<P2para><Text>The title of these Regulations is the Town and Country Planning (Compensation) (Wales) (No.2) Regulations 2014 and they come into force on 7 November 2014.</Text>

<Text>These Regulations apply in relation to Wales.</Text>

</P2>

<Text>In these Regulations—</Text>
<UnorderedList Decoration="none" Class="Definition">
<ListItem>
<Para><Text>“the Act” (“<Emphasis>y Ddeddf</Emphasis>”) means the Town and Country Planning Act 1990;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“the 1995 Order” (“<Emphasis>Gorchymyn 1995</Emphasis>”) means the Town and Country Planning (General Permitted Development) Order 1995<FootnoteRef Ref="f00003"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“the DMPO” (“<Emphasis>Gorchymyn y Weithdrefn Rheoli Datblygu</Emphasis>”) means the Town and Country Planning (Development Management Procedure) (Wales) Order 2012<FootnoteRef Ref="f00004"/>; and</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“Schedule 2” (“<Emphasis>Atodlen 2</Emphasis>”) means Schedule 2 to the 1995 Order.</Text>
</Para>
</ListItem>

</P1group>
<P1group RestrictExtent="E+W" RestrictStartDate="2026-06-01"><Title>Prescribed development – planning permission granted by development order</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2" id="regulation-2"><Pnumber><CommentaryRef Ref="key-3bf38b070b814061c6584f8158826173"/>2</Pnumber><P1para><Text>For the purposes of paragraphs (2A)(a) and (3C)(a) of section 108 of the Act (compensation where development order or local development order withdrawn), development of the following description is prescribed—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/a" id="regulation-2-a"><Pnumber>a</Pnumber><P3para><Text>development permitted by Part 1 of Schedule 2 (development within the curtilage of a dwellinghouse)<FootnoteRef Ref="f00005"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/aa" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/aa" id="regulation-2-aa"><Pnumber><Addition ChangeId="key-a0d6d523201f962cb560d328b8966a27-1762939801247" CommentaryRef="key-a0d6d523201f962cb560d328b8966a27">aa</Addition></Pnumber><P3para><Text><Addition ChangeId="key-a0d6d523201f962cb560d328b8966a27-1762939801247" CommentaryRef="key-a0d6d523201f962cb560d328b8966a27">development permitted by Class I of Part 3 of Schedule 2 (certain changes of use);</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/ab" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/ab" id="regulation-2-ab"><Pnumber><Addition ChangeId="key-7cc1322d66894a0c57969cb99e7943ff-1785236909701" CommentaryRef="key-7cc1322d66894a0c57969cb99e7943ff">ab</Addition></Pnumber><P3para><Text><Addition ChangeId="key-7cc1322d66894a0c57969cb99e7943ff-1785236909701" CommentaryRef="key-7cc1322d66894a0c57969cb99e7943ff">development permitted by Class BA of Part 4 of Schedule 2 (temporary buildings and uses);</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/b" id="regulation-2-b"><Pnumber>b</Pnumber><P3para><Text>development permitted by Classes A and E of Part 8 of Schedule 2 (extension or alteration of an industrial building or a warehouse and erection or construction of a refuse or cycle store within the curtilage of an industrial building or warehouse)<FootnoteRef Ref="f00006"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/c" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/c" id="regulation-2-c"><Pnumber>c</Pnumber><P3para><Text>Class A of Part 24 (development by electronic communications code operators (Wales))<FootnoteRef Ref="f00007"/> to the extent that paragraph A.2(4A) disapplies the conditions in paragraph A.3 of Class A and applies the conditions in paragraph A.2(4B) of Class A;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/d" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/d" id="regulation-2-d"><Pnumber>d</Pnumber><P3para><Text>development permitted by Part 32 of Schedule 2 (schools, colleges, universities and hospitals)<FootnoteRef Ref="f00008"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/e" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/e" id="regulation-2-e"><Pnumber>e</Pnumber><P3para><Text>development permitted by Part 40 of Schedule 2 (installation of domestic microgeneration equipment)<FootnoteRef Ref="f00009"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/f" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/f" id="regulation-2-f"><Pnumber>f</Pnumber><P3para><Text>development permitted by Part 41 of Schedule 2 (office buildings)<FootnoteRef Ref="f00010"/>;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/g" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/g" id="regulation-2-g"><Pnumber>g</Pnumber><P3para><Text>development permitted by Part 42 of Schedule 2 (shops, financial or professional services establishments)<FootnoteRef Ref="f00011"/>; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/2/h" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/2/h" id="regulation-2-h"><Pnumber>h</Pnumber><P3para><Text>development permitted by Part 43 of Schedule 2 (installation of non-domestic microgeneration equipment)<FootnoteRef Ref="f00012"/>.</Text></P3para></P3></P1para></P1></P1group>
<P1group RestrictExtent="E+W" RestrictStartDate="2022-10-20"><Title>Prescribed manner for withdrawing planning permission granted by development order</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/3" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/3" id="regulation-3"><Pnumber><CommentaryRef Ref="key-331cdf757a94ff6dfd3357fffb63abe7"/>3</Pnumber><P1para><Text>For the purposes of section 108(3C)(b) of the Act, the prescribed manner for withdrawing planning permission is—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/3/a" id="regulation-3-a"><Pnumber>a</Pnumber><P3para><Text>by direction in accordance with  <Substitution ChangeId="key-40f91d0435aeca4f04ba023583f3546f-1762939893135" CommentaryRef="key-40f91d0435aeca4f04ba023583f3546f">article 4</Substitution>  of the 1995 Order; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/3/b" id="regulation-3-b"><Pnumber>b</Pnumber><P3para><Text>by providing in a development order that planning permission—</Text><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/3/b/i" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/3/b/i" id="regulation-3-b-i"><Pnumber>i</Pnumber><P4para><Text>is for a limited period; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/3/b/ii" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/3/b/ii" id="regulation-3-b-ii"><Pnumber>ii</Pnumber><P4para><Text>is withdrawn after a date specified in the order.</Text></P4para></P4></P3para></P3></P1para></P1></P1group>
<P1group RestrictExtent="E+W" RestrictStartDate="2022-10-20"><Title>Notice of the withdrawal - prescribed manner of publication and period for development orders</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4" id="regulation-4"><Pnumber><CommentaryRef Ref="key-aa3ee5069de40bd28daf7da76daf9517"/>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>For the purposes of section 108(3C)(c) of the Act the following matters are prescribed.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>The prescribed manner in which notice of the withdrawal is to be published is—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4/2/a" id="regulation-4-2-a"><Pnumber>a</Pnumber><P3para><Text>in the manner described in  <Substitution ChangeId="key-b05436a674fd8c71d03419e2cae80e54-1762939976931" CommentaryRef="key-b05436a674fd8c71d03419e2cae80e54">paragraphs 1(1) to (5) of Schedule 2A to</Substitution>  the 1995 Order; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4/2/b" id="regulation-4-2-b"><Pnumber>b</Pnumber><P3para><Text>by providing in a development order that planning permission—</Text><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4/2/b/i" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4/2/b/i" id="regulation-4-2-b-i"><Pnumber>i</Pnumber><P4para><Text>is for a limited period; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4/2/b/ii" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4/2/b/ii" id="regulation-4-2-b-ii"><Pnumber>ii</Pnumber><P4para><Text>is withdrawn after a date specified in the development order.</Text></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4/3" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4/3" id="regulation-4-3"><Pnumber>3</Pnumber><P2para><Text>The prescribed period is—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4/3/a" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4/3/a" id="regulation-4-3-a"><Pnumber>a</Pnumber><P3para><Text>24 months; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2014/2693/regulation/4/3/b" IdURI="http://www.legislation.gov.uk/id/wsi/2014/2693/regulation/4/3/b" id="regulation-4-3-b"><Pnumber>b</Pnumber><P3para><Text>where notice of withdrawal is published in accordance with paragraph (2)(b), 5 years.</Text></P3para></P3></P2para></P2></P1para></P1></P1group>

<Title>Notice of withdrawal – prescribed manner and period for local development orders</Title>

<Pnumber>1</Pnumber>
<P2para><Text>For the purposes of section 108(3D)(c) of the Act the following matters are prescribed.</Text>

<Text>The prescribed manner for publication of notice of the revocation, amendment or directions is—</Text>

<Pnumber>a</Pnumber>

<Text>in the manner described in paragraphs (7) and (8) of article 27 of the DMPO; or</Text>

<Text>These Regulations do not apply in relation to any withdrawal of planning permission for development of a description prescribed in regulation 2(d) where, before 18 June 2012, either—</Text>

<Title>EXPLANATORY NOTE</Title>

<P><Text Hanging="indented">These Regulations prescribe various matters for the purposes of section 108 of the Town and Country Planning Act 1990.</Text></P>
<P><Text Hanging="indented">Section 108 provides for the payment of compensation in certain cases where planning permission for development granted by a development order or a local development order is withdrawn and where on an application for planning permission for that development, the application is refused or permission is granted subject to conditions.</Text></P>
<P><Text Hanging="indented">Section 108(2A) and (3B) to (3D) (as amended by the Planning Permission (Withdrawal of Development Order or Local Development Order) (Compensation) (Wales) Order 2012) (<Citation URI="http://www.legislation.gov.uk/id/wsi/2012/210" id="c00001" Class="WelshStatutoryInstrument" Year="2012" Number="0210" AlternativeNumber="W. 36">S.I. 2012/210 (W. 36)</Citation>) enable the circumstances in which compensation is payable to be limited.</Text></P>
<P><Text Hanging="indented">These Regulations prescribe types of development for the purposes of section 108(2A) and (3C) (regulation 2), the manner for withdrawing planning permission (regulation 3) and the manner, and maximum period, in which notice of withdrawal, revocation, amendment or directions is to be given (regulations 4 and 5).</Text></P>
<P><Text Hanging="indented">The prescribed types of development already include development permitted by the following parts of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (<Citation URI="http://www.legislation.gov.uk/id/uksi/1995/418" id="c00002" Class="UnitedKingdomStatutoryInstrument" Year="1995" Number="0418">S.I. 1995/418</Citation>) (“1995 Order”): Part 1 (development within the curtilage of a dwellinghouse); Class A of Part 8 (extension or alteration of an industrial building or warehouse) and Class E (refuse and cycle stores within the curtilage of an industrial building or warehouse); Part 32 (schools, colleges, universities and hospitals); Part 40 (installation of domestic microgeneration equipment); Part 41 (office buildings); Part 42 (shops and financial or professional services establishments) and Part 43 (installation of non-domestic microgeneration equipment).</Text></P>
<P><Text Hanging="indented">The prescribed types of development now also include Part 24 (development by electronic communications code operators (Wales)) to the extent that paragraph A.2(4A) disapplies the conditions in paragraph A.3 of Class A and applies the conditions in paragraph A.2(4B) of Class A.</Text></P>
<P><Text Hanging="indented">The effect of these Regulations is that when the permitted development rights identified in regulation 2 are withdrawn by directions under section 108(2A), compensation is only payable in respect of planning applications made within 12 months beginning on the date the directions took effect.</Text></P>
<P><Text Hanging="indented">The matters prescribed in regulations 3 and 4 relate to planning permission granted by development order and provide a mechanism for the permitted development rights identified in regulation 2 to be withdrawn without compensation being payable, provided the prescribed procedures are followed as to the manner of withdrawal, the manner of publishing the withdrawal and the maximum period of notice that may be given in respect of withdrawal. Regulation 5 makes similar provision regarding withdrawal of permitted development rights granted by a local development order.</Text></P>
<P><Text Hanging="indented">Regulations 3, 4 and 5 make provision consequential on the creation of a time-limited permitted development right in the Town and Country Planning (General Permitted Development) (Amendment) (Wales) (No.2) Order 2014, which amends the Town and Country Planning (General Permitted Development) Order 1995.</Text></P>
<P><Text Hanging="indented">Regulation 6 is a transitional provision.</Text></P>
<P><Text Hanging="indented">Regulation 7 revokes the Town and Country Planning (Compensation) (Wales) Regulations 2014 (<Citation URI="http://www.legislation.gov.uk/id/wsi/2014/593" id="c00003" Class="WelshStatutoryInstrument" Year="2014" Number="0593" AlternativeNumber="W. 70">S.I. 2014/593 (W. 70)</Citation>) which are remade in substance with amendments.</Text></P>
