of the Town and Country Planning Act 1990<authorialNote class="footnote" eId="f00001" marker="1"><p><ref eId="c00001" href="http://www.legislation.gov.uk/id/ukpga/1990/8">1990 c. 8</ref>. Section 198(8) was inserted by the Planning and Compulsory Purchase Act <ref eId="c00002" href="http://www.legislation.gov.uk/id/ukpga/2004/5">2004 (c. 5)</ref> section 42(3). Section 333(1) was amended by the Environment Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/1995/25">1995 (c. 25)</ref> section 78 and Schedule 10, paragraph 32(12).</p></authorialNote> and now exercisable by them<authorialNote class="footnote" eId="f00002" marker="2"><p>Functions under those sections, so far as exercisable in relation to Wales, were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (<ref eId="c00004" href="http://www.legislation.gov.uk/id/uksi/1999/672">S.I. 1999/672</ref>). By virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act <ref eId="c00005" href="http://www.legislation.gov.uk/id/ukpga/2006/32">2006 (c. 32)</ref>, those functions are now exercisable by the Welsh Ministers.</p></authorialNote>, make the following Regulations.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Title, commencement and application</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>The title of these Regulations is the Town and Country Planning (Trees) (Amendment) (Wales) Regulations 2012 and they come into force on 30 April 2012.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><intro><p>These Regulations apply in relation to—</p></intro><level class="para1" eId="regulation-1-2-a"><num>(a)</num><content><p>applications made on or after 30 April 2012; and</p></content></level><level class="para1" eId="regulation-1-2-b"><num>(b)</num><content><p>Wales.</p></content></level></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendments to the Town and Country Planning (Trees) Regulations 1999</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>The Town and Country Planning (Trees) Regulations 1999<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/uksi/1999/1892">S.I. 1999/1892</ref> to which there are amendments not relevant to this instrument.</p></authorialNote> are amended as follows.</p></content></paragraph><paragraph eId="regulation-2-2"><num>(2)</num><content><p><mod>After regulation 9A insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="wsi" ukl:TargetClass="secondary" ukl:TargetSubClass="regulation" ukl:Context="main" ukl:Format="default"><hcontainer name="regulation"><heading>Applications for consent under tree preservation order: Wales</heading><num>9B.</num><paragraph><num>(1)</num><intro><p>Subject to the following provisions of this regulation, an application for consent to the cutting down, topping, lopping or uprooting of any tree in respect of which an order is for the time being in force must—</p></intro><level class="para1"><num>(a)</num><intro><p>be made in writing to the authority—</p></intro><level class="para2"><num>(i)</num><content><p>on a form published by the Welsh Ministers for the purpose of proceedings under these Regulations; or</p></content></level><level class="para2"><num>(ii)</num><content><p>where the authority has consented to applications being made electronically, on a form published electronically by the Welsh Ministers and provided to the applicant using electronic communication for that purpose;</p></content></level></level><level class="para1"><num>(b)</num><content><p>include the particulars specified in the form;</p></content></level><level class="para1"><num>(c)</num><intro><p>be accompanied, whether electronically or otherwise by—</p></intro><level class="para2"><num>(i)</num><content><p>a plan which identifies the tree or trees to which the application relates;</p></content></level><level class="para2"><num>(ii)</num><content><p>such information as is necessary to specify the work for which consent is sought;</p></content></level><level class="para2"><num>(iii)</num><content><p>a statement of the applicant’s reasons for making the application; and</p></content></level><level class="para2"><num>(iv)</num><content><p>appropriate evidence describing any structural damage to property or in relation to tree health or safety, as applicable.</p></content></level></level></paragraph><paragraph><num>(2)</num><intro><p>Where an application is made using electronic communication, the applicant is taken to have agreed—</p></intro><level class="para1"><num>(a)</num><content><p>to the use of such communication by the authority for the purposes of the application;</p></content></level><level class="para1"><num>(b)</num><content><p>that the applicant’s address for those purposes is the address incorporated into, or otherwise logically associated with, the application; and</p></content></level><level class="para1"><num>(c)</num><intro><p>that deemed agreement under this paragraph will subsist until the applicant gives notice in writing—</p></intro><level class="para2"><num>(i)</num><content><p>withdrawing any address notified to the authority for that purpose; or</p></content></level><level class="para2"><num>(ii)</num><content><p>revoking that deemed agreement,</p></content></level><wrapUp><p>and such withdrawal or revocation will be final and must take effect on the date specified by the applicant in the notice being not less than seven days after the date on which the notice is given.</p></wrapUp></level></paragraph></hcontainer></quotedStructure><inline name="appendText">.</inline></mod></p></content></paragraph><paragraph eId="regulation-2-3"><num>(3)</num><intro><p>In the Schedule (form of tree preservation order)—</p></intro><level class="para1" eId="regulation-2-3-a"><num>(a)</num><content><p>omit article 6 (applications for consent under the order);
