SCHEDULE 2Control of works affecting scheduled monuments

Regulation 42

(1)

The 2016 Order applies with the following modifications.

Article 15 (acceptance of applications) is to be read as if in the case of a consent under F1section 13 of the Historic Environment (Wales) Act 2023 (authorisation of works by scheduled monument consent), the application is accompanied by—

(a)

one or more of the F2declarations listed in section 15(1) of the Historic Environment (Wales) Act 2023 signed by or on behalf of the applicant; and

F3(b)

the items listed or referred to in F4regulation 2 of the Applications for Scheduled Monument Consent (Wales) Regulations 2024.

(1)

The provisions of these Regulations apply in relation to the grant of consent under F5section 13(1) of the Historic Environment (Wales) Act 2023 subject to the following modification.

In regulation 2 the definition of “appointed person” is read as “means the person appointed by the Welsh Ministers under F6section 17(2)(b) of the Historic Environment (Wales) Act 2023.
