The functions of the Secretary of State under these sections were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (<ref eId="c00002" href="http://www.legislation.gov.uk/id/uksi/1999/672">S.I. 1999/672</ref>) and are now exercisable by the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/2006/32">2006 (c. 32)</ref>.</p></authorialNote>, and in exercise of the powers conferred on the National Assembly for Wales by sections 77(2) and (9), 150 and 152 of the Learning and Skills Act 2000<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00004" href="http://www.legislation.gov.uk/id/ukpga/2000/21">2000 c. 21</ref>. The functions of the National Assembly for Wales under these sections were transferred to the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006.</p></authorialNote>, and now exercisable by them make the following Regulations:</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Title, commencement and application</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>The title of these Regulations is the Education (Amendments Relating to the Intervals for Inspection of Education and Training) (Wales) Regulations 2016 and they come into force on 1 September 2016.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations apply in relation to Wales.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment to the Inspection of Education and Training (Wales) Regulations 2001</heading><num>2.</num><content><p><mod>In regulation 2 of the Inspection of Education and Training (Wales) Regulations 2001<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/wsi/2001/2501">S.I. 2001/2501 (W. 204)</ref> as amended by the Inspection of Education and Training (Amendment) (Wales) Regulations 2004 (<ref eId="c00007" href="http://www.legislation.gov.uk/id/wsi/2004/783">S.I. 2004/783 (W. 80)</ref>), the National Council for Education and Training for Wales (Transfer of Functions to the National Assembly for Wales and Abolition) Order 2005 (<ref eId="c00008" href="http://www.legislation.gov.uk/id/wsi/2005/3238">S.I. 2005/3238 (W. 243)</ref>), the Education (Amendments Relating to the Intervals for the Inspection of Education and Training) (Wales) Regulations 2010 (<ref eId="c00009" href="http://www.legislation.gov.uk/id/wsi/2010/1436">S.I. 2010/1436 (W. 127)</ref>) and the Education (Amendments Relating to the Inspection of Education and Training) (Wales) Regulations 2014 (<ref eId="c00010" href="http://www.legislation.gov.uk/id/wsi/2014/1212">S.I. 2014/1212 (W. 128)</ref>).</p></authorialNote>, for paragraph (1)(b) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(b)</num><content><p>in all other cases, at least once within a seven year period beginning on 1 September 2016 and ending on 31<span ukl:Name="NonBreakingSpace"> </span>August 2023 and at least once within every subsequent six year period beginning on the expiry of the previous period.</p></content></level></quotedStructure></mod></p></content></hcontainer><hcontainer name="regulation" eId="regulation-3"><heading>Amendments to the Education (School Inspection) (Wales) Regulations 2006</heading><num>3.</num><intro><p>The Education (School Inspection) (Wales) Regulations 2006<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00011" href="http://www.legislation.gov.uk/id/wsi/2006/1714">S.I. 2006/1714 (W. 176)</ref> as amended by the Education (Amendments Relating to the Intervals for the Inspection of Education and Training) (Wales) Regulations 2010 (<ref eId="c00012" href="http://www.legislation.gov.uk/id/wsi/2010/1436">S.I. 2010/1436 (W. 127)</ref>) and the Education (Amendments Relating to the Inspection of Education and Training) (Wales) Regulations 2014 (<ref eId="c00013" href="http://www.legislation.gov.uk/id/wsi/2014/1212">S.I. 2014/1212 (W. 128)</ref>).</p></authorialNote> are amended as follows—</p></intro><level class="para1" eId="regulation-3-a"><num>(a)</num><content><p><mod>in regulation 6, for paragraph (1)(b), substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(b)</num><content><p>in all other cases, at least once within a seven year period beginning on 1 September 2016 and ending on 31 August 2023 and at least once within every subsequent six year period beginning on the expiry of the previous period.</p></content></level></quotedStructure><inline name="appendText">; and</inline></mod></p></content></level><level class="para1" eId="regulation-3-b"><num>(b)</num><content><p><mod>in regulation 14, for paragraph (b) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(b)</num><content><p>in all other cases, at least once within a seven year period beginning on 1 September 2016 and ending on 31 August 2023 and at least once within every subsequent six year period beginning on the expiry of the previous period.</p></content></level></quotedStructure></mod></p></content></level></hcontainer><hcontainer name="regulation" eId="regulation-4"><heading>Amendment to the Inspection of the Careers and Related Services (Wales) Regulations 2006</heading><num>4.</num><content><p><mod>In regulation 4 of the Inspection of the Careers and Related Services (Wales) Regulations 2006<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00014" href="http://www.legislation.gov.uk/id/wsi/2006/3103">S.I. 2006/3103 (W. 286)</ref> as amended by the Education (Amendments Relating to the Intervals for the Inspection of Education and Training) (Wales) Regulations 2010 (<ref eId="c00015" href="http://www.legislation.gov.uk/id/wsi/2010/1436">S.I. 2010/1436 (W. 127)</ref>) and the Education (Amendments Relating to the Inspection of Education and Training) (Wales) Regulations 2014 (<ref eId="c00016" href="http://www.legislation.gov.uk/id/wsi/2014/1212">S.I. 2014/1212 (W. 128)</ref>).</p></authorialNote>, for paragraph (1) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(1)</num><content><p>Save where regulation 3 applies, the Chief Inspector must inspect each service provider under section 55 of the 2005 Act and each relevant provider under section 56 of the 2005 Act at least once within a seven year period beginning on 1 September 2016 and ending on 31 August 2023 and at least once within every subsequent six year period beginning on the expiry of the previous period.</p></content></paragraph></quotedStructure></mod></p></content></hcontainer><hcontainer name="regulation" eId="regulation-5"><heading>Amendment to the Education (Inspection of Nursery Education) (Wales) Regulations 2015</heading><num>5.</num><intro><p>The Education (Inspection of Nursery Education) (Wales) Regulations 2015<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00017" href="http://www.legislation.gov.uk/id/wsi/2015/1599">S.I. 2015/1599 (W. 198)</ref>.</p></authorialNote> are amended as follows—</p></intro><level class="para1" eId="regulation-5-a"><num>(a)</num><content><p><mod>in regulation 3, for paragraph (2)(f) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><level class="para1"><num>(f)</num><content><p>in the case of nursery education provided by a person registered by the Welsh Ministers under sections 20 or 22 of the Children and Families (Wales) Measure 2010<authorialNote class="footnote" eId="f00008" marker="8"><p><ref eId="c00018" href="http://www.legislation.gov.uk/id/mwa/2010/1">2010 nawm 1</ref>.</p></authorialNote>, that person and the Welsh Ministers</p></content></level></quotedStructure><inline name="appendText">; Regulation 3(2)(f) of the <abbr title="Education (Inspection of Nursery Regulations) (Wales) Regulations 2015 (S.I. 2015/1599 (W. 198))">2015 Regulations</abbr> refers to the local authorities registration functions in sections 20 and 22 of the Children and Families (Wales) Measure 2010 (“the <abbr title="Children and Families (Wales) Measure 2010 nawm 1">2010 Measure</abbr>”). Regulation 4 of these Regulations amends that reference so that it refers to the Welsh Ministers registration functions in sections 20 or 22 of the <abbr title="Children and Families (Wales) Measure 2010 nawm 1">2010 Measure</abbr>.</p></blockContainer><blockContainer ukl:Name="P"><p>The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations.
