							(“<Term id="term-sudd-ffrwythau-y-tynnwyd-dŵr-ohono"><Emphasis>sudd ffrwythau y tynnwyd dŵr ohono</Emphasis></Term>”) means a product that complies with the specification in Schedule 5; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/2/2/d" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/2/2/d" id="regulation-2-2-d"><Pnumber>d</Pnumber><P3para><Text>“<Term id="term-dehydrated-fruit-juice">dehydrated fruit juice</Term>”
							(“<Term id="term-sudd-ffrwythau-dadhydredig"><Emphasis>sudd ffrwythau dadhydredig</Emphasis></Term>”) or  “<Term id="term-powdered-fruit-juice">powdered fruit juice</Term>”
							(“<Term id="term-sudd-ffrwythau-powdr"><Emphasis>sudd ffrwythau powdr</Emphasis></Term>”) means a product that complies with the specification in Schedule 6.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/2/3" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/2/3" id="regulation-2-3"><Pnumber>3</Pnumber><P2para><Text>In these Regulations  “<Term id="term-fruit-nectar">fruit nectar</Term>”
					(“<Term id="term-neithdar-ffrwythau"><Emphasis>neithdar ffrwythau</Emphasis></Term>”) means a product that complies with the specification in Schedule 7.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>General interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/3/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/3/1" id="regulation-3-1"><Pnumber>1</Pnumber><P2para><Text>In these Regulations—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-act">the Act</Term>” (“<Term id="term-y-ddeddf"><Emphasis>y Ddeddf</Emphasis></Term>”) means the Food Safety Act 1990;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-authorised-additional-ingredient">authorised additional ingredient</Term>” (“<Term id="term-cynhwysyn-ychwanegol-awdurdodedig"><Emphasis>cynhwysyn ychwanegol awdurdodedig</Emphasis></Term>”) means an additional ingredient listed in Schedule 8;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-authorised-additional-substance">authorised additional substance</Term>” (“<Term id="term-sylwedd-ychwanegol-awdurdodedig"><Emphasis>sylwedd ychwanegol awdurdodedig</Emphasis></Term>”) means an additional substance listed in Schedule 9;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-authorised-treatment">authorised treatment</Term>” (“<Term id="term-triniaeth-awdurdodedig"><Emphasis>triniaeth awdurdodedig</Emphasis></Term>”) means a treatment listed in Schedule 10;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-concentrated-fruit-purïe">concentrated fruit purï¿½e</Term>” (“<Term id="term-piwrï-ffrwythau-wedi-ei-ddwysïu"><Emphasis>piwrï¿½ ffrwythau wedi ei ddwysï¿½u</Emphasis></Term>”) means the product obtained from fruit purï¿½e by the removal of a specific proportion of its water content, and in respect of which, if flavour has been restored to it, such flavour has been recovered from the same species of fruit;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-directive-2001112ec">Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0112" id="c00002" Class="EuropeanUnionDirective" Year="2001" Number="112">2001/112/EC</Citation></Term>” (“<Term id="term-cyfarwyddeb-2001112ec"><Emphasis>Cyfarwyddeb <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0112" id="c00003" Class="EuropeanUnionDirective" Year="2001" Number="112">2001/112/EC</Citation></Emphasis></Term>”) means Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0112" id="c00004" Class="EuropeanUnionDirective" Year="2001" Number="112">2001/112/EC</Citation> relating to fruit juices and certain similar products intended for human consumption <CommentaryRef Ref="c21942711"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-flavour">flavour</Term>” (“<Term id="term-blas"><Emphasis>blas</Emphasis></Term>”), except in paragraph 1 of Schedule 2 and Part 2 of Schedule 7, means flavour for restoration—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>that is obtained during the processing of fruit by applying suitable physical processes (including squeezing, extraction, distillation, filtration, adsorption, evaporation, fractionation and concentration) to obtain, retain, preserve or stabilise the flavour quality, and</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>that is cold-pressed oil from citrus peel or compounds from the stones of fruit or obtained from the edible parts of the fruit ;</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“fruit” (“<Emphasis>ffrwyth</Emphasis>”,  “<Emphasis>ffrwythau</Emphasis>”) means any kind of fruit (including tomatoes) that is sound, appropriately mature and fresh or preserved by—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>physical means, or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>a treatment, including a post-harvest treatment;</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-fruit-purïe">fruit purï¿½e</Term>” (“<Term id="term-piwrï-ffrwythau"><Emphasis>piwrï¿½ ffrwythau</Emphasis></Term>”) means the fermentable but unfermented product obtained by suitable physical processes such as sieving, grinding or milling the edible part of whole or peeled fruit without removing the juice;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-honey">honey</Term>” (“<Term id="term-mïl"><Emphasis>mï¿½l</Emphasis></Term>”) has the meaning given in point 1 of Annex I to Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0110" id="c00005" Class="EuropeanUnionDirective" Year="2001" Number="110">2001/110/EC</Citation> relating to honey <CommentaryRef Ref="c21942721"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-in-trade">in trade</Term>” (“<Term id="term-mewn-masnach"><Emphasis>mewn masnach</Emphasis></Term>”) has the same meaning as in Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0112" id="c00006" Class="EuropeanUnionDirective" Year="2001" Number="112">2001/112/EC</Citation> and cognate expressions are to be construed accordingly;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-pulp-or-cells">pulp or cells</Term>” (“<Term of citrus fruit, the juice sacs obtained from the endocarp, or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>in respect of any other fruit, the products obtained from the edible parts of the fruit without removing the juice;</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-regulation-19352004">Regulation 1935/2004</Term>” (“<Term id="term-rheoliad-19352004"><Emphasis>Rheoliad 1935/2004</Emphasis></Term>”) means Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2004/1935" id="c00007" Class="EuropeanUnionRegulation" Year="2004" Number="1935">(EC) No 1935/2004</Citation> of the European Parliament and of the Council on materials and articles intended to come into contact with food and repealing Directives <Citation URI="http://www.legislation.gov.uk/european/directive/1980/0590" id="c00008" Class="EuropeanEconomicCommunityDirective" Year="1980" Number="590">80/590/<Acronym Expansion="European Economic Community">EEC</Acronym></Citation> and <Citation URI="http://www.legislation.gov.uk/european/directive/1989/0109" id="c00009" Class="EuropeanEconomicCommunityDirective" Year="1989" Number="109">89/109/EEC</Citation> <CommentaryRef Ref="c21942731"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-regulation-13332008">Regulation 1333/2008</Term>” (“<Term id="term-rheoliad-13332008"><Emphasis>Rheoliad 1333/2008</Emphasis></Term>”) means Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2008/1333" id="c00010" Class="EuropeanUnionRegulation" Year="2008" Number="1333">(EC) No 1333/2008</Citation> of the European Parliament and of the Council on food additives <CommentaryRef Ref="c21942741"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-regulated-product">regulated product</Term>” (“<Term id="term-cynnyrch-rheoleiddiedig"><Emphasis>cynnyrch rheoleiddiedig</Emphasis></Term>”) means any of the following—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>a fruit juice;</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>a fruit juice from concentrate;</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>a concentrated fruit juice;</Text></Para></ListItem><ListItem NumberOverride="d"><Para><Text>a water extracted fruit juice;</Text></Para></ListItem><ListItem NumberOverride="e"><Para><Text>a dehydrated fruit juice;</Text></Para></ListItem><ListItem NumberOverride="f"><Para><Text>a powdered fruit juice;</Text></Para></ListItem><ListItem NumberOverride="g"><Para><Text>a fruit nectar; and</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-sugars">sugars</Term>” (“<Term id="term-siwgrau"><Emphasis>siwgrau</Emphasis></Term>”) means any of the following—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>sugars as defined by Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0111" id="c00011" Class="EuropeanUnionDirective" Year="2001" Number="111">2001/111/EC</Citation> relating to certain sugars intended for human consumption <CommentaryRef Ref="c21942751"/>;</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>fructose syrup;</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>sugars derived from fruits.</Text></Para></ListItem></OrderedList></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/3/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/3/2" id="regulation-3-2"><Pnumber>2</Pnumber><P2para><Text>Any other expression not defined in these Regulations and used in these Regulations and Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0112" id="c00012" Class="EuropeanUnionDirective" Year="2001" Number="112">2001/112/EC</Citation> has the same meaning in these Regulations as in that Directive.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/3/3" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/3/3" id="regulation-3-3"><Pnumber>3</Pnumber><P2para><Text>In these Regulations, any reference to an EU instrument listed in Schedule 1 is a reference to that instrument as amended from time to time.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Use of the name fruit juice</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/4" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/4" id="regulation-4"><Pnumber>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>A person trading in a fruit juice must use the name  “[x] juice” as the name of the product with the relevant name of the fruit from which the juice comes substituting  “[x]” in accordance with regulation 10.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>But paragraph (1) does not prevent a name listed in column 2 of Schedule 11 being used as the name of a fruit juice provided that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/4/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/4/2/a" id="regulation-4-2-a"><Pnumber>a</Pnumber><P3para><Text>the name is in the language provided for in column 2 of that Schedule, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/4/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/4/2/b" id="regulation-4-2-b"><Pnumber>b</Pnumber><P3para><Text>the fruit juice meets the requirements of the corresponding product description in column 3 of that Schedule.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/4/3" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/4/3" id="regulation-4-3"><Pnumber>3</Pnumber><P2para><Text>A person must not use the name  “fruit juice”, or  “juice” together with the name of a fruit, in trade, as the name of a product if the product is not fruit juice.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Use of the name fruit juice from concentrate</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/5" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/5" id="regulation-5"><Pnumber>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/5/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/5/1" id="regulation-5-1"><Pnumber>1</Pnumber><P2para><Text>A person trading in a fruit juice from concentrate must use the name  “[x] juice from concentrate” as the name of the product with the relevant name of the fruit from which the juice comes substituting  “[x]” in accordance with regulation 10.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/5/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/5/2" id="regulation-5-2"><Pnumber>2</Pnumber><P2para><Text>A person must not use the name  “fruit juice from concentrate”, or  “juice from concentrate” together with the name of a fruit, in trade, as the name of a product if the product is not fruit juice from concentrate.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Use of the name concentrated fruit juice</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/6" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/6" id="regulation-6"><Pnumber>6</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/6/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/6/1" id="regulation-6-1"><Pnumber>1</Pnumber><P2para><Text>A person trading in a concentrated fruit juice must use the name  “concentrated [x] juice” as the name of the product with the relevant name of the fruit from which the juice comes substituting  “[x]” in accordance with regulation 10.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/6/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/6/2" id="regulation-6-2"><Pnumber>2</Pnumber><P2para><Text>A person must not use the name  “concentrated fruit juice”, or  “concentrated juice” together with the name of a fruit, in trade, as the name of a product if the product is not concentrated fruit juice.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Use of the name water extracted fruit juice</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/7" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/7" id="regulation-7"><Pnumber>7</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/7/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/7/1" id="regulation-7-1"><Pnumber>1</Pnumber><P2para><Text>A person trading in a water extracted fruit juice must use the name  “water extracted [x] juice” as the name of the product with the relevant name of the fruit from which the juice comes substituting  “[x]” in accordance with regulation 10.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/7/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/7/2" id="regulation-7-2"><Pnumber>2</Pnumber><P2para><Text>A person must not use the name  “water extracted fruit juice”, or  “water extracted juice” together with the name of a fruit, in trade, as the name of a product if the product is not water extracted fruit juice.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Use of the name dehydrated fruit juice and powdered fruit juice</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/8" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/8" id="regulation-8"><Pnumber>8</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/8/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/8/1" id="regulation-8-1"><Pnumber>1</Pnumber><P2para><Text>A person trading in a product that complies with the specifications in Schedule 6 must use the name  “dehydrated [x] juice” or  “powdered [x] juice” as the name of the product with the relevant name of the fruit from which the juice comes substituting  “[x]” in accordance with regulation 10.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/8/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/8/2" id="regulation-8-2"><Pnumber>2</Pnumber><P2para><Text>A person must not use the name  “dehydrated fruit juice” or  “powdered fruit juice”, or  “dehydrated juice” or  “powdered juice” together with the name of a fruit, in trade, as the name of a product if the product does not comply with the specifications in Schedule 6.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Use of the name fruit nectar</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/9" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/9" id="regulation-9"><Pnumber>9</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/9/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/9/1" id="regulation-9-1"><Pnumber>1</Pnumber><P2para><Text>A person trading in a fruit nectar must use the name  “[x] nectar” as the name of the product with the relevant name of the fruit from which the nectar comes substituting  “[x]” in accordance with regulation 10.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/9/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/9/2" id="regulation-9-2"><Pnumber>2</Pnumber><P2para><Text>But paragraph (1) does not prevent a name listed in column 2 of Schedule 12 being used as the name of a fruit nectar provided that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/9/2/a" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/9/2/a" id="regulation-9-2-a"><Pnumber>a</Pnumber><P3para><Text>the name is in the language provided for in column 2 of that Schedule, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/9/2/b" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/9/2/b" id="regulation-9-2-b"><Pnumber>b</Pnumber><P3para><Text>the fruit nectar meets the requirements of any corresponding product description in column 3 of that Schedule.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/9/3" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/9/3" id="regulation-9-3"><Pnumber>3</Pnumber><P2para><Text>A person must not use the name  “fruit nectar”, or  “nectar” together with the name of a fruit, in trade, as the name of a product if the product is not fruit nectar.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Indication of kinds of fruits used</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10" id="regulation-10"><Pnumber>10</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/1" id="regulation-10-1"><Pnumber>1</Pnumber><P2para><Text>A person must not trade in a regulated product unless the name of the product indicates the kinds of fruit from which it has come in accordance with paragraphs (2) to (7).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/2" id="regulation-10-2"><Pnumber>2</Pnumber><P2para><Text>If a regulated product is manufactured from a single kind of fruit, the name of that fruit must substitute  “[x]” in the product name.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/3" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/3" id="regulation-10-3"><Pnumber>3</Pnumber><P2para><Text>If a regulated product is manufactured from two kinds of fruit (excluding the use of one or more of lemon juice, lime juice, concentrated lemon juice and concentrated lime juice in accordance with paragraph 3 of Schedule 8), a list of the names of the fruits used must substitute the <InlineAmendment>“

              ”</InlineAmendment> in the product name.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/4" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/4" id="regulation-10-4"><Pnumber>4</Pnumber><P2para><Text>If a regulated product is manufactured from three or more kinds of fruit (excluding the use of one or more of lemon juice, lime juice, concentrated lemon juice and concentrated lime juice in accordance with paragraph 3 of Schedule 8), the  “[x]” in the product name must be substituted by—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/4/a" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/4/a" id="regulation-10-4-a"><Pnumber>a</Pnumber><P3para><Text>a list of the names of the fruits used;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/4/b" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/4/b" id="regulation-10-4-b"><Pnumber>b</Pnumber><P3para><Text>the words  “several fruits” or similar wording; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/4/c" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/4/c" id="regulation-10-4-c"><Pnumber>c</Pnumber><P3para><Text>the number of kinds of fruit used.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/5" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/5" id="regulation-10-5"><Pnumber>5</Pnumber><P2para><Text>For the purposes of paragraph (3) and (4)(a), the list of the names of the fruits must be set out in descending order by volume of the juices or purï¿½es included from each kind of fruit, as indicated in the list of ingredients.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/6" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/6" id="regulation-10-6"><Pnumber>6</Pnumber><P2para><Text>Where a species of fruit listed in column 2 of Schedule 13 is used in the preparation of a fruit juice, fruit purï¿½e or fruit nectar, the name given as the name of the fruit in the product name in accordance with the requirements of this regulation must be—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/6/a" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/6/a" id="regulation-10-6-a"><Pnumber>a</Pnumber><P3para><Text>the common name for the fruit specified in column 1 of Schedule 13, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/6/b" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/6/b" id="regulation-10-6-b"><Pnumber>b</Pnumber><P3para><Text>the botanical name for the fruit specified in column 2 of Schedule 13.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/7" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/7" id="regulation-10-7"><Pnumber>7</Pnumber><P2para><Text>In the case of any other species of fruit used in the preparation of a fruit juice, fruit purï¿½e or fruit nectar, the name given as the name of the fruit in the product name in accordance with the requirements of this regulation must be—</Text><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/7/a" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/7/a" id="regulation-10-7-a"><Pnumber>a</Pnumber><P3para><Text>the common name for the fruit, or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/7/b" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/7/b" id="regulation-10-7-b"><Pnumber>b</Pnumber><P3para><Text>the botanical name for the fruit.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/10/8" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/10/8" id="regulation-10-8"><Pnumber>8</Pnumber><P2para><Text>In this regulation any reference to the  “<Term id="term-x">[x]</Term>” in a product name must be construed taking into account the provisions relating to product names in regulations 4 to 9.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Indication of added extra pulp and cells</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/11" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/11" id="regulation-11"><Pnumber>11</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/11/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/11/1" id="regulation-11-1"><Pnumber>1</Pnumber><P2para><Text>A person must not trade in a fruit juice to which there has been added extra pulp or cells unless its labelling indicates such addition.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/11/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/11/2" id="regulation-11-2"><Pnumber>2</Pnumber><P2para><Text>In paragraph (1),  “<Term id="term-fruit-juice">fruit juice</Term>” (“<Term id="term-sudd-ffrwythau"><Emphasis>sudd ffrwythau</Emphasis></Term>”) has the same meaning as in the second sub-paragraph of point 5 of Article 3 of Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2001/0112" id="c00013" Class="EuropeanUnionDirective" Year="2001" Number="112">2001/112/EC</Citation>.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Labelling of a fruit juice partially made from concentrate</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/12" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/12" id="regulation-12"><Pnumber>12</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/12/1" for delivery to the final consumer unless it indicates on its packaging, on a label attached to its packaging or in an accompanying document, of the presence and quantity in it of any of the id="regulation-13-c"><Pnumber>c</Pnumber><P3para><Text>acidifying agents permitted by Regulation 1333/2008.</Text></P3para></P3></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Labelling of a fruit nectar</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/14" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/14" id="regulation-14"><Pnumber>14</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/14/1" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/14/1" id="regulation-14-1"><Pnumber>1</Pnumber><P2para><Text>A person must not trade in a fruit nectar unless the labelling of the product complies with paragraphs (2) to (8).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/14/2" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/14/2" id="regulation-14-2"><Pnumber>2</Pnumber><P2para><Text>The labelling of a fruit nectar must indicate the minimum content of fruit juice, fruit purï¿½e or mixture of fruit juice and fruit purï¿½e that it contains, using the words  “fruit content: [x]% minimum” with the appropriate figure being substituted for  “[x]”.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/14/3" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/14/3" id="regulation-14-3"><Pnumber>3</Pnumber><P2para><Text>The wording required by paragraph (2) must be located in the same field of vision as the product name.</Text></P2para></P2><P2 product name in characters that are clearly visible and stand out well from the background against which it appears.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/14/7" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/14/7" id="regulation-14-7"><Pnumber>7</Pnumber><P2para><Text>A claim stating that sugars have not been added to a fruit nectar, or any claim likely to have the same meaning for the consumer, may not be made unless the product does not contain any added monosaccharides or disaccharides or any other food used for its sweetening properties, including sweeteners as defined in Regulation 1333/2008.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/14/8" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/14/8" id="regulation-14-8"><Pnumber>8</Pnumber><P2para><Text>Where a claim stating that sugars have not been added to a fruit nectar, or any claim likely to have the same meaning for the consumer, is made and sugars are naturally present in the fruit nectar, the words  “contains naturally occurring sugars” must also appear on the label.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Manner of marking or labelling</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/15" Regulations.</Text></P1para></P1></P1group><P1group RestrictStartDate="2013-10-28" RestrictExtent="E+W" TerritorialApplication="W"><Title>Improvement notice – application of subsections (1) and (2) of section 10 of the Act</Title><P1 DocumentURI="http://www.legislation.gov.uk/wsi/2013/2750/regulation/17" IdURI="http://www.legislation.gov.uk/id/wsi/2013/2750/regulation/17" id="regulation-17-1"><Pnumber>1</Pnumber><P2para><Text>Subsections (1) and (2) of section 10 of the Act (improvement notices) apply for the purposes of these Regulations with the following Format="default"><P2><Pnumber>1</Pnumber><P2para><Text>If an authorised officer of an enforcement authority has reasonable grounds for believing that a person is failing to comply with a provision of the Fruit Juices and Fruit Nectars (Wales) Regulations 2013 specified in subsection (1A), the authorised officer may, by a notice served on that person (in this Act referred to as an  “<Term>improvement notice</Term>”)—</Text><P3><Pnumber>a</Pnumber><P3para><Text>state the officer's grounds for believing that the person is failing to comply with the relevant provision;</Text></P3para></P3><P3><Pnumber>b</Pnumber><P3para><Text>specify the matters which constitute the person's failure so to comply;</Text></P3para></P3><P3><Pnumber>c</Pnumber><P3para><Text>specify the measures which, in the officer's opinion, the person must take in order to secure compliance; and</Text></P3para></P3><P3><Pnumber>d</Pnumber><P3para><Text>require the person to take those measures, or measures that are at least equivalent to them, within such period (not being less than 14 days) as may be specified in the notice.</Text></P3para></P3></P2para></P2><P2><Pnumber>1A</Pnumber><P2para><Text>The provisions are—</Text><P3><Pnumber>a</Pnumber><P3para><Text>regulation 4(1), as They revoke and replace the Fruit Juices and Fruit Nectars (Wales) Regulations 2003 (<Acronym Expansion="Statutory Instrument">S.I.</Acronym> 2003/3041 (W. 286)), as amended.</Text></Para></BlockText></P><P><BlockText><Para><Text>The Regulations regulate the use of the names fruit juice (regulation 4 and Schedules 2 and 11), fruit juice from concentrate (regulation 5 and Schedules 3 and 13), concentrated fruit juice (regulation 6 and Schedule 4), water extracted fruit juice (regulation 7 and Schedule 5), dehydrated fruit juice and powdered fruit juice (regulation 8 and Schedule 6) and fruit nectar (regulation 9 and Schedules 7 and 12).</Text></Para></BlockText></P><P><BlockText><Para><Text>They lay down what additional ingredients and substances may be added to regulated products (Schedules 8 and 9) and what treatments the products may undergo in their manufacture (Schedule 10).</Text></Para></BlockText></P><P><BlockText><Para><Text>They require certain particulars to be indicated when trading in regulated products, including—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>a requirement to indicate the kinds of fruits, or (in some cases) the number of kinds of fruits, used to make a regulated product (regulation 10);</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>an indication of whether extra pulp and cells have been added to a fruit juice (regulation 11);</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>a requirement for a fruit juice made from a mixture of fruit juice and fruit juice from concentrate to indicate that it is partially made from concentrate or concentrates (regulation 12);</Text></Para></ListItem><ListItem NumberOverride="d"><Para><Text>a requirement to indicate any added lemon juice, lime juice or acidifying agents in a concentrated fruit juice that is not intended for delivery to the final consumer (regulation 13); and</Text></Para></ListItem><ListItem NumberOverride="e"><Para><Text>various indications for a fruit nectar, including an indication of its fruit content (regulation 14).</Text></Para></ListItem></OrderedList></BlockText></P><P><BlockText><Para><Text>The Regulations make provision relating to the manner in which the particulars required by these Regulations should be marked or labelled (regulation 15).</Text></Para></BlockText></P><P><BlockText><Para><Text>These Regulations impose an obligation on food authorities to enforce the Regulations (regulation 16).</Text></Para></BlockText></P><P><BlockText><Para><Text>The Regulations apply with modifications subsections (1) and (2) of section 10 of the Food Safety Act 1990 (1990 c.16), enabling an improvement notice to be served to require compliance with specified provisions of these Regulations (regulation 17). The provisions, as applied, make the failure to comply with an improvement notice an offence. In addition, the Regulations apply with modifications subsections (1) and (6) of section 37, and section 39, of the Food Safety Act 1990 enabling a decision to serve an improvement notice to be appealed (regulation 18).</Text></Para></BlockText></P><P><BlockText><Para><Text>The Regulations also apply certain other provisions of the Food Safety Act 1990, with modifications (regulation 19 and Schedule 14).</Text></Para></BlockText></P><P><BlockText><Para><Text>The Regulations also provide for the revocation of certain legislation (regulation 20), consequential amendments (regulation 21 and Schedule 15) and transitional provisions (regulation 22).</Text></Para></BlockText></P><P><BlockText><Para><Text>TheWelsh Ministers' Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations.
