The Welsh Ministers, in exercise of the powers conferred on the National Assembly for Wales by sections 28(6) and 47(5) of the Higher Education Act 2004(1), and now exercisable by them(2) make the following Regulations:

Title, commencement and application

1.—(1) The title of these Regulations is the Student Fees (Amounts) (Wales) (Amendment) Regulations 2014.

(2) These Regulations come into force on 31 August 2014 and apply in relation to Wales.

Amendment of the Student Fees (Amounts) (Wales) Regulations 2011

2.  The Student Fees (Amounts) (Wales) Regulations 2011(3) are amended in accordance with the following regulations.

3.  In regulation 3 for “Subject to regulation 4” substitute “Subject to regulations 4–6”.

4.  For regulation 4 substitute—

Prescribed basic and higher amounts for certain final academic years of courses and academic years of courses of initial training of teachers

4.   For the purpose of section 28 of the 2004 Act the basic amount is £2,000 and the higher amount is £4,500 in respect of:

(a) the final academic year of a course where that academic year is normally required to be completed after less than 15 weeks’ attendance;

(b) a course of initial training of teachers(4) (including such a course leading to a first degree), an academic year during which any periods of full time study are in aggregate less than 10 weeks.”

5.  After regulation 4 insert—

Prescribed basic and higher amounts for sandwich courses

5.   For the purpose of section 28 of the 2004 Act the basic amount is £800 and the higher amount is £1,800 in respect of an academic year of a sandwich course—

(a) during which any periods of full time study are in aggregate less than 10 weeks; or

(b) if in respect of that academic year and any previous academic years of the course the aggregate of any one or more periods of attendance which are not periods of full time study at the institution (disregarding intervening vacations) exceeds 30 weeks.

Prescribed basic and higher amounts for study and work placements overseas

6.   For the purpose of section 28 of the 2004 Act the basic amount is £600 and the higher amount is £1,350 in respect of an academic year of a course provided in conjunction with an overseas institution—

(a) during which any periods of full time study at the institution in the United Kingdom are in aggregate less than 10 weeks; or

(b) if in respect of that academic year and any previous academic years of the course the aggregate of any one or more periods of attendance which are not periods of full time study at the institution in the United Kingdom (disregarding intervening vacations) exceeds 30 weeks.”

EXPLANATORY NOTE

(This note is not part of the Regulations)

The Student Fees (Amounts) (Wales) Regulations 2011 (“the Principal Regulations”) prescribe the basic and higher amounts which relevant institutions may charge by way of tuition fees for full-time undergraduate qualifying courses in accordance with section 28 of the Higher Education Act 2004 (“the Act”), being conditions for the purposes of section 27 of the Act.

These Regulations amend the Principal Regulations.

Regulation 3 makes a minor amendment to regulation 3 of the Principal Regulations. The amendment provides that the basic and higher amounts prescribed by regulation 3 are subject to regulations 4-6.

Regulation 4 replaces regulation 4 of the Principal Regulations. Regulation 4 prescribes the basic and higher amounts in respect of the final academic year of a course where that academic year is normally required to be completed after less than 15 weeks’ attendance and in respect of an academic year of a course of initial training of teachers during which any periods of full time study are in aggregate less than 10 weeks.

Regulation 5 inserts two new regulations (5 and 6) which prescribe the basic and higher amounts for sandwich courses and for study and work placements overseas.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations.
