Section 40 was amended by section 118(1) of, and paragraph 27 of Schedule 6 to, the Planning and Compulsory Purchase Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/2004/5">2004 (c. 5)</ref>.</p></authorialNote> and now exercisable by them<authorialNote class="footnote" eId="f00002" marker="2"><p>The functions of the Secretary of State under those sections were, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2 of, and Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (<ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/1999/672">S.I. 1999/672</ref>). Section 323A was inserted by section 50 of the 2015 Act. Section 323A is applied to the Planning (Hazardous Substances) Act 1990 by section 37 of that Act. Section 37 was amended by section 51 of, and paragraphs 23 and 25 of Schedule 5 to, the 2015 Act.</p></authorialNote>.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Title, commencement, application and interpretation</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>The title of these Regulations is the Planning (Hazardous Substances) (Wales) (Amendment) Regulations 2017 and they come into force on 5 May 2017.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations apply in relation to Wales.</p></content></paragraph><paragraph eId="regulation-1-3"><num>(3)</num><content><p>In these Regulations, “the 2015 Regulations” (“<i>Rheoliadau 2015</i>”) means the Planning (Hazardous Substances) (Wales) Regulations 2015<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00012" href="http://www.legislation.gov.uk/id/wsi/2015/1597">S.I. 2015/1597 (W. 196)</ref> to which there are amendments not relevant to these Regulations.</p></authorialNote></p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendments to the 2015 Regulations</heading><num>2.</num><content><p>The 2015 Regulations are amended in accordance with the following provisions.</p></content></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Interpretation</heading><num>3.</num><content><p><mod>In regulation 2(1) at the appropriate place insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><hcontainer name="definition"><intro><p>“full statement of case” (“<i>datganiad achos llawn</i>”) means and is comprised of—</p></intro><level class="para1"><num>(a)</num><content><p>a statement in writing containing full particulars of the case—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>the applicant proposes to put forward in relation to the application referred to the Welsh Ministers pursuant to a direction under section 20 of the PHSA<authorialNote class="footnote" eId="f00006" marker="6"><p>Section 20 was amended by section 162 of, and paragraph 1 of Part 7 of Schedule 16 to, the EPA and article 3 of, and paragraphs 24 and 25 of Schedule 1 to, <ref eId="c00013" href="http://www.legislation.gov.uk/id/uksi/2014/2773">S.I. 2014/2773</ref>.</p></authorialNote>; or</p></item><item><num>(ii)</num><p>the appellant proposes to put forward in relation to the appeal under section 21 of the PHSA; and</p></item></blockList></content></level><level class="para1"><num>(b)</num><content><p>copies of any supporting documents the applicant or the appellant proposes to refer to or put forward in evidence;</p></content></level></hcontainer></quotedStructure><inline name="appendText">.</inline></mod></p></content></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Reference of applications to the Welsh Ministers</heading><num>4.</num><content><p><mod>For regulation 12 (notice of reference of applications to the Welsh Ministers) and its heading substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="wsi" ukl:TargetClass="secondary" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><article><heading>Reference of applications to the Welsh Ministers</heading><num>12.</num><paragraph><num>(1)</num><intro><p>On referring any application to the Welsh Ministers pursuant to a direction under section 20 of the PHSA, a hazardous substances authority must as soon as reasonably practicable—</p></intro><level class="para1"><num>(a)</num><content><p>serve on the applicant a notice of reference; and</p></content></level><level class="para1"><num>(b)</num><content><p>send to the Welsh Ministers a copy of the application file.</p></content></level></paragraph><paragraph><num>(2)</num><content><p>The hazardous substances authority must send a copy of the notice of reference to the Welsh Ministers at the same time as the notice is sent to the applicant.</p></content></paragraph><paragraph><num>(3)</num><content><p>An applicant upon whom a notice of reference is served may choose to submit a full statement of case to the Welsh Ministers.</p></content></paragraph><paragraph><num>(4)</num><intro><p>An applicant who so chooses must send—</p></intro><level class="para1"><num>(a)</num><content><p>the full statement of case so that it is received by the Welsh Ministers within 4 weeks beginning with the day on which the notice of reference is served;</p></content></level><level class="para1"><num>(b)</num><content><p>a copy of the full statement of case to the hazardous substances authority at the same time as it is sent to the Welsh Ministers.</p></content></level></paragraph><paragraph><num>(5)</num><intro><p>In this regulation—</p></intro><level class="para1"><num>(a)</num><content><p>“application file” (“<i>ffeil y cais</i>”) means the application together with accompanying documents and all correspondence with the hazardous substances authority relating to the application; and</p></content></level><level class="para1"><num>(b)</num><intro><p>“notice of reference” (“<i>hysbysiad o gyfeirio</i>”) means a notice—</p></intro><level class="para2"><num>(i)</num><content><p>informing the applicant that the application has been referred to the Welsh Ministers;</p></content></level><level class="para2"><num>(ii)</num><content><p>setting out the reasons given by the Welsh Ministers for issuing the direction; and</p></content></level><level class="para2"><num>(iii)</num><intro><p>notifying the applicant that—</p></intro><level class="para3"><num>(aa)</num><content><p>if the applicant so chooses, the applicant may submit a full statement of case to the Welsh Ministers;</p></content></level><level class="para3"><num>(bb)</num><content><p>if the applicant so chooses, the full statement of case must be received by the Welsh Ministers within 4 weeks beginning with the day on which the notice of reference is served; and</p></content></level><level class="para3"><num>(cc)</num><content><p>a copy of the full statement of case (if applicable) must be sent to the hazardous substances authority at the same time as it is sent to the Welsh Ministers.</p></content></level></level></level></paragraph></article></quotedStructure></mod></p></content></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Appeals</heading><num>5.</num><paragraph eId="regulation-5-1"><num>(1)</num><intro><p>In regulation 13(3)—</p></intro><level class="para1" eId="regulation-5-1-a"><num>(a)</num><content><p>in subparagraph (c) omit “and”;</p></content></level><level class="para1" eId="regulation-5-1-b"><num>(b)</num><content><p>at the end of subparagraph (d) for the full stop substitute “; and”;</p></content></level><level class="para1" eId="regulation-5-1-c"><num>(c)</num><content><p><mod>after subparagraph (d) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(e)</num><content><p>a full statement of case</p></content></level></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></paragraph><paragraph eId="regulation-5-2"><num>(2)</num><content><p>In regulation 13(6) for “completed notice of appeal form and accompanying certificate” substitute “completed notice of appeal form, accompanying certificate and full statement of case”.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-6"><heading>Variation of applications after notice of appeal</heading><num>6.</num><content><p><mod>After regulation 13, insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="wsi" ukl:TargetClass="secondary" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><article><heading>Variation of applications after notice of appeal</heading><num>13A.</num><paragraph><num>(1)</num><content><p>For the purposes of section 21(3E) of the PHSA<authorialNote class="footnote" eId="f00007" marker="7"><p>Section 21(3E) was inserted by section 47(4) of the 2015 Act.</p></authorialNote> the prescribed circumstance is the application to which the appeal relates contains a correctable error.</p></content></paragraph><paragraph><num>(2)</num><content><p>An application which is varied in the circumstance prescribed in paragraph (1) is subject to such further consultation as the Welsh Ministers consider appropriate.</p></content></paragraph><paragraph><num>(3)</num><intro><p>In this regulation “correctable error” (“<i>gwall cywiradwy</i>”) means an error which—</p></intro><level class="para1"><num>(a)</num><content><p>is corrected in order to ensure consistency in the information contained in the application and the accompanying documents; and</p></content></level><level class="para1"><num>(b)</num><content><p>does not alter the substance of the application.</p></content></level></paragraph></article></quotedStructure></mod></p></content></hcontainer><hcontainer name="regulation" eId="regulation-7"><heading>Appeals against hazardous substances contravention notices</heading><num>7.</num><paragraph eId="regulation-7-1"><num>(1)</num><content><p>Regulation 17(1) (appeals: supplementary) is omitted.</p></content></paragraph><paragraph eId="regulation-7-2"><num>(2)</num><intro><p>Paragraph 2 of Part 1 of Schedule 4 (appeals against hazardous substances contravention notices) is amended as follows—</p></intro><level class="para1" eId="regulation-7-2-a"><num>(a)</num><content><p><mod>for subparagraph (b) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(b)</num><content><p><mod>for subsection (4) there were substituted—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(4)</num><content><p>A notice under subsection (3) must be accompanied by a copy of the hazardous substances contravention notice.</p></content></paragraph><paragraph><num>(4A)</num><intro><p>A person who gives notice under subsection (3) must submit to the Welsh Ministers a full statement of case either—</p></intro><level class="para1"><num>(a)</num><content><p>when giving the notice, or</p></content></level><level class="para1"><num>(b)</num><content><p>so that it is received by the Welsh Ministers before the end of the period specified in subsection (4B).</p></content></level></paragraph><paragraph><num>(4B)</num><intro><p>The period specified in this subsection is—</p></intro><level class="para1"><num>(a)</num><content><p>7 days beginning with the day on which the notice of appeal under subsection (3) is received by the Welsh Ministers; or</p></content></level><level class="para1"><num>(b)</num><content><p>such longer period as the Welsh Ministers may allow provided that any such longer period is authorised in writing by them before the date stated in the hazardous substances contravention notice as the date on which it is to take effect.</p></content></level></paragraph><paragraph><num>(4C)</num><content><p>The appellant must send to the hazardous substances authority that issued the notice, as soon as reasonably practicable, a copy of the notice of appeal and the full statement of case.</p></content></paragraph></quotedStructure></mod></p></content></level></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-7-2-b"><num>(b)</num><content><p><mod>after subparagraph (c) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(d)</num><content><p><mod>subsection (6) read as follows—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(6)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><intro><p>“full statement of case” means and is comprised of—</p></intro><level class="para1"><num>(a)</num><content><p>a statement in writing specifying the grounds of the appeal, stating the facts on which the appeal is based and containing full particulars of the case the appellant proposes to put forward in relation to the appeal; and</p></content></level><level class="para1"><num>(b)</num><content><p>copies of any supporting documents the appellant proposes to refer to or put forward in evidence;</p></content></level></hcontainer><hcontainer name="definition"><intro><p>“relevant occupier” means a person who—</p></intro><level class="para1"><num>(a)</num><content><p>on the date on which the hazardous substances contravention notice is issued occupies the land to which the notice relates by virtue of a licence; and</p></content></level><level class="para1"><num>(b)</num><content><p>continues so to occupy the land when the appeal is brought.</p></content></level></hcontainer></paragraph></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></quotedStructure></mod></p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-8"><heading>Transitional and saving provisions</heading><num>8.</num><paragraph eId="regulation-8-1"><num>(1)</num><intro><p>Paragraph <ref href="#regulation-8-2">(2)</ref> applies where any of the following occurs in relation to an application made before these Regulations come into force—</p></intro><level class="para1" eId="regulation-8-1-a"><num>(a)</num><content><p>the application is referred to the Welsh Ministers pursuant to a direction under section 20 of the Planning (Hazardous Substances) Act 1990, or</p></content></level><level class="para1" eId="regulation-8-1-b"><num>(b)</num><content><p>an appeal is made.</p></content></level></paragraph><paragraph eId="regulation-8-2"><num>(2)</num><content><p>The 2015 Regulations apply to that application or appeal as though the amendments made by regulations <ref href="#regulation-3">3</ref> to <ref href="#regulation-6">6</ref> had not been made.</p></content></paragraph><paragraph eId="regulation-8-3"><num>(3)</num><content><p>Where an appeal is made in relation to a hazardous substances contravention notice which was issued before these Regulations come into force, the 2015 Regulations apply to that appeal as though the amendments made by regulation <ref href="#regulation-7">7</ref> had not been made.</p></content></paragraph></hcontainer><hcontainer name="signatures"><hcontainer name="signatureBlock"><content><block name="signature"><signature refersTo="#">Jane Hutt</signature></block><block name="role"><role refersTo="#">One of the Welsh Ministers</role></block><block name="date"><date date="2017-04-05">5 April 2017</date></block></content></hcontainer></hcontainer></body><conclusions><blockContainer class="explanatoryNote"><heading>EXPLANATORY NOTE</heading><subheading>(This note is not part of the Regulations)</subheading><blockContainer ukl:Name="P"><p>These Regulations amend the Planning (Hazardous Substances) (Wales) Regulations 2015 (“the 2015 Regulations”).</p></blockContainer><blockContainer ukl:Name="P"><p>The main changes are—</p><blockContainer ukl:Name="P2" class="prov2"><num>(1)</num><p>amendments to the procedure in relation to applications referred to the Welsh Ministers pursuant to a direction under section 20 of the Planning (Hazardous Substances) Act 1990 (“the PHSA”), including provision for an applicant to submit a full statement of case within a specified timescale if the applicant so chooses (regulation <ref href="#regulation-4">4</ref> which substitutes regulation 12 of the 2015 Regulations);</p></blockContainer><blockContainer ukl:Name="P2" class="prov2"><num>(2)</num><p>amendments to the procedure in relation to appeals under section 21 of the PHSA to require—</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>a notice of appeal to be accompanied by a full statement of case; and</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>the appellant to send a copy of the full statement of case to the hazardous substances authority (regulation <ref href="#regulation-5">5</ref> which amends regulation 13 of the 2015 Regulations);</p></blockContainer></blockContainer><blockContainer ukl:Name="P2" class="prov2"><num>(3)</num><p>provision under section 21(3E) and (3F) of the PHSA (which were inserted by section 47(4) of the Planning (Wales) Act 2015) to—</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>prescribe a circumstance under section 21(3E) in which an application may be varied once notice of appeal has been served; and</p></blockContainer><blockContainer ukl:Name="P3" class="para1"><num>(b)</num><p>provide for an application which is so varied to be subject to such further consultation as the Welsh Ministers consider appropriate (regulation <ref href="#regulation-6">6</ref> which inserts regulation 13A into the 2015 Regulations);</p></blockContainer></blockContainer><blockContainer ukl:Name="P2" class="prov2"><num>(4)</num><p>amendments to the procedure for appeals against hazardous substances contravention notices to require—</p><blockContainer ukl:Name="P3" class="para1"><num>(a)</num><p>a full statement of case to be sent to the Welsh Ministers within a specified period;
