They can do this only if the use is in accordance with planning permission. It makes provision in relation to Wales which corresponds to section 194(1) of, and Schedule 9 to, the Planning Act 2008 (“the 2008 Act”). 4 In paragraph 5(1A) of Schedule 10 to the Housing Act 1988 after “in England” insert “or Wales”. 1988 c. 50; sub-paragraph 5(1A) of Schedule 10 was inserted by section 194(1) of, and paragraph 3 of Schedule 9 to, the Planning Act 2008.
