The Welsh Ministers make the following Order in exercise of the powers conferred upon them by section 38(2) of the Local Government (Wales) Measure 2009

In accordance with section 50(5) of that Measure, a draft of this instrument has been laid before and approved by resolution of the National Assembly for Wales.

In accordance with section 38(3)(b) of that Measure, the Welsh Ministers have consulted with the Police and Crime Commissioners in Wales, representatives of local authorities in Wales, and those representatives of community planning partners as they consider appropriate.

Title and commencement1.(1)

The title of this Order is the Local Government (Wales) Measure 2009 (Amendment) Order 2014.

This Order comes into force on the day after the day on which it is made.

Amendment of the Local Government (Wales) Measure 20092.(1)

The Local Government (Wales) Measure 2009 is amended as follows.

In section 38(1)(f) (meaning of “community planning partners”), for “police authority” substitute “police and crime commissioner”.

Part 2 of the Local Government (Wales) Measure 2009 (“the Measure”) introduces a system of community planning in Wales. Section 38(1) of the Measure provides a list of public bodies which are referred to as ‘community planning partners’ under Part 2 of the Measure. These bodies are required to participate in community planning. This list includes police authorities.

In accordance with the Police Reform and Social Responsibility Act 2011 (“the 2011 Act”), police authorities were abolished and replaced with Police and Crime Commissioners. To reflect the change made by the 2011 Act, article 2 of this Order removes police authorities from the list of community planning partners in the Measure and replaces them with Police and Crime Commissioners.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to this Order. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with this Order.
