Mae Gweinidogion Cymru, drwy arfer y pwerau a roddwyd i’r Ysgrifennydd Gwladol gan adrannau 1, 16(9), 17(1) a (6), 47(1), (2) a (5), 49(5), 50(1), (4) a (6), 51(1) a (2), 51A(2), (3) a (6) o Ddeddf Adeiladu 19841, a pharagraffau 2, 4, 4A a 10 o Atodlen 1 iddi, sydd bellach yn arferadwy ganddynt hwy2, yn gwneud y Rheoliadau a ganlyn:

Enw’r Rheoliadau hyn yw Rheoliadau Adeiladu (Arolygwyr Cymeradwy etc.) (Diwygio) (Cymru) 2014.

Mae’r Rheoliadau hyn yn gymwys o ran Cymru ond nid ydynt yn gymwys o ran adeiladau ynni a eithrir yng Nghymru.

Yn y rheoliad hwn mae i “adeilad ynni a eithrir” yr ystyr a roddir i “excepted energy building” yn yr Atodlen i Orchymyn Gweinidogion Cymru (Trosglwyddo Swyddogaethau) (Rhif 2) 20093.

Diwygio Rheoliadau Adeiladu (Arolygwyr Cymeradwy etc.) 20102

Mae Rheoliadau Adeiladu (Arolygwyr Cymeradwy etc.) 20104 (“Rheoliadau 2010”) wedi eu diwygio fel a nodir yn rheoliadau 3 i 9.

Yswiriant arolygydd cymeradwy (rheoliad 5A newydd)3

Ar ôl rheoliad 5, mewnosoder—

Subject to paragraph (2), an approved inspector who gives a notice or certificate specified in paragraph (2) to a local authority must ensure that, before or on the date of the notice or certificate, the person who approved that inspector (the Welsh Ministers or a body designated under regulation 3 as the case may be) is in possession of a declaration of insurance in respect of the work to which the notice or certificate relates.

Paragraph (1) applies to a notice or certificate given on or after 10 February 2014 which is—

a

an initial notice;

b

an amendment notice;

c

a plans certificate;

d

a combined initial notice and plans certificate; or

e

a final certificate.

In this regulation a “declaration of insurance” means a declaration of insurance signed by the insurer that a named scheme of insurance approved by the Welsh Ministers applies to the approved inspector in relation to the building work to which the notice or certificate relates.

Rhestrau o gymeradwyaethau a dynodiadau4

Yn lle rheoliad 7 rhodder—

The Welsh Ministers shall—

a

maintain a list of bodies which are for the time being designated in accordance with regulation 3 for the purpose of approving inspectors;

b

maintain a list of inspectors for the time being approved by the Welsh Ministers; and

c

in respect of each approved inspector listed, keep a copy of—

i

the approval certificate, and

ii

the declaration of insurance referred to in regulation 5A.

The Welsh Ministers shall—

a

supply to every local authority in whose area these Regulations apply a copy of the first lists of approved inspectors and designated bodies prepared under paragraph (1); and

b

notify every such local authority as soon as practicable of the withdrawal of any approval or designation and of any addition to the lists.

A designated body shall—

a

maintain a list of inspectors for the time being approved by it;

b

in respect of each approved inspector listed, keep a copy of—

i

the approval certificate, and

ii

the declaration of insurance referred to in regulation 5A; and

c

notify every local authority in whose area these Regulations apply as soon as practicable after withdrawing approval from any inspector.

Lists maintained under this regulation shall set out any limitation placed on the approval or designation of the persons or bodies listed and shall indicate the date on which each approval will expire.

Mae’r Rheoliadau hyn yn diwygio Rheoliadau Adeiladu (Arolygwyr Cymeradwy etc.) 2010 (“Rheoliadau 2010”). Roedd Rheoliadau 2010 yn ei gwneud yn ofynnol i arolygwyr a gymeradwyir gan gorff a ddynodwyd gan Weinidogion Cymru gyflwyno copi o’r hysbysiad cymeradwyo ynghyd â hysbysiadau a thystysgrifau penodol a bennir yn Atodlen 1 i Reoliadau 2010. Roedd yn ofynnol hefyd i’r arolygwyr gynnwys, ynghyd â hysbysiadau a thystysgrifau penodol, ddatganiad a lofnodwyd gan yr yswiriwr i’r perwyl bod cynllun yswiriant a enwyd a gymeradwywyd gan Weinidogion Cymru yn gymwys i’r gwaith y mae hysbysiad neu dystysgrif yn ymwneud â hwy. Mae’r Rheoliadau hyn yn dileu’r gofynion hynny ac yn rhoi yn eu lle ofyniad bod yr hysbysiadau a’r tystysgrifau perthnasol yn datgan bod copïau o’r hysbysiad cymeradwyo a’r datganiad yswiriant ar y gofrestr a gedwir gan y corff dynodedig.

Y corff a ddynodir ar hyn o bryd o dan reoliad 3 o Reoliadau 2010 yw Cyngor y Diwydiant Adeiladu.

Mae rheoliad 3 yn ychwanegu rheoliad 5A newydd i Reoliadau 2010, gan ei gwneud yn ofynnol i arolygwr cymeradwy sy’n rhoi hysbysiadau a thystysgrifau penodol i awdurdod lleol sicrhau bod gan y corff dynodedig (neu Weinidogion Cymru os cawsant eu cymeradwyo gan Weinidogion Cymru) gopi o’r datganiad yswiriant mewn cysylltiad â’r gwaith y mae’r hysbysiad neu’r dystysgrif yn ymwneud ag ef.

Mae rheoliad 7 o Reoliadau 2010 yn ei gwneud yn ofynnol i’r corff dynodedig (neu Weinidogion Cymru) gynnal rhestr o arolygwyr a gymeradwyir gan y corff hwnnw. Mae rheoliad 4 o’r Rheoliadau hyn yn ychwanegu gofyniad bod yn rhaid i’r corff dynodedig (neu Weinidogion Cymru) gadw’r dystysgrif gymeradwyo a’r datganiad yswiriant y cyfeirir atynt yn y rheoliad 5A newydd.

Mae rheoliad 5 yn dileu’r gofyniad yn rheoliad 30 o Reoliadau 2010 i awdurdod lleol gadw enw a chyfeiriad yr yswiriwr a lofnododd y datganiad yswiriant mewn cysylltiad â’r gwaith y mae hysbysiad neu dystysgrif yn ymwneud ag ef ar ei gofrestr o hysbysiadau a thystysgrifau.

Mae rheoliad 6 yn gwneud diwygiadau canlyniadol i’r ffurflenni perthnasol a bennir yn Atodlen 1 i Reoliadau 2010. Y ffurflenni hyn yw Ffurflen 1 (hysbysiad cychwynnol), Ffurflen 2 (hysbysiad diwygio), Ffurflen 3 (tystysgrif planiau), Ffurflen 4 (hysbysiad cychwynnol a thystysgrif planiau cyfunol) a Ffurflen 5 (tystysgrif derfynol).

Mae rheoliadau 7 i 9 yn gwneud diwygiadau cyfatebol yn Atodlenni 2, 3 a 4 o Reoliadau 2010 i’r seiliau dros wrthod hysbysiad neu dystysgrif gan yr awdurdod lleol.
