The Welsh Ministers, in exercise of the powers conferred by paragraphs 1 and 9 of Schedule 12 to the Commonhold and Leasehold Reform Act 2002(1), make the following Regulations.

Title, commencement and application

1.—(1) The title of these Regulations is the Leasehold Valuation Tribunals (Fees) (Wales) (Amendment) Regulations 2014 and they come into force on 10 March 2014.

(2) These Regulations apply in relation to Wales.

Amendment of the Leasehold Valuation Tribunals (Fees) (Wales) Regulations 2004

2.—(1) The English text of the Leasehold Valuation Tribunals (Fees) (Wales) Regulations 2004(2) is amended in accordance with paragraph (2).

(2) In regulation 8(1) (waiver and reduction of fees)—

(a)at the end of sub-paragraph (e), delete “or”;

(b)remove the full stop at the end of sub-paragraph (f); and

(c)after sub-paragraph (f) insert—

; or

(g)universal credit.

(3) The Welsh text of the Leasehold Valuation Tribunals (Fees) (Wales) Regulations 2004 is amended in accordance with paragraph (4).

(4) In regulation 8(1) (hepgor a lleihau ffioedd)—

(a)at the end of sub-paragraph (ch) delete “neu”;

(b)at the end of sub-paragraph (d)(ii) replace the full stop with a semi-colon; and

(c)after sub-paragraph (d)(ii) insert—

(dd)lwfans cyflogaeth a chymorth yn seiliedig ar incwm sy’n daladwy o dan Ran 1 o Ddeddf Diwygio Lles 2007; neu

(e)credyd cynhwysol.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make amendments to the English and Welsh text of the Leasehold Valuation Tribunals (Fees) (Wales) Regulations 2004 (S.I. 2004/683) as a result of the introduction of universal credit by Part 1 of the Welfare Reform Act 2012.

Regulation 8 is amended so as allow the receipt of universal credit to be taken into account when determining whether a tribunal fee may be waived.

Some minor amendments are also made to the Welsh text of the Regulations so as to align both English and Welsh texts.
