<P2para><Text>It is an offence for a service provider to fail to comply with a requirement of any of the provisions specified in paragraph (2)<FootnoteRef Ref="f00026"/>.</Text>

<Text>The provisions specified for the purposes of paragraph (1) are the provisions of regulations 7(3), 7(5), 11(3), 12(1), 12(2), 19(1), 19(2), 19(3), 20(1), 35(1), 38(1), 59(1), 59(2), 59(3), 60(1), 60(2), 60(4), 61(3) and 62(3).</Text>

<Text>A service provider commits an offence if the provider fails to comply with a requirement of any of the provisions specified in paragraph (4) and such failure results in—</Text>

<Text>avoidable harm (whether of a physical or psychological nature) to an individual,</Text>

<Text>an individual being exposed to a significant risk of such harm occurring, or</Text>
