8.—(1) Mae’r erthygl hon yn gymwys pan fo person, yn union cyn y dyddiad trosglwyddo, yn darparu gwasanaeth gwarchod plant o dan amgylchiadau a fyddai, pe bai’n cael ei ddarparu ar y dyddiad hwnnw neu ar ôl y dyddiad hwnnw, yn groes i amodau cofrestru’r person hwnnw a osodwyd o dan adran 29 o’r Mesur oherwydd effaith erthygl 7(1) o’r Gorchymyn hwn.
(2) Pan fo person y mae paragraff (1) yn gymwys iddo yn cyflwyno cais i Weinidogion Cymru i amrywio amodau cofrestru cyn y dyddiad trosglwyddo, rhaid i Weinidogion Cymru benderfynu ar y cais hwnnw o fewn cyfnod o bum mis i’r dyddiad trosglwyddo.
(3) Yn ystod y cyfnod a bennir ym mharagraff (2)—
(a)nid yw person sydd wedi cyflwyno cais i amrywio amodau cofrestru yn agored i’w erlyn o dan adran 29(4) o’r Mesur pan fo’r amodau wedi eu torri o ganlyniad i effaith erthygl 7(1) o’r Gorchymyn hwn;
(b)nid yw adran 31(2)(b) o’r Mesur yn gymwys pan fo’r amodau wedi eu torri o ganlyniad i effaith erthygl 7(1) o’r Gorchymyn hwn.
