected by, or has an interest in, the application, who is unlikely to become aware of it by means of electronic publication, a site notice or by local advertisement, they must notify the appellant of any such person.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/7" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/7" id="regulation-13-7"><Pnumber>7</Pnumber><P2para><Text>An appellant who receives a notification under paragraph (5), may within 21 days beginning with the date of the notification, confirm to the Welsh Ministers that an environmental statement will be provided.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2017/567/regulation/13/8" IdURI="http://www.legislation.gov.uk/id/wsi/2017/567/regulation/13/8" id="regulation-13-8"><Pnumber>8</Pnumber><P2para><Text>If the appellant does not confirm in accordance with paragraph (7), the Welsh Ministers have or, where relevant, the inspector has, no duty to deal with the appeal;
