<Text>After article 15 of the 2010 Order insert—</Text>

<P2para><Text>A person does not provide child minding or day care if and to the extent that—</Text><P3>
<Pnumber>a</Pnumber>
<P3para><Text>the person solely provides a youth service for young persons who have attained the age of eleven; and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para><Text>any care provided is incidental to the provision of that youth service.</Text>
</P3para>
</P3>
</P2para>
</P2>
</P1para>
</P1>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>In this article “youth service” (“<Emphasis>gwasanaeth ieuectid</Emphasis>”)<Emphasis> means</Emphasis> an activity of a type listed in paragraph (3).</Text>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>For the purposes of paragraph (2), the type of activity are those—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>that encourage, enable or assist young persons who have attained the age of 11 to participate effectively in:</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para>
<Text>leisure and recreational activities;</Text>
</P4para></P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>education and training;</Text>
</P4para></P4>
<P4>
<Pnumber>iii</Pnumber>
<P4para>
<Text>the life of their communities; and</Text>

<P><Text Hanging="indented">Part 2 of the Children and Families (Wales) Measure 2010 enables the Welsh Ministers to specify by Order, exceptions to what constitutes “child minding” and “day care for children”.</Text></P>
<P><Text Hanging="indented">This Order is made under section 19(4) and (5) of the Measure. It amends the Child Minding and Day Care Exceptions (Wales) Order 2010 (“the 2010 Order”) to extend the circumstances in which a person whose activity would otherwise fall within the definition of “child minding” or “day care for children” is excepted from it and who is not therefore required to register.</Text></P>
<P><Text Hanging="indented">Articles 3 and 4 of this Order make consequential amendments to articles 2 and 8 of the 2010 Order.</Text></P>
<P><Text Hanging="indented">Article 5 of this Order excludes youth service provision for young persons who have attained the age of eleven from the requirement to register.</Text></P>
<P><Text Hanging="indented">The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with this Order. A copy can be obtained from the Education and Public Services Group, Welsh Government, Cathays Park, Cardiff CF10 3NQ.</Text></P>
